For the purposes of thoroughly implementing the spirit of the 18th National Congress of the CPC and the Third, Fourth, Fifth and Sixth Plenary Sessions of the 18th CPC Central Committee, implementing the spirit of and the overall requirement for “commending the honest and punishing the dishonest” in the Guiding Opinions of the State Council on Establishing and Improving the System of Joint Incentive for Keeping Faith and Joint Punishment for Losing Faith and Accelerating the Advancement of the Development of Social Honesty(No. 33 [2016], State Council), the Several Opinions of the State Council on Promoting Fair Market Competition and Maintaining the Normal Market Order (No. 20 [2014], State Council), the Notice by the State Council of Issuing the Outline of the Plan for Building the Social Credit System (2014-2020) (No. 21 [2014], State Council) , the Opinions of the Office of the Spiritual Civilization Development Steering Commission of the CCCPC on Advancing the Institutional Construction of Integrity (No. 7 [2014], Office of the Spiritual Civilization Development Steering Commission) and other documents, the National Development and Reform Commission, the People's Bank of China, the General Administration of Customs, the Office of the Spiritual Civilization Development Steering Commission of the CCCPC, the Office of the Central Cyberspace Affairs Commission, the Supreme People's Court, the Ministry of Science and Technology, the Ministry of Public Security, the Ministry of Finance, the Ministry of Human Resources and Social Security, the Ministry of Land and Resources, the Ministry of Environmental Protection, the Ministry of Housing and Urban-Rural Development, the Ministry of Transport, the Ministry of Agriculture, the Ministry of Commerce, the Ministry of Culture, the State-Owned Assets Supervision and Administration Commission of the State Council, the State Taxation Administration, the State Administration for Industry and Commerce, the General Administration of Quality Supervision, Inspection and Quarantine, the State Administration of Work Safety, the China Food and Drug Administration, the State Forestry Administration, the China National Tourism Administration, the China Banking Regulatory Commission, the China Securities Regulatory Commission, the China Insurance Regulatory Commission, the Civil Aviation Administration of China, the State Administration of Foreign Exchange, the All-China Women's Federation, the All-China Federation of Industry and Commerce, China Railway Corporation and other departments have, based on the provisions of relevant laws, regulations, rules, and regulatory documents, among others, reached the following consensus on joint punishment for dishonest enterprises determined by the Customs: 为深入贯彻党的十八大和十八届三中、四中、五中、六中全会精神,落实《国务院关于建立完善守信联合激励和失信联合惩戒制度加快推进社会诚信建设的指导意见菊花碎了一地》(国发〔2016〕33号)、《国务院关于促进市场公平竞争维护市场正常秩序的若干意见》(国发〔2014〕20号)、《国务院关于印发社会信用体系建设规划纲要(2014-2020年)的通知》(国发〔2014〕21号)和中央文明委《关于推进诚信建设制度化的意见》(文明委〔2014〕7号)等文件精神及“褒扬诚信、惩戒失信”的总体要求,国家发展改革委、人民银行、海关总署、中央文明办、中央网信办、最高人民法院、科技部、公安部、财政部、人力资源社会保障部、国土资源部、环境保护部、住房城乡建设部、交通运输部、农业部、商务部、文化部、国资委、税务总局、工商总局、质检总局、安全监管总局、食品药品监管总局、林业局、旅游局、银监会、证监会、保监会、民航局、外汇局、全国妇联、全国工商联、中国铁路总公司等部门依据有关法律、法规、规章及规范性文件等规定,对海关失信企业实施联合惩戒达成如下一致意见:
I. Parties Subject to Joint Punishment   一、联合惩戒对象
The parties subject to joint punishment are dishonest enterprises determined by the Customs in accordance with the Interim Measures of the Customs of the People's Republic of China for the Administration of Enterprise Credit (Order No. 225, GACC, hereinafter referred to as the “Credit Measures”) and their legal representatives (persons in charge), directors, supervisors, and senior executives. 实施失信联合惩戒的对象,为海关根据《中华人民共和国海关企业信用管理暂行办法

》(海关总署令第225号,以下简称《信用办法》)认定的海关失信企业及其法定代表人(负责人)、董事、监事、高级管理人员。
