Interim Measures for the Administration of Sharing of Government Information Resources 政务信息资源共享管理暂行办法
Chapter I General Provisions 

第一章 总  则

Article 1 For the purposes of accelerating the interconnection of government information systems and the sharing of public data, enhancing governments' credibility, raising administrative efficiency, improving services, and maximizing the important role of sharing of government information systems in furthering reform, transforming functions and innovating on management, these Measures are developed in accordance with relevant laws and regulations, the Notice of the State Council on Issuing the Platform for Action on Promoting Big Data Development (No. 50 [2015], State Council), and other relevant provisions.   第一条 为加快推动政务信息系统互联和公共数据共享,增强政府公信力,提高行政效率,提升服务水平,充分发挥政务信息资源共享在深化改革、转变职能、创新管理中的重要作用,依据相关法律法规和《国务院关于印发促进大数据发展行动纲要的通知》(国发〔2015〕50号)等规定,制定本办法。
Article 2 For the purpose of these Measures, “government information resources” means all kinds of information resources such as documents, materials, tables and data produced or acquired by government departments in the performance of functions and recorded and retained in certain forms, including the information resources legally collected by government departments, directly or through third parties, those managed upon legal authorization, and those formed through government information systems for the performance of functions.   第二条 本办法所称政务信息资源,是指政务部门在履行职责过程中制作或获取的,以一定形式记录、保存的文件、资料、图表和数据等各类信息资源,包括政务部门直接或通过第三方依法采集的、依法授权管理的和因履行职责需要依托政务信息系统形成的信息资源等。
For the purpose of these Measures, “government departments” means government departments, as well as public institutions and social organizations with administrative functions as authorized by laws and regulations. 本办法所称政务部门,是指政府部门及法律法规授权具有行政职能的事业单位和社会组织。
Article 3 These Measures shall be used to regulate the sharing of government information resources among government departments, including the use of government information resources of other government departments for the performance of functions and the provision of government information resources for other government departments.   第三条 本办法用于规范政务部门间政务信息资源共享工作,包括因履行职责需要使用其他政务部门政务信息资源和为其他政务部门提供政务信息资源的行为。
Article 4 The inter-ministerial joint meeting for big data development (hereinafter referred to as the “joint meeting”) shall be responsible for organizing, directing, coordinating and overseeing the sharing of government information resources, directing and organizing all departments of the State Council and all local governments to compile catalogues of government information resources, organizing the preparation of the catalogue of government information resources of the state, and directing the entities that construct, operate and manage the national data sharing and exchange platform to conduct the routine maintenance of the catalogue of government information resources of the state.   第四条 促进大数据发展部际联席会议(以下简称联席会议)负责组织、指导、协调和监督政务信息资源共享工作,指导和组织国务院各部门、各地方政府编制政务信息资源目录,组织编制国家政务信息资源目录,并指导国家数据共享交换平台建设、运行、管理单位开展国家政务信息资源目录的日常维护工作。
All government departments shall, according to these Measures, be responsible for their interconnection with the data sharing and exchange platform (hereinafter referred to as the “sharing platform”), provide shared government information resources (hereinafter referred to as “shared information”) to the sharing platform based on the catalogues of government information resources, and obtain and use shared information from the sharing platform. 各政务部门按本办法规定负责本部门与数据共享交换平台(以下简称共享平台)的联通,并按照政务信息资源目录向共享平台提供共享的政务信息资源(以下简称共享信息),从共享平台获取并使用共享信息。
Article 5 The sharing of government information resources shall observe the following principles:   第五条 政务信息资源共享应遵循以下原则:
(1) Taking sharing as the principle and non-sharing as the exception. The government information resources formed by all government departments shall be shared in principle, and those involving any state secret or national security shall be governed by relevant laws and regulations. (一)以共享为原则,不共享为例外。各政务部门形成的政务信息资源原则上应予共享,涉及国家秘密和安全的,按相关法律法规执行。
(2) Demand orientation and free use. Where a department that needs to use shared information for the performance of functions (hereinafter referred to as the “user”) raises specific sharing demand and information use purpose, the department that produces and provides the shared information (hereinafter collectively referred to as the “provider”) shall respond in a timely manner and provide sharing services free of charge. (二)需求导向,无偿使用。因履行职责需要使用共享信息的部门(以下简称使用部门)提出明确的共享需求和信息使用用途,共享信息的产生和提供部门(以下统称提供部门)应及时响应并无偿提供共享服务。
(3) Uniform standards and overall planning on construction. The collection, storage, exchange and sharing of government information resources shall be conducted according to the relevant national standards for government information resources, “one source for one data” and diversified verification shall be adhered to, and overall planning shall be made on the construction of the catalogue system and the sharing and exchange system of government information resources. (三)统一标准,统筹建设。按照国家政务信息资源相关标准进行政务信息资源的采集、存储、交换和共享工作,坚持“一数一源”、多元校核,统筹建设政务信息资源目录体系和共享交换体系。
(4) Establishing mechanisms to ensure security. The joint meeting shall make overall planning to establish a management mechanism for the sharing of government information resources and an information sharing evaluation mechanism. All government departments and sharing platform management entities shall strengthen identification, authorization management and security guarantee during the entire course of collection, sharing and use of shared information, so as to ensure the security of shared information. (四)建立机制,保障安全。联席会议统筹建立政务信息资源共享管理机制和信息共享工作评价机制,各政务部门和共享平台管理单位应加强对共享信息采集、共享、使用全过程的身份鉴别、授权管理和安全保障,确保共享信息安全。
Article 6 All government departments shall, based on the reestablishment and optimization of information sharing business flows, innovate in social management and service modes, and improve social governance and public services under the condition of informationization.   第六条 各政务部门应加强基于信息共享的业务流程再造和优化,创新社会管理和服务模式,提高信息化条件下社会治理能力和公共服务水平。
Chapter II Catalogues of Government Information Resources 

