The Oversight Law (Draft) of the People's Republic of China has been deliberated at the 28th Session of the Standing Committee of the Twelfth National People's Congress. The Oversight Law of the People's Republic of China (Draft) is hereby issued on the website of the National People's Congress, and the public may directly make comments on the website of the National People's Congress (www.npc.gov.cn), or mail the comments to the Legislative Affairs Commission of the Standing Committee of the National People's Congress (No. 1 Qianmen West Street, Xicheng District, Beijing, 100805. Please indicate “Comments on the Draft Oversight Law” on the envelope). Please submit comments before December 6, 2017. | |

| Article 4 The oversight work of the state shall comply with the Constitution and laws, take facts as the basis and laws as the criterion, give equal consideration to power and responsibility, and conduct strict supervision, and integrate punishment with education and leniency with severity. Equal attention shall be paid to temporary and permanent solutions, a tough stance shall be maintained, so as to form a sustainable deterrent, and no one dare to be corrupt. Reform shall be deepened, the rule of law shall be improved, and power shall be effectively restricted and overseen, so that no one can be corrupted. | Chapter II Oversight Authorities | | 第二章 监察机关 |

| Article 5 The Oversight Commission of the People's Republic of China (“PRC Oversight Commission”) shall be the highest oversight authority of the state. | | 第五条 中华人民共和国监察委员会是最高国家监察机关。 |
Provinces, autonomous regions, municipalities directly under the Central Government, autonomous prefectures, counties, autonomous counties, cities, and municipal districts shall set up oversight committees. | |

Oversight committees at all levels shall be specialized authorities for the exercise of oversight functions of the state. | |

| Article 6 The PRC Oversight Commission shall be created by the National People's Congress, and shall be responsible for the oversight work nationwide. | | 第六条 中华人民共和国监察委员会由全国人民代表大会产生，负责全国监察工作。 |
The PRC Oversight Commission shall consist of a director, several deputy directors and several members. The director shall be elected by the National People's Congress and deputy directors and members shall be appointed or removed by the Standing Committee of the National People's Congress as proposed by the director of the PRC Oversight Commission. | |

| Article 7 A local oversight committee at or above the county level shall be created by the people's congress at the same level, and shall be responsible for the oversight work within its administrative region. | | 第七条 县级以上地方各级监察委员会由本级人民代表大会产生，负责本行政区域内的监察工作。 |
A local oversight committee at or above the county level shall consist of a director, several deputy directors and several members. The director shall be elected by the people's congress at the same level, and deputy directors and members shall be appointed or removed by the standing committee of the people's congress at the same level as proposed by the director of the oversight committee. | |

| Article 8 The PRC Oversight Commission shall lead the work of local oversight committees at all levels, and oversight committees at higher levels shall lead the work of oversight committees at lower levels. | | 第八条 中华人民共和国监察委员会领导地方各级监察委员会的工作，上级监察委员会领导下级监察委员会的工作。 |

| Article 9 As required for work, an oversight committee at any level may, upon approval, dispatch an oversight body and oversight officials to Party organs, state authorities, organizations and entities administering public affairs at the same level, or administrative regions under its jurisdiction, and the oversight body and oversight officials shall be responsible to the oversight authority dispatching them. | | 第九条 各级监察委员会根据工作需要，经批准，可以向本级党的机关、国家机关、管理公共事务的组织和单位、所管辖的行政区域派出监察机构、监察专员，监察机构、监察专员对派出它的监察机关负责。 |

| Article 10 Oversight authorities shall independently exercise the oversight power in accordance with the law, and no organization or individual may refuse, obstruct or interfere with oversight officials' legal performance of duties in accordance with the law, or retaliate against them. | | 第十条 监察机关依法独立行使监察权，任何组织和个人不得拒绝、阻碍或者干涉监察人员依法执行职务，不得对其打击报复。 |

| Article 11 Censors are the oversight officials who exercise the oversight power in accordance with the law. The state shall implement a hierarchical system for censors, and establish the measures for the hierarchical setup, assessment and promotion of censors. | | 第十一条 监察官是依法行使监察权的监察人员。国家实行监察官等级制度，制定监察官等级设置、评定和晋升办法。 |