II. Ways of Information Sharing and Joint Punishment   二、信息共享与联合惩戒的实施方式
The General Administration of Customs shall provide information on dishonest enterprises determined by the Customs to all departments involved in joint punishment through the National Credit Information Sharing Platform (Joint Punishment System for Dishonest Conduct) and update it dynamically in accordance with relevant regulations. All departments shall obtain information on dishonest enterprises determined by the Customs, and take one or more punitive measures against the parties subject to joint punishment in accordance with the provisions of relevant laws, regulations, rules and regulatory documents (see the Annex for relevant bases and implementation departments). 海关总署通过全国信用信息共享平台(失信联合惩戒系统)向参与联合惩戒的各部门,提供海关失信企业信息并按照有关规定动态更新。各部门获取海关失信企业信息,依照有关法律、法规、规章及规范性文件的规定,对联合惩戒对象采取下列一种或多种惩戒措施(相关依据和实施部门见附录)。同时,各部门每季度将执行情况反馈给国家发展改革委和海关总署;对于在日常监管中已向全国信用信息共享平台及时传输相关信息的部门,无需再按季度进行反馈。
At the same time, all departments shall return the information on implementation to the National Development and Reform Commission and the General Administration of Customs on a quarterly basis; and the departments that have transmitted relevant information to the National Credit Information Sharing Platform in routine regulation are no longer required to return such information on a quarterly basis. 
   三、惩戒措施及实施部门
III. Punitive Measures and Implementation Departments 
 (一)海关部门采取的惩戒措施
1. Punitive measures taken by customs offices 
 1.适用较高的进出口货物查验率(布控查验或者实货验估)。
(1) Applying relatively high inspection rates of import and export goods (inspection under surveillance or physical commodity appraisal). 
 2.实施进出口货物单证重点审核。
(2) Conducting intensified examination of documents on import and export goods 
 3.实施加工贸易重点监管。
(3) Conducting intensified supervision of processing trade. 
 4.海关总署规定的其他管理原则和措施。
(4) Other management principles and measures as provided for by the General Administration of Customs. 
 (二)跨部门联合惩戒措施
2. Inter-departmental joint punitive measures 
 5.不予适用检验检疫部门A级及以上企业信用管理,对其中有走私行为、走私罪的海关失信企业,直接列为信用D级管理,实行限制性管理措施。
(5) Not allowing dishonest enterprises to be subject to the credit administration of enterprises with the credit rating of Grade A or above by inspection and quarantine departments, and directly incorporating dishonest enterprises determined by the Customs which been involved in smuggling or committed the crime of smuggling into the credit administration of enterprises with the credit rating of Grade D and taking restrictive administrative measures against them. 
 6.对进出口货物适用较高的检验检疫查验率。
(6) Applying relatively high inspection and quarantine examination rates to import and export goods. 
 7.在出口退税管理方面严格加强出口退税审核。
(7) Strictly strengthening export tax refund examination in terms of export tax refund administration. 
 8.对违法违规的固体废物进口企业,提高监管频次,依法实行限制性管理措施。
(8) Increasing the frequency of regulation of and legally taking restrictive administrative measures against solid waste importers that violate laws and regulations. 
 9.对有拖欠海关应缴税款或者应缴罚没款项情形的海关失信企业的法定代表人(负责人),在未按规定缴清相关款项或提供有效担保前,阻止其出境。具体工作程序,按照公安部有关要求执行。
(9) Preventing the legal representatives (persons in charge) of dishonest enterprises determined by the Customs that default on the payment of taxes or fines payable to the Customs from leaving China before they pay off relevant funds or provide effective guarantee as required. The specific working procedures shall be governed by the relevant requirements put forward the Ministry of Public Security. 
 10.将列入“信用中国”网站受惩黑名单的失信信息作为限制有关商品进出口配额分配的依据。
(10) Using the dishonesty information of being included in the punishment blacklist on the website of Credit China (www.creditchina.gov.cn) as the basis for restricting the distribution of import and export quotas for relevant commodities. 
