Recently, the General Office of the CPC Central Committee and the General Office of the State Council have issued the Guiding Opinions on Building a Modern Environmental Governance System, and have given a notice requiring all regions and all departments to implement the Opinions according to actual circumstances. 近日,中共中央办公厅、国务院办公厅印发了《关于构建现代环境治理体系的指导意见》,并发出通知,要求各地区各部门结合实际认真贯彻落实。
The full text of the Guiding Opinions on Building a Modern Environmental Governance System is as follows. 《关于构建现代环境治理体系的指导意见》全文如下。
For the purposes of implementing the arrangements of the 19th CPC National Congress, and building a modern environmental governance system in which party committees will take the lead, governments will provide guidance, enterprises will assume the primary responsibilities, and social organizations and the public will jointly participate, the opinions are hereby offered as follows: 为贯彻落实党的十九大部署,构建党委领导、政府主导、企业主体、社会组织和公众共同参与的现代环境治理体系,现提出如下意见。
I. General requirements   一、总体要求
1. Guiding ideology: With Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era as the guidance, efforts shall be made to comprehensively fulfill the spirit of the 19th CPC National Congress and the Second, Third and Fourth Plenary Sessions of the 19th CPC Central Committee, further follow Xi Jinping Thought on Ecological Civilization, closely revolve around coordinated efforts to implement the five-sphere integrated plan and four-pronged comprehensive strategy, and earnestly implement the decisions and arrangements of the CPC Central Committee and the State Council. There shall also be efforts to firmly grasp the concept of green development, and create a sound pattern integrating government's governance, social regulation and enterprise autonomy, with the Party's centralized leadership as a guideline, the government's dominant role as the key, the primary responsibility of enterprises as the basis, and the participation of social organizations and the public as the support. Furthermore, systems and mechanisms shall be improved, governance at source shall be strengthened, and joint working forces shall be formed, so as to provide a strong institutional guarantee for creating a better ecological environment, promoting ecological progress, and building China into a more beautiful country. (一)指导思想。以习近平新时代中国特色社会主义思想为指导,全面贯彻党的十九大和十九届二中、三中、四中全会精神,深入贯彻习近平生态文明思想,紧紧围绕统筹推进“五位一体”总体布局和协调推进“四个全面”战略布局,认真落实党中央、国务院决策部署,牢固树立绿色发展理念,以坚持党的集中统一领导为统领,以强化政府主导作用为关键,以深化企业主体作用为根本,以更好动员社会组织和公众共同参与为支撑,实现政府治理和社会调节、企业自治良性互动,完善体制机制,强化源头治理,形成工作合力,为推动生态环境根本好转、建设生态文明和美丽中国提供有力制度保障。
2. Basic principles (二)基本原则
- Remaining firm with the Party's leadership: Implementing the general requirements of the CPC Central Committee for the protection of ecological environment, and ensuring that both party committees and governments are held accountable, and that officials take responsibility for the protection of ecological environment. --坚持党的领导。贯彻党中央关于生态环境保护的总体要求,实行生态环境保护党政同责、一岗双责。
- Upholding governance by multiple stakeholders: Clarifying the rights and responsibilities of various actors, such as governments, enterprises and the public, providing smooth channels for participation, and creating an effective pattern in which all sectors concerned with society will jointly promote environmental governance. --坚持多方共治。明晰政府、企业、公众等各类主体权责,畅通参与渠道,形成全社会共同推进环境治理的良好格局。
- Following a market-oriented approach: Improving economic policies and market systems, regulating market activities in environmental governance, strengthening integrity in environmental governance, and promoting industrial self-discipline. --坚持市场导向。完善经济政策,健全市场机制,规范环境治理市场行为,强化环境治理诚信建设,促进行业自律。
- Adhering to law-based governance: Enhancing laws, regulations and standards, strictly enforcing laws, intensifying supervision, and improving the weaknesses in the systems and institutions of environmental governance in an expedient manner. --坚持依法治理。健全法律法规标准,严格执法、加强监管,加快补齐环境治理体制机制短板。
3. Main objectives: By 2025, the leadership responsibility system, the enterprise responsibility system, the national action system, the supervision system, the market system, the credit system, and the system of laws, regulations and policies for environmental governance shall be established and improved. The responsibilities of various actors will be implemented, and participation of market players and the public shall be encouraged. An environmental governance system with clear guidance, science-based decisions, rigorous enforcement, effective stimulation, diversified participants, and sound interactions will be established. (三)主要目标。到2025年,建立健全环境治理的领导责任体系、企业责任体系、全民行动体系、监管体系、市场体系、信用体系、法律法规政策体系,落实各类主体责任,提高市场主体和公众参与的积极性,形成导向清晰、决策科学、执行有力、激励有效、多元参与、良性互动的环境治理体系。
II. Improving the leadership responsibility system for environmental governance   二、健全环境治理领导责任体系