| Chapter III Scope of Oversight | | 第三章 监察范围 |

|
| Article 12 Oversight authorities shall conduct oversight of the following public officials in accordance with their administration authority: | | 第十二条 监察机关按照管理权限对下列公职人员进行监察： |

|
| (1) Civil servants of organs of the Communist Party of China, organs of people's congresses, administrative authorities, CPPCC authorities, oversight authorities, judicial authorities, procuratorial authorities, organs of democratic parties and associations of industry and commerce, and persons managed, mutatis mutandis, by the Civil Servant Law of the People's Republic of China. | | （一）中国共产党的机关、人大机关、行政机关、政协机关、监察机关、审判机关、检察机关、民主党派和工商联机关的公务员及参照《中华人民共和国公务员法》管理的人员； |
| |
|
| (2) Personnel engaged in public affairs at organizations authorized by laws or regulations, or lawfully entrusted by state authorities with the management of public affairs. | | （二）法律、法规授权或者受国家机关依法委托管理公共事务的组织中从事公务的人员； |
| |
|
| (3) Managers of state-owned enterprises. | | （三）国有企业管理人员； |
| |
|
| (4) Personnel engaged in management in public entities in education, scientific research, culture, health care, and sports, among others. | | （四）公办的教育、科研、文化、医疗卫生、体育等单位中从事管理的人员； |
| |
|
| (5) Personnel engaged in the management of collective affairs at basic-level self-governing mass organizations. | | （五）基层群众性自治组织中从事集体事务管理的人员； |
| |
|
| (6) Other personnel who perform public duties in accordance with the law. | | （六）其他依法履行公职的人员。 |
| |
|
| Article 13 The oversight authority at a higher level may handle oversight matters under the jurisdiction of the oversight authority at the next lower level, and when necessary, may also handle oversight matters of oversight authorities at all levels under its jurisdiction. | | 第十三条 上级监察机关可以办理下一级监察机关管辖范围内的监察事项，必要时也可以办理所辖各级监察机关管辖范围内的监察事项。 |
Where oversight authorities have disputes over oversight matters, the disputes shall be determined by their common oversight authority at the higher level. | |
监察机关之间对监察事项有争议的，由其共同的上级监察机关确定。 |

| Article 14 The oversight authority at a higher level may designate an oversight authority at a lower level to exercise jurisdiction over oversight matters under its jurisdiction, or may designate another oversight authority to exercise jurisdiction over oversight matters under the jurisdiction of an oversight authority at a lower level. | | 第十四条 上级监察机关可以将其所管辖的监察事项指定下级监察机关管辖，也可以将下级监察机关有管辖权的监察事项指定给其他监察机关管辖。 |
Where the oversight authority is of the opinion that the oversight matters under its jurisdiction are major or complicated and need to be subject to the jurisdiction of the oversight authority at a higher level, it may request the transfer to the oversight authority at a higher level for jurisdiction. | |
监察机关认为所管辖的监察事项重大、复杂，需要由上级监察机关管辖的，可以请求移送上级监察机关管辖。 |

| Chapter IV Oversight Functions | | 第四章 监察职责 |
| |
|
| Article 15 The main functions of the oversight authority in exercising the oversight power in accordance with the law are: | | 第十五条 监察机关依法行使监察权，主要职能是： |

|
| (1) Maintaining the Constitution, laws and regulations. | | （一）维护宪法和法律法规； |
| |
|
| (2) Legally overseeing public officials' exercise of public power, and investigating duty-related violations of law and crimes. | | （二）依法监察公职人员行使公权力的情况，调查职务违法和职务犯罪； |
| |
|
| (3) Building a clean government and conducting anti-corruption work. | | （三）开展廉政建设和反腐败工作。 |
The functions of the oversight authority are supervision, investigation and disposition. | |
监察机关的职责是监督、调查、处置。 |
| |
|
| Article 16 Supervision. Oversight authorities shall conduct supervision and inspection of public officials' performance of functions in accordance with the law, impartial exercise of power, clean administration, and moral integrity. | | 第十六条 监督。监察机关对公职人员依法履职、秉公用权、廉洁从政从业以及道德操守情况进行监督检查。 |

