| Article 1 These Measures are formulated in accordance with the relevant provisions of the Environmental Protection Law of the People's Republic of China, the Notice of the State Council on Issuing the Comprehensive Work Plan for Energy Conservation and Emission Reduction during the “Twelfth Five-Year Plan” Period (No. 26 [2011] of the State Council, hereinafter referred to as the “Plan”), the Opinions of the State Council on Strengthening Major Points of the Environmental Protection Work (No. 35 [2011] of the State Council) and the Notice of the State Council on Issuing the Energy Conservation and Emission Reduction Plan during the “Twelfth Five-Year Plan” Period (No. 40 [2012] of the State Council) for purposes of implementing the Scientific Outlook on Development, promoting government performance management, controlling the emission of major pollutants, and ensure the realization of the targets for reducing the total emission of major pollutants during the “Twelfth Five-Year Plan” period. | | 第一条 为贯彻落实科学发展观，推进政府绩效管理，控制主要污染物排放，确保实现“十二五”主要污染物总量减排目标，按照《中华人民共和国环境保护法》、《国务院关于印发“十二五”节能减排综合性工作方案的通知》（国发〔2011〕26号，以下简称《方案》）、《国务院关于加强环境保护重点工作的意见》（国发〔2011〕35号）和《国务院关于印发节能减排“十二五”规划的通知》（国发〔2012〕40号）的有关规定，制定本办法。 |

| Article 2 These Measures shall apply to the performance management and evaluation and assessment of the accomplishment of reducing the total emission of major pollutants by the people's governments of all provinces, autonomous regions and municipalities directly under the Central Government and the Xinjiang Production and Construction Corps during the “Twelfth Five-Year Plan” period. | | 第二条 本办法适用于对各省、自治区、直辖市人民政府和新疆生产建设兵团（以下称各地区） “十二五”期间主要污染物总量减排完成情况的绩效管理和评价考核。 |
For the purpose of these Measures, “major pollutants” means four types of pollutants subject to the control of total discharge volume as determined in the Outline of the Twelfth Five-Year Plan for National Economic and Social Development, namely, chemical oxygen demand, ammonia nitrogen, sulfur dioxide and nitrogen oxide. | |
本办法所称主要污染物，是指《国民经济和社会发展第十二个五年规划纲要》确定实施总量控制的四项污染物，即化学需氧量、氨氮、二氧化硫和氮氧化物。 |

Article 3 The main bodies responsible for reducing the total emission of major pollutants during the “Twelfth Five-Year Plan” period are the local people's governments at all levels. All regions shall split up the controlling indicators of the total emission of major pollutants level by level and assign them to the local people's governments at various levels within their respective regions, include them into the economic and social development planning of their regions, strengthen organization and leadership, intensify performance management, implement projects and guarantee funds, and strictly supervise law enforcement, so as to ensure the realization of the targets for reducing total emission of major pollutants.
．．．．．． | | 第三条 “十二五”主要污染物总量减排的责任主体是地方各级人民政府。各地区要把主要污染物排放总量控制指标层层分解落实到本地区各级人民政府，并将其纳入本地区经济社会发展规划，加强组织领导，强化绩效管理，落实项目和资金，严格执法监督，确保实现主要污染物总量减排目标。