第二章 政务信息资源目录

Article 7 The National Development and Reform Commission shall be responsible for developing the Guidelines for the Preparation of Catalogues of Government Information Resources, so as to specify the categorization, responsible party, format, attribute, updating time, sharing type, sharing method, and use requirements, among others, of government information resources.   第七条 国家发展改革委负责制定《政务信息资源目录编制指南》,明确政务信息资源的分类、责任方、格式、属性、更新时限、共享类型、共享方式、使用要求等内容。
Article 8 All government departments shall, according to the requirements of the Guidelines for the Preparation of Catalogues of Government Information Resources, compile and maintain their catalogues of government information resources, and update their catalogues of government information resources within 15 working days as of the date of revision of relevant laws and regulations or change of administrative functions. All local governments shall, according to the requirements of the Guidelines for the Preparation of Catalogues of Government Information Resources, compile and maintain the catalogues of local government information resources, and be responsible for the supervision and examination of the updating of catalogues of government information resources of all government departments at the same level.   第八条 各政务部门按照《政务信息资源目录编制指南》要求编制、维护部门政务信息资源目录,并在有关法律法规作出修订或行政管理职能发生变化之日起15个工作日内更新本部门政务信息资源目录。各地方政府按照《政务信息资源目录编制指南》要求编制、维护地方政务信息资源目录,并负责对本级各政务部门政务信息资源目录更新工作的监督考核。
The National Development and Reform Commission shall summarize and form the catalogue of government information resources of the state, and establish the catalogue updating mechanism. The catalogue of government information resources of the state is the basis for realizing the sharing of government information resources of the state and the collaboration of services and the basis for sharing information resources among government departments. 国家发展改革委汇总形成国家政务信息资源目录,并建立目录更新机制。国家政务信息资源目录是实现国家政务信息资源共享和业务协同的基础,是政务部门间信息资源共享的依据。