| Article 17 Investigation. Oversight authorities shall conduct investigations of duty-related violations of laws and crimes such as suspected corruption and bribery, abuse of power, negligence of duty, power rent-seeking, tunneling, practice of favoritism and falsification, as well as the waste of state assets. | | 第十七条 调查。监察机关对涉嫌贪污贿赂、滥用职权、玩忽职守、权力寻租、利益输送、徇私舞弊以及浪费国家资财等职务违法和职务犯罪进行调查。 |

| Article 18 Disposition. Oversight authorities shall, in accordance with relevant laws, make decisions on disciplinary actions in respect of government affairs against public officials who violate any law, offer oversight suggestions as to problems in the exercise of functions and powers, hold liable those who fail to perform their functions in an effective manner or leaders who neglect their duties and responsibilities, and transfer investigation results on suspected duty-related crimes to procuratorial authorities for initiating a public prosecution in accordance with the law. | | 第十八条 处置。监察机关依据相关法律对违法的公职人员作出政务处分决定；对在行使职权中存在的问题提出监察建议；对履行职责不力、失职失责的领导人员进行问责；对涉嫌职务犯罪的，将调查结果移送检察机关依法提起公诉。 |

| Article 19 On the basis of their authorization, dispatched oversight authorities shall, in accordance with the law, conduct supervision of relevant authorities, organizations, entities, and public officials of administrative regions and offer oversight suggestions, legally investigate and punish public officials who are suspected of involving in any duty-related violation of law according to the administration authority, and make decisions on disciplinary actions in respect of government affairs. | | 第十九条 派出的监察机构根据授权，依法对有关机关、组织和单位、行政区域的公职人员进行监督，提出监察建议；按照管理权限对涉嫌职务违法的公职人员依法进行调查、处置，并作出政务处分决定。 |

| Chapter V Oversight Power | | 第五章 监察权限 |
| |
|
| Article 20 Oversight authorities excising their functions and powers have the right to collect and acquire evidence from relevant entities and individuals in accordance with the law. Relevant entities and individuals shall faithfully provide evidence. | | 第二十条 监察机关行使职权，有权依法向有关单位和个人收集、调取证据。有关单位和个人应当如实提供证据。 |
Evidence that involves any state secret, trade secret or personal privacy shall be kept confidential. | |
对涉及国家秘密、商业秘密、个人隐私的证据，应当保密。 |
Anyone who forges, conceals, or destroys evidence shall be subject to legal liability, no matter which party the evidence belongs to. | |
凡是伪造证据、隐匿证据或者毁灭证据的，无论属于何方，必须受法律追究。 |

| Article 21 For a public official who may have any duty-related violation of law, or who has duty-related violation of law but the circumstances are relatively minor, the oversight authority may, according to the administration authority, directly talk with and remind him or her, criticize and educate him or her, order him or her to make a self-criticism, or admonish him or her, or authorize any relevant authority or person to do so. | | 第二十一条 对可能发生职务违法，或者有职务违法行为但情节较轻的公职人员，监察机关按照管理权限，可以直接或者委托有关机关、人员，进行谈话提醒、批评教育、责令检查，或者予以诫勉。 |

| Article 22 The oversight authority may require the person under investigation who has any duty-related violation of law to give statements on the violation of law, and when necessary, shall issue a written notice to the person under investigation. | | 第二十二条 对职务违法的被调查人，监察机关可以要求其就违法行为作出陈述，必要时应当向被调查人出具书面通知。 |
For the person under investigation who is suspected of corruption and bribery, negligence of duty or any other duty-related crime, the oversight authority may conduct an interrogation and request him or her to make a statement on the alleged crime. | |
对涉嫌贪污贿赂、失职渎职等职务犯罪的被调查人，监察机关可以进行讯问，要求其供述涉嫌犯罪的情况。 |

| Article 23 During the course of the investigation, the oversight authority may question witnesses and other persons. | | 第二十三条 在调查过程中，监察机关可以询问证人等人员。 |

Article 24 Where the person under investigation is suspected of any serious duty-related violation of law or duty-related crime such as corruption, bribery, and negligence of duty, and the oversight authority has obtained some facts and evidence on the violation of law or crime, but needs to conduct further investigation of important issues, after examination and approval by the oversight authority in accordance with the law, the person may be retained at a specific place under any of the following circumstances:
