| The Arrangement Concerning Mutual Assistance in Court-ordered Interim Measures in Aid of Arbitral Proceedings by the Courts of the Mainland and of the Hong Kong Special Administrative Region (hereinafter referred to as the “Arrangement”) will come into force on October 1, 2019. In order to effectively implement the Arrangement, you are hereby notified of the relevant issues as follows: | | 《最高人民法院关于内地与香港特别行政区法院就仲裁程序相互协助保全的安排》(以下简称《安排》)将于2019年10月1日生效。为贯彻执行好《安排》，现就有关问题通知如下： |
I. For the purpose of the Arrangement, “arbitrations” are determined in accordance with the law of the requested party. In accordance with the Arbitration Law of the People's Republic of China, disputes that may be arbitrated are limited to the contract disputes and other property right and interest disputes that have occurred among the citizens, legal persons, and other organizations as equal parties. Accordingly, for the purpose of this Arrangement, “arbitral proceedings in Hong Kong” do not include investment arbitrations between investors and the host countries or regions.