 11.在一定期限内,对有走私罪的海关失信企业,列入黑名单,依法限制其法定代表人(负责人)、董事、监事、高级管理人员成为其他公司的法定代表人(负责人)、董事、监事、高级管理人员。
(11) Legally restricting the legal representatives (persons in charge), directors, supervisors and senior executives of dishonest enterprises determined by the Customs that committed the crime of smuggling and are listed in the blacklist from acting as the legal representatives (persons in charge), directors, supervisors and senior executives of other companies during a specified period. 
 12.不予适用外汇部门A类企业管理。
(12) Not allowing dishonest enterprises to be subject to the administration of enterprises with the credit rating of Grade A by foreign exchange departments. 
 13.对有走私行为、走私罪的海关失信企业,直接列为外汇部门C类企业管理,实行限制性管理措施。
(13) Directly incorporating dishonest enterprises determined by the Customs that are involved in smuggling or committed the crime of smuggling into the administration of enterprises with the credit rating of Grade C by foreign exchange departments, and taking restrictive administrative measures against them. 
 14.在一定期限内,将失信状况作为合格境内机构投资者、合格境外机构投资者等外汇额度核准与管理的重要参考依据。
(14) Taking the dishonesty status as a major reference for the confirmation and administration of the foreign exchange quotas of qualified domestic institutional investors and qualified foreign institutional investors, among others, during a specified period. 
 15.对发行公司(企业)债券从严审核;在银行间市场发行非金融企业债务融资工具限制注册,并按照注册发行有关工作要求,强化信息披露,加强投资人保护机制管理,防范有关风险。
(15) Conducting stricter review of issuance of corporate (enterprise) bonds; and restricting the registration of issuance of debt financing instruments of non-financial enterprises in the inter-bank market, and, according to the relevant work requirements for registration and issuance, strengthening information disclosure and the administration of investor protection mechanisms, and preventing relevant risks. 
 16.在审批证券公司、基金管理公司、期货公司的设立和变更持有5%以上股权的股东、实际控制人,以及私募投资基金管理人登记时,依法将失信企业的失信状况作为重要参考依据。
(16) Legally taking the dishonesty status of dishonest enterprises as an important reference for the approval of the formation of securities companies, fund management companies or futures companies, and the change of the shareholders that hold more than 5% of their equities or the actual controllers, or for the registration of managers of privately offered investment funds. 
 17.在上市公司或者非上市公众公司收购的事中事后监管中,予以重点关注。
(17) Paying special attention to the interim and ex-post regulation of the acquisition of listed companies or non-listed public companies. 
 18.将海关失信企业的失信情况作为股票发行审核的重要参考。
(18) Taking the dishonesty status of dishonest enterprises determined by the Customs as an important reference for the examination of stock issuance. 
 19.依法限制设立融资性担保公司;在审批融资性担保公司或金融机构董事、监事及高级管理人员任职资格时,将海关失信企业的失信状况作为重要参考依据。
(19) Legally restricting the formation of financing guarantee companies; and taking the dishonesty status of dishonest enterprises determined by the Customs as an important reference for the approval of the office qualifications of directors, supervisors and senior executives of financing guarantee companies or financial institutions. 
 20.在一定期限内,依法限制参与政府采购活动。
(20) Legally restricting the participation in government procurement activities during a specified period. 
 21.在一定期限内,依法限制参与工程等招投标。
(21) Legally restricting the participation in the bidding of projects, among others, during a specified period. 
 22.在一定期限内,暂停审批与失信企业相关的科技项目。
(22) Suspending the approval of the science and technology projects related to dishonest enterprise during a specified period. 
 23.在审批保险公司设立时,将海关失信企业的失信状况作为重要参考依据。
(23) Taking the dishonesty status of dishonest enterprises determined by the Customs as an important reference for the approval of the formation of insurance companies. 
 24.对有拖欠缴海关应缴税款或应缴罚没款项情形的海关失信企业,在海关申请人民法院强制执行后,仍不履行的,限制海关失信企业及其法定代表人(负责人)支付高额保费购买具有现金价值的保险产品。
(24) Restricting dishonest enterprises determined by the Customs and their legal representatives (persons in charge) from paying high insurance premiums to purchase insurance products with cash value if dishonest enterprises determined by the Customs which default on payment of taxes or fines payable to the Customs still fail to perform the payment obligations after the Customs apply to the people's court for enforcement. 