4. Enhancing the working mechanism with the central government making overall arrangements, provincial governments assuming primary responsibilities, and city-level and county-level governments implementing specific tasks: The CPC Central Committee and the State Council shall coordinate the efforts to formulate significant policies for the protection of ecological environment, establish general objectives, and devise major strategies and measures. They shall also prepare a list of responsibilities for the relevant departments of the central and state organs in the protection of ecological environment. The provincial party committees and governments shall assume overall responsibilities for environmental governance in their respective regions, implement various decisions and arrangements of the CPC Central Committee and the State Council, organize the implementation of objectives, tasks, policies and measures, and increase funds in environmental governance. City-level and county-level governments shall take on specific duties, and effectively perform tasks such as supervision, enforcement, market regulation, funding arrangement, publicity and education. (四)完善中央统筹、省负总责、市县抓落实的工作机制。党中央、国务院统筹制定生态环境保护的大政方针,提出总体目标,谋划重大战略举措。制定实施中央和国家机关有关部门生态环境保护责任清单。省级党委和政府对本地区环境治理负总体责任,贯彻执行党中央、国务院各项决策部署,组织落实目标任务、政策措施,加大资金投入。市县党委和政府承担具体责任,统筹做好监管执法、市场规范、资金安排、宣传教育等工作。
5. Specifying the responsibilities of central and local governments in fiscal expenditures: A plan for the reform on defining the respective responsibilities of central and local governments in fiscal powers and expenditures in the field of ecological environment shall be developed and implemented. Except for environmental governance throughout the country, in key areas or water basins, across different regions and countries, and other important affairs, local governments shall be responsible for paying the expenditures for environmental governance. Based on the principles of matching financial resources with powers, the financial demands of local governments in environmental governance shall be taken into consideration in the reform on further improving revenue sharing between central and local governments and the payment transfer system. (五)明确中央和地方财政支出责任。制定实施生态环境领域中央与地方财政事权和支出责任划分改革方案,除全国性、重点区域流域、跨区域、国际合作等环境治理重大事务外,主要由地方财政承担环境治理支出责任。按照财力与事权相匹配的原则,在进一步理顺中央与地方收入划分和完善转移支付制度改革中统筹考虑地方环境治理的财政需求。
6. Evaluating and assessing the performance in achieving objectives: Focus shall be put on improving the quality of the environment, and restrictive and predictable objectives shall be reasonably established and incorporated into the national economic and social development plan, the territorial spatial plan and other special plans. All regions may formulate objectives that meet their actual conditions as well as local characteristics. The system of evaluating and assessing the objectives of promoting ecological progress shall be improved, and the relevant special assessment shall be streamlined and integrated so as to enhance environmental governance. (六)开展目标评价考核。着眼环境质量改善,合理设定约束性和预期性目标,纳入国民经济和社会发展规划、国土空间规划以及相关专项规划。各地区可制定符合实际、体现特色的目标。完善生态文明建设目标评价考核体系,对相关专项考核进行精简整合,促进开展环境治理。
7. Deepening protection and supervision of ecological environment: Two-level (central government, and governments of provinces (autonomous regions, and municipalities directly under the Central Government)) ecological environment protection and supervision system shall be implemented. Focus shall be put on solving prominent problems in ecological environment, improving the quality of ecological environment, and promoting high-quality economic development. Routine supervision shall be supported, special supervision shall be strengthened, and supervision and rectification shall be strictly implemented. The ‘five-step' working mode (screening, assignment, review, interview, and special supervision) shall be further improved, assistance through supervision shall be underpinned, and the responsibilities for the protection of ecological environment shall be fulfilled. (七)深化生态环境保护督察。实行中央和省(自治区、直辖市)两级生态环境保护督察体制。以解决突出生态环境问题、改善生态环境质量、推动经济高质量发展为重点,推进例行督察,加强专项督察,严格督察整改。进一步完善排查、交办、核查、约谈、专项督察“五步法”工作模式,强化监督帮扶,压实生态环境保护责任。
III. Improving the enterprise responsibility system for environmental governance   三、健全环境治理企业责任体系
8. Implementing a licensing system for the discharge of pollutants: The legislation process of the Regulation on the Administration of Permission of Pollution Discharge shall be accelerated, the pollution discharge licensing system shall be improved, and the supervision and inspection of enterprises in pollution discharge shall be strengthened. The relations between pollution discharge licensing and environmental impact assessment shall be properly handled according to the principle of “different standards for new and old enterprises, and steady transition towards a new licensing mode”.

 (八)依法实行排污许可管理制度。加快排污许可管理条例立法进程,完善排污许可制度,加强对企业排污行为的监督检查。按照新老有别、平稳过渡原则,妥善处理排污许可与环评制度的关系。
