| Chapter I General Provisions | | 第一章 总则 |
| Article 1 For purposes of strengthening the administration of border security of berths for Taiwan fishing boats, promoting the exchange of compatriots of both sides, and maintaining the security order of coastal areas and ports, these Measures are developed in accordance with relevant laws and regulations of the state. | | 第一条 为了加强台湾渔船停泊点的边防治安管理，促进两岸同胞交往，维护沿海、港口的治安秩序，根据国家有关法律、法规，制定本办法。 |
| Article 2 The administration of border security of Taiwan fishing boats and seamen shall follow the principles of ensuring security and facilitating exchange. | | 第二条 对台湾渔船及船员的边防治安管理，遵循确保安全、方便往来的原则。 |
| Article 3 Where a Taiwan fishing boat needs to berth on the coast of mainland China (hereinafter referred to as the “mainland”), it shall berth at the berth for Taiwan fishing boats approved by the competent department of the State Council (hereinafter referred to as the “berth”). The Taiwan fishing boat may berth at a nearby shelter point for Taiwan fishing boats approved by the relevant department of the state due to typhoon or any other force majeure or any unforeseeable emergency. It shall immediately sail away from the shelter point after the elimination of force majeure or any unforeseeable emergency. | | 第三条 台湾渔船需要在祖国大陆（以下简称大陆）沿岸停靠的，应当在国务院主管部门批准的台湾渔船停泊点（以下简称停泊点）停泊。因遇台风等不可抗力的事由或者不可预见的紧急情况，台湾渔船可以就近在国家有关部门批准的台湾渔船避风点停泊。不可抗力的事由或者不可预见的紧急情况消除后，应当立即航离。 |
| Article 4 Taiwan fishing boats and personnel aboard berthing at berths shall abide by these Measures, unless it is otherwise prescribed by any law or regulation. | | 第四条 凡在停泊点停泊的台湾渔船及随船人员，除法律、法规另有规定外，应当遵守本办法。 |
| Article 5 The border defense departments of public security authorities shall be responsible for the administration of border defense security during the period when Taiwan fishing boats and crew berth along the coast of the mainland. | | 第五条 台湾渔船及船员在大陆沿岸停靠期间的边防治安管理工作由公安边防部门负责。 |
| Chapter II Berth at a Port | | 第二章 泊港 |
| Article 6 After a Taiwan fishing boat enters the berth, the captain shall, in a timely manner, declare to the border defense work station of the berth, show the ship's certificate, certificate of seafarer or any other valid certificate, state the reason for berth and time period of berth, and accept the inspection of border defense personnel who are on duty. | | 第六条 台湾渔船进入停泊点后，船长应当及时向停泊点边防工作站申报，出示船舶证书、船员证书或其他有效证件，说明来靠原因及泊港时间，接受边防执勤人员的检查。 |
| Article 7 The border defense work station shall check the ship's certificate, certificate of seafarer and other valid certificates and verify the number of people of a Taiwan fishing boat entering the port. During the period when the Taiwan fishing boat berths at the port, its ship's certificate shall be taken into custody by the border defense work station on its behalf, and returned to it when it departs from the port. | | 第七条 边防工作站对进港的台湾渔船，应查验其船舶证书、船员证书及其他有效证件，核对人数；台湾渔船泊港期间，其船舶证书由边防工作站代为保管，离港时发还。 |
| When the border defense work station inspects the Taiwan fishing boat, it shall conduct major inspection of the boat and goods and luggage on the boat, and the captain of the Taiwan fishing boat shall assist the border defense personnel who are on duty in conducting inspection on site. | | 边防工作站对台湾渔船实施检查时，应当对船体及船上货物、行李物品进行重点检查，台湾渔船的船长应当在现场协助边防执勤人员进行检查。 |
| Border defense personnel who are on duty shall show their duty certificates when inspecting Taiwan fishing boats. | | 边防执勤人员对台湾渔船实施检查时，应当出示其执勤证件。 |
| Article 8 A Taiwan fishing boat must berth at the designated berth area (section) during the berth period, and accept the guardianship and administration of the border defense work station. | | 第八条 台湾渔船泊港期间，必须在指定的停泊区（段）锚泊，接受边防工作站的监护和管理。 |
| Article 9 During the berth period, a Taiwan fishing boat shall, in addition to abiding by the laws and regulations of the state, abide by the following provisions: | | 第九条 台湾渔船泊港期间，除遵守国家法律、法规外，还应当遵守下列规定： |
| (1) It shall not hang or exhibit any sign that is against the principle of one China and damages national unification. | | （一）不得悬挂、显示有损一个中国原则和祖国统一的标志； |
| (2) It shall not broadcast any content that splits the motherland and disrupts national unification. | | （二）不得播放分裂祖国、破坏祖国统一内容的广播； |
| (3) It shall not use any broadcasting station without approval. | | （三）不得擅自启用电台； |
| (4) It shall not spread or distribute any prohibited articles and articles unfavorable for normal cross-strait exchange, and shall not carry any prohibited articles to debark. | | （四）不得传播、散发各种违禁物品及不利两岸正常往来的物品，不得携带违禁物品上岸； |
| (5) It shall not lead any mainland resident aboard without approval. | | （五）不得擅自引带大陆居民登船； |
| (6) It shall not moor to any other vessel without approval. | | （六）不得擅自搭靠其他船舶； |
| (7) It shall not conduct any other activities that damage the cross-strait relationship. | | （七）不得从事其他有损两岸关系的活动。 |
| Chapter III Debarking and Embarking on a Ship | | 第三章 登陆与登轮 |
| Article 10 Where a staff member of the relevant department of the state needs to perform official duties aboard during the berth period of a Taiwan fishing boat, he or she shall notify the border defense work station in advance, and the border defense personnel who are on duty shall release the said staff member based on his or her valid certificate; and if any other person needs to embark on a ship, he or she may embark on the ship only after undergoing temporary embarking formalities with the approval of the border defense work station. | | 第十条 台湾渔船泊港期间，国家有关部门的工作人员需要登船执行公务的，应当事先通报边防工作站，边防执勤人员凭其本人有效证件放行；其他人员需要登轮的，须经边防工作站同意，并办理临时登轮手续后，方可登轮。 |
| Where a mainland vessel needs to moor to a Taiwan fishing boat, the captain shall apply to the border defense work station for undergoing mooring formalities. | | 大陆船舶需要搭靠台湾渔船的，应当由船长向边防工作站申请办理搭靠手续。 |
Article 11 Where a Taiwan resident on a Taiwan fishing boat needs to debark at the mainland, he shall apply to the border defense work station for the Debarking Certificate for Taiwan Residents based on his or her certificate of seafarer or any other valid identity certificate, conduct activities within the scope of the county (city or district) at the place where the port is located, and shall not enter any prohibited military zone or military management zone.