 25.将海关失信企业的失信状况作为设立商业银行或分行、代表处以及参股、收购商业银行的审批时审慎性参考。
(25) Taking the dishonesty status of a dishonest enterprise determined by the Customs as a prudential reference for the approval of the formation of a commercial bank or the branch office or representative office thereof or the holding of non-controlling shares in or acquisition of a commercial bank. 
 26.依法限制境内上市公司实行股权激励计划或者限制成为股权激励对象。
(26) Legally restricting domestic listed companies from implementing the equity incentive plans or restricting relevant personnel from becoming participants in equity incentive plans. 
 27.将海关失信企业的失信状况作为其融资或对其授信的重要依据或参考。
(27) Taking the dishonesty status of dishonest enterprises determined by the Customs as an important basis or reference for their financing or the credit extension to them. 
 28.对有拖欠缴海关应缴税款或应缴罚没款项情形的海关失信企业,在海关申请人民法院强制执行后,仍不履行的,由人民法院依法纳入失信被执行人名单,限制其法定代表人(负责人)乘坐飞机、列车软卧、轮船二等以上舱位、G字头动车组列车全部座位、其他动车组列车一等以上座位等非生活和工作必须的消费行为。
(28) Where a dishonest enterprise determined by the Customs which defaults on payment of taxes or fines payable to the Customs still fails to perform the payment obligation after the Customs applies to the people's court for enforcement, the people's court shall include it in the list of dishonest persons subject to enforcement according to the law, and restrict its legal representative (person in charge) from taking an airplane, the soft berth of a train, the second-class berth or above of a steamship, any seat of a G-series high-speed (CRH) train, or a seat of the business class or a higher class in any other high speed train or having any other consumption behavior not necessary for life or work. 
 29.对有拖欠缴海关应缴税款或应缴罚没款项情形的海关失信企业,在海关申请人民法院强制执行后,仍不履行的,限制海关失信企业及其法定代表人(负责人)购买房产、土地等不动产。
(29) Restricting the legal representative (person in charge) of a dishonest enterprise determined by the Customs from purchasing houses, land or other immovable properties if it defaults on payment of taxes or fines payable to the Customs and still fail to performs the payment obligation after the Customs applies to the people's court for enforcement. 
 30.限制参与国有企业资产、国家资产等国有产权交易。
(30) Restricting the participation in transactions of the assets of state-owned enterprises, national assets, and other state-owned property rights. 
 31.在申请政府性资金支持和社会保障资金支持时,依法依规采取从严审核或降低支持力度或不予支持等限制措施。
(31) Taking restrictive measures such as conducting stricter review, and reducing support or providing no support according to laws and regulations when government financial support and social security fund support are applied for. 
 32.限制海关失信企业的法定代表人(负责人)担任国有独资公司董事、监事及国有资本控股或参股公司董事、监事及国有企业的高级管理人员;已担任相关职务的,提出其不再担任相关职务的意见。
(32) Restricting the legal representative (person in charge) of a dishonest enterprise determined by the Customs from serving as the director or supervisor of a wholly state-owned company, the director or supervisor of a company in which the state has a stake, whether controlling or non-controlling, or the senior executive of a state-owned enterprise; and, if such person who has taken a relevant post, offering the opinion of no longer allowing him or her to take the relevant post. 
 33.限制海关失信企业及其法定代表人(负责人)使用国有林地,申报重点林业建设项目,申报草原征占用审批,申报重点草原保护建设项目。
(33) Restricting the legal representative (person in charge) of a dishonest enterprise determined by the Customs from using state-owned forest land, applying for key forestry construction projects, applying for the approval of grassland expropriation and occupation, and applying for key grassland protection and construction projects. 
 34.将海关失信企业相关信息依法依规作为从事药品、食品安全行业从严审批的参考。
(34) Taking the relevant information on dishonest enterprises determined by the Customs as the reference for conducting stricter approval of the engagement in pharmaceutical and food safety industries. 
