| For purposes of further strengthening the administration of scientific research in seas under the jurisdiction of foreign countries, in accordance with China's relevant laws and regulations, as well as the United Nations Convention on the Law of the Sea and with reference to relevant domestic and international practices, you are notified of the matters including applications for and implementation and notification of scientific research in seas under the jurisdiction of foreign countries, which are as follows: | | 为对赴外国管辖海域开展科学研究进一步加强管理，根据我国有关法律法规和《联合国海洋法公约》，并参照国内外有关实践做法，现就赴外国管辖海域科考申请、执行及通报等事宜通知如下： |
| Guided by Xi Jinping Thought on Socialism with Chinese Characteristics in a New Era, all localities and departments shall comprehensively implement Xi Jinping Thought on Diplomacy, practically implement the concepts of building a community with a shared future for mankind and a maritime community with a shared future, and under the principles of enhancing overall planning and coordination, optimizing resource allocation, abiding by international rules and being conducive to foreign relations, manage relevant scientific research activities in a scientific and standard way, create a favorable atmosphere of international cooperation, and promote the long-term and orderly development of China's scientific research activities. | | 各地方各部门要以习近平新时代中国特色社会主义思想为指导，全面贯彻落实习近平外交思想，切实践行构建人类命运共同体和海洋命运共同体理念，本着加强统筹协调、优化资源配置、遵守国际规则、有利对外关系的原则，对有关科研活动进行科学化、规范化管理，营造良好国际合作氛围，促进我国科研活动长远有序发展。 |
| I. This Notice shall apply to the investigations and research activities by China's government departments, entities, enterprises, organizations and individuals of the marine environment and marine resources that are conducted in seas under the jurisdiction of any foreign country, through vessels or other means or facilities of delivery. | | 一、本通知适用于我国政府部门、单位、企业、组织和个人，使用船舶或其他运载工具、设施，在外国管辖海域内进行的对海洋环境和海洋资源等的调查研究活动。 |
| For the purpose of this Notice, ‘seas under the jurisdiction of foreign countries' means territorial seas, exclusive economic zones, and continental shelves (including continental shelves beyond 200 nautical miles from the baselines) that are claimed, under international law, by foreign countries that have no dispute with China over sovereignty or jurisdiction. | | 为本通知目的，外国管辖海域是指与我国不存在主权和管辖权争议的外国依据国际法主张的领海、专属经济区和大陆架（包括200海里外大陆架）等管辖海域。 |
| II. An applicant that intends to conduct scientific research activities in seas under the jurisdiction of any foreign country shall advance an application, submit reports and data, and handle other relevant matters through the Ministry of Foreign Affairs. A scientific research entity operating with a coastal State to conduct scientific research in seas under the jurisdiction of such State may file an application for foreign-related scientific research, submit reports and data, and handle other relevant matters with the State through consultation. If scientific research activities to be conducted in the territorial sea of any foreign country are otherwise prescribed by the country, the provisions of the country shall prevail. | | 二、赴外国管辖海域开展科学研究活动，应通过外交部办理事先申请、提交报告和数据等事项。与沿海国合作在该国管辖海域开展科学研究的，可由科研合作单位协商办理向该国提出涉外科学研究申请、提交报告和数据等事宜。赴外国领海开展科学研究活动，该国另有规定的，应依该国规定办理。 |
| III. The superior authority of an entity undertaking marine scientific research tasks shall be responsible for examining and submitting application materials for marine scientific research activities, supervising the implementation of the entity's project, and taking the lead in organizing the writing of project reports. | | 三、海洋科研任务承担单位上级主管部门负责审核报送海洋科研活动申请材料、监督项目实施、牵头组织项目报告撰写等事宜。 |
| An entity undertaking marine scientific research tasks shall strictly abide by the State's diplomatic policies, this Notice, along with the administrative rules of its superior authority, take charge of maritime liaison, maritime emergency plans, staff training, education and management, handling of exit-entry procedures and other matters, and maintain communication and coordination with its superior authority and the Ministry of Foreign Affairs in respect of related issues. | | 海洋科研任务承担单位应严格遵守国家外交政策、本通知和上级主管部门管理规定，负责海上联络、海上应急预案制定、人员培训、教育和管理、出入境手续办理等事项，应及时与上级主管部门、外交部就有关问题保持沟通与协调。 |
| For example, where the voyage of marine scientific research involves more than two entities undertaking marine scientific research tasks, their superior authorities, marine scientific research project management departments, and other parties, the responsible body for the filing of an application, management, submission of reports and other matters concerning the voyage shall be determined by relevant departments and entities through consultation. | | 如海洋科学研究的航次涉及多个海洋科研任务承担单位及其上级主管部门、海洋科研项目管理部门等，该航次的申请、管理、提交报告等事项的责任主体由相关部门和单位协商确定。 |
IV. The superior authority of an entity undertaking marine scientific research tasks shall submit relevant application materials to the Ministry of Foreign Affairs (the Department of Treaty and Law) no less than seven months in advance of the expected start date of the marine scientific research plan in seas under the jurisdiction of any foreign country.
