In June 2013, jointly with Beijing Youth Press, Shangkequan (Beijing) Cultural Communication Co., Ltd. (hereinafter referred to as “Shangkequan Company”) launched “The Poem For You” welfare poetic activities; Shangkequan Company established a WeChat official account “The Poem For You.” On each day, a work of poem-reading in the form of music and reading was pushed and the sub-title of the read content was displayed in video. In addition, each work of poem-reading was attached with texts and images, including introductions to the poem, author, and reader and the text of the read poem. Up to September 16, 2014, Shangkequan Company issued a total of 473 episodes and the readers were elites from various industries and celebrities. Due to the celebrity charm of such poem readers, from July 2013 to September 2014, xinhuanet, book.163.com, gmw.cn, Beijing Youth Daily, People's Daily (overseas edition), sina.com, chinanews.com, and other media reported the poem-reading activities in which poem readers participated and the WeChat official account “The Poem For You.” Up to the exposure of this case, the quantity of subscribers of the WeChat official account “The Poem For You” reached over 1.36 million and the daily average reading and on-demand quantity of hot works amounted to over 100,000. It was indicated that the cumulative view counts of works in the WeChat official account “The Poem For You” in Tencent Video exceeded 100 million times. On September 16, 2014, Shoushan (Beijing) Music Creative Co., Ltd. launched an App “The Poem For You” in the Apple App Store and on June 23, 2015, it was renamed to The Poem For You (Beijing) Technology Co., Ltd. (hereinafter referred to as “The Poem For You Company”). On January 1, 2015, Shoushan (Beijing) Cultural Industry Co., Ltd. (hereinafter referred to as “Shoushan Culture Company”) established a WeChat official account “The Poem For You Official Client.” The functions of the App “The Poem For You” included recording, dubbing, and uploading and sharing of poem-reading works as well as listening to others' poem-reading works. The WeChat official account “The Poem For You Official Client” was mainly used to release the relevant information. Shangkequan Company filed a lawsuit with the People's Court of Chaoyang District and requested the Court to order that The Poem For You Company should immediately revoke the App “The Poem For You” released on Apple App Store and Android Market or cease the use of “The Poem For You” in the App, alter the company name, and may not use “The Poem For You” in the company name as a trade name, and alter the name in the copyright registration of the App “The Poem For You” and may not register the software name as “The Poem For You” in the software copyright registration; that defendant Shoushan Culture Company should immediately revoke the WeChat official account “The Poem For You Official Client” or cease the use of “The Poem For You” in the WeChat official client, and cancel the Sina MicroBlog account “The Poem For You Client” or cease the use of “The Poem For You” in this Sina MicroBlog account; and that the two defendants should immediately cease the unfair competition activities of unauthorized use of “The Poem For You” and compensate for Shangkequan Company's economic losses.
．．．．．． | | 2013年6月，尚客圈（北京）文化传播有限公司（以下简称尚客圈公司）联合北京青年报社等发起“为你读诗”公益诗歌艺术活动；同时尚客圈公司创建微信公众号“为你读诗”，每天以配乐加朗读的形式推送一期读诗作品，同时以视频的形式展现所朗诵内容的字幕。另外，每期读诗作品中还配有图文，包括对诗歌及作者、朗诵者的介绍，所诵读诗歌的文字内容等。截至2014年9月16日，尚客圈公司共发布473期节目，诗歌朗读者含各行业精英与明星。因参与诗歌朗诵者的名人效应，自2013年7月至2014年9月，新华网、网易读书频道、光明网、北京青年报、人民日报海外版、新浪网、中国新闻网等媒体对参与朗诵诗歌者的朗诵活动以及微信公众号“为你读诗”进行了报道。截至本案起诉，微信公众号“为你读诗”的关注者数量显示已达136万余人，热门作品显示日均阅读和点播量超10万次。微信公众号“为你读诗”中作品在腾讯视频栏目下显示累积播放量超过1亿次。2014年9月16日，首善（北京）音乐创意有限公司在苹果应用商店推出为你读诗APP ，其于2015年6月23日更名为为你读诗（北京）科技有限公司（以下简称为你读诗公司）。2015年1月1日，首善（北京）文化产业有限公司（以下简称首善文化公司）创建名为“为你读诗官方客户端”的微信公众号。为你读诗APP的功能包括诗歌朗诵录制、配音、上传分享及收听他人的诗歌朗诵作品。“为你读诗官方客户端”的微信公众号主要用于发布相关信息。尚客圈公司诉至法院，请求法院判令为你读诗公司立即撤销在苹果应用商店、安卓市场中发布的为你读诗app或停止在该app上使用为你读诗的名称、变更公司名称、不得在公司名称中使用为你读诗作为字号，变更为你读诗app软件的著作权登记名称、不得在软件著作权登记中将其软件名称登记为为你读诗；判令被告首善文化公司立即撤销微信公众号为你读诗客户端或停止在该公众号中使用为你读诗的名称、注销为你读诗客户端的新浪微博账号或停止在该新浪微博账号中使用为你读诗的名称；判令二被告立即停止擅自使用为你读诗名称的不正当竞争行为、赔偿经济损失。