 35.限制从事危险化学品生产经营储存、烟花爆竹生产经营、矿山生产、安全评价等行业,限制在认证行业执业,限制取得认证机构资质,限制获得认证证书。
(35) Restricting dishonest enterprises determined by the Customs from engaging in production, distribution, and storage of hazardous chemicals, production and distribution of fireworks and crackers, mine production, safety assessment, and other industries; and restricting them from practicing in the certification industry, obtaining the qualifications of certification bodies and obtaining certification certificates. 
 36.海关总署将海关失信企业信息在海关总署门户网站、中国海关企业进出口信用信息公示平台、“信用中国”网站、国家企业信用信息公示系统、网络交易监管信息化系统等向社会公布。
(36) Having the information on dishonest enterprises determined by the Customs published by the General Administration of Customs on the web portal of the General Administration of Customs, the Credit Publicity Platform of Import and Export Business of Customs of the People's Republic of China, the website of “Credit China”, the National Enterprise Credit Information Publication System, and the Network Transaction Supervision Information Technology System, among others.

 38.在一定期限内,限制海关失信企业及其法定代表人(负责人)获得相关部门颁发的荣誉证书、嘉奖和表彰等荣誉性称号。
(38) Restricting dishonest enterprises determined by the Customs and their legal representatives (persons in charge) from acquiring the certificates of honor, prizes, commendation and other honorary titles granted by the relevant departments during a specified period. 
 39.鼓励各级党政机关、社会组织、企事业单位使用海关失信企业名单及相关信息,结合各自主管领域、业务范围、经营活动制定对海关失信企业及其法定代表人(负责人)的惩戒措施;鼓励政府部门、社会组织、企事业单位加强合作、信息共享,共同加大对海关失信企业的信用监督、威慑和惩戒;鼓励将海关失信企业信息作为重要信用评价指标纳入社会信用评价体系。
(39) Encouraging the party and government organs at all levels, social organizations, enterprises and public institutions to develop the punitive measures against dishonest enterprises determined by the Customs and their legal representatives (persons in charge) based on the lists of dishonest enterprises determined by the Customs and relevant information and in consideration of their respective fields, business scopes and business activities; encouraging government departments, social organizations, and enterprises and public institutions to strengthen cooperation and information sharing and jointly enhance the credit supervision, deterrence and punishment efforts against dishonest enterprises determined by the Customs; and encouraging the use of information on dishonest enterprises determined by the Customs as an important credit evaluation indicator and incorporating it into the social credit evaluation system. 
   四、联合惩戒的动态管理
IV. Dynamic Administration of Joint Punishment 海关总署在全国信用信息共享平台失信行为联合惩戒系统上实时更新海关失信企业信息。各部门根据各自职责,按照法律法规和有关规定实施惩戒或解除惩戒。
The General Administration of Customs shall update in real time the information on dishonest enterprises on the Joint Punishment System for Dishonest Conduct of the National Credit Information Sharing Platform. All departments shall, according to their respective functions, impose or terminate punishments in accordance with laws, regulations and relevant provisions. 根据《信用办法》的规定,适用失信企业管理满1年,且未再发生《信用办法》第十条规定情形的,海关应当将其调整为一般信用企业管理。因此,海关总署在向各部门通报海关失信企业信息时,应注明决定作出日期及效力期限,各部门根据各自的法定职责,按照法律法规和有关规定实施惩戒或解除惩戒。根据海关总署提供的信息,超过效力期限的,不再实施联合惩戒。
In accordance with the provisions of the Credit Measures, where an enterprise has been administered as a dishonest enterprise for one year or more, and does not fall under any circumstance as set forth in Article 10 of the Credit Measures, the Customs shall change it into a general credit enterprise for administration. Therefore, the General Administration of Customs shall, when notifying the information on a dishonest enterprise determined by the Customs to all departments, indicate the date when the decision is made and the valid period of the decision, and all departments shall, according to their respective statutory functions, impose or terminate punishments in accordance with laws, regulations and relevant provisions. According to the information provided by the General Administration of Customs, if the valid period expires, the joint punishment shall cease to be imposed. 附录
