| In order to further open up the field of construction services, in accordance with the Notice of the State Council on Several Measures for Supporting the Deepening of Reform and Innovation in Pilot Free Trade Zones (No. 38 [2018], State Council), you are hereby notified of the matters concerning the formation of foreign-funded construction engineering enterprises in China (Fujian) Pilot Free Trade Zone (“FJFTZ”) as follows: | | 为进一步扩大建筑服务领域的对外开放，根据《国务院关于支持自由贸易试验区深化改革创新若干措施的通知》（国发〔2018〕38号），现就在中国（福建）自由贸易试验区（以下简称福建自贸区）设立的外商投资建设工程企业的有关事项通知如下： |
| I. For the purpose of this Notice, “foreign-funded construction engineering enterprises” means foreign-funded construction engineering design enterprises and foreign-funded construction enterprises formed in FJFTZ under Chinese laws and regulations. | | 一、本通知所指外商投资建设工程企业，是指根据中国法律、法规的规定，在福建自贸区设立的外商投资建设工程设计企业、外商投资建筑业企业。 |
II. To form a foreign-funded construction engineering design enterprise in FJFTZ, foreign investors shall apply for qualification certificates of design enterprises in accordance with the Provisions on the Administration of the Qualification for the Survey and Design of Construction Projects and the Qualification Standards for Engineering Design; to form a foreign-funded construction enterprise in FJFTZ, foreign investors shall apply for qualification certificates of construction enterprises in accordance with the Provisions on the Administration of the Qualifications of Construction Enterprises and the Qualification Standards for Construction Enterprises.
