| Measures for the Implementation of the Regulation on the Administration of Administrative Divisions | | 行政区划管理条例实施办法 |
| Article 1 These Measures are developed in accordance with the Regulation on the Administration of Administrative Divisions (hereinafter referred to as “the Regulation”). | | 第一条 根据《行政区划管理条例》（以下简称条例），制定本办法。 |
| Article 2 For the purpose of the Regulation, the term “alteration of administrative divisions” means the establishment and cancellation of administrative divisions, alteration of subordination relationship of administrative divisions, alteration of administrative boundaries, relocation of a people's government, and alteration of the name of an administrative division. | | 第二条 条例所称行政区划的变更，包括行政区划的设立、撤销，行政区划隶属关系的变更，行政区域界线的变更，人民政府驻地的迁移和行政区划名称的变更。 |
| The term “alteration of subordination relationship of an administrative division” means the transfer of administrative jurisdiction over an administrative division from the previous superior administrative division to another. Authorizing the administrative functions of one administrative division to another or altering the authorization relationship without changing the subordination relationship of the administrative division shall be governed, mutatis mutandis, by the provisions regarding the alteration of subordination relationship of administrative divisions. | | 行政区划隶属关系的变更，是指行政区划整建制由其原上级行政区划划归另一个上级行政区划管辖。在不改变行政区划隶属关系的情况下，将行政区划整建制委托另一行政区划代管或者变更代管关系，参照行政区划隶属关系的变更办理。 |
| The term “alteration of administrative boundaries” means the transfer of certain administrative jurisdiction of one administrative division to another. | | 行政区域界线的变更，是指将一个行政区划的部分行政区域划归另一行政区划管辖。 |
| The term “relocation of a people's government (or its dispatched office)” means the relocation of a people's government at the county level or above (or its dispatched office) across the lower-level administrative divisions (or the scope of jurisdiction of the dispatched office), and the relocation of a people's government at the township, ethnic township, or town level, or a sub-district office across the scope of jurisdiction of villagers' (residents') committees. | | 人民政府（派出机关）驻地的迁移，是指县级以上地方人民政府（派出机关）驻地跨下一级行政区划（派出机关管辖范围）的变更和乡、民族乡、镇人民政府、街道办事处驻地跨村（居）民委员会管辖范围的变更。 |
| The term “alteration of the name of an administrative division” means the alteration of a specific name for an administrative division. | | 行政区划名称的变更，是指改变行政区划专名。 |
| Article 3 If an administrative division is to be established or cancelled, the people's government at the higher level that intends to do so shall develop an alteration plan. If, when an administrative division is being cancelled, a new administrative division is to be established with its administrative area remaining unchanged, the local people's government that intends to cancel the administrative division may develop an alteration plan. If an administrative division is to be established, the alteration plan shall specify the name, organizational type, subordination relationship (including authorization relationship), administrative boundaries of the administrative division, as well as the location of the people's government. If an administrative division is to be cancelled, the alteration plan shall specify the jurisdiction of the administrative areas under the administrative division after the cancellation. | | 第三条 行政区划的设立、撤销，由拟设立行政区划或者拟撤销行政区划的上一级地方人民政府制订变更方案。在撤销的同时设立新的行政区划且行政区域不变的，可以由拟撤销行政区划的地方人民政府制订变更方案。涉及设立行政区划的，应当在变更方案中明确拟设立行政区划的名称、建制类型、隶属关系（含代管关系）、行政区域界线和人民政府驻地。涉及撤销行政区划的，应当在变更方案中明确行政区划撤销后其所辖行政区域的归属。 |
| If the subordination relationship or the administrative boundaries is to be altered, the relevant people's governments shall negotiate with each other before jointly developing an alteration plan; and if they fail to reach a consensus, an alteration plan may be developed by the people's government(s) of one party or multiple parties, or common people's government at the next higher level of parties concerned. | | 变更行政区划隶属关系和变更行政区域界线，由有关地方人民政府先行协商并共同制订变更方案；如未能取得一致意见时，可以由单方、多方或者共同的上一级人民政府制订变更方案。 |
| If a people's government is to be relocated or the name of an administrative division is to be altered, an alteration plan shall be made by the people's government at the corresponding level. | | 变更人民政府驻地和变更行政区划名称，由本级地方人民政府制订变更方案。 |
| Article 4 The information regarding the standards of establishing a city or a district under a city shall include demographic structure, socio-economic development, resource and environment carrying capacity, national spatial development and utilization, construction of infrastructure, and the capabilities of basic public services. | | 第四条 市、市辖区设立标准的内容应当包括：人口规模结构、经济社会发展水平、资源环境承载能力、国土空间开发利用状况、基础设施建设状况和基本公共服务能力等。 |
| In developing the standards of establishing a township or a sub-district, such conditions as socio-economic development and urbanization of the province, autonomous region or municipality directly under the Central Government, urban system and township layout, population, resources and environment shall be taken into consideration. | | 拟订镇、街道设立标准，应当充分考虑本省、自治区、直辖市经济社会和城镇化发展水平、城镇体系和乡镇布局、人口规模和资源环境等情况。 |
| The civil affairs department that organizes the development of standards for establishing a city, a district under a city, a township, or a sub-district shall, in conjunction with the relevant departments, assess the implementation of standards, and adjust the standards based on the assessment results according to the authority and procedures as required. | | 组织拟订市、市辖区设立标准和镇、街道设立标准的民政部门，应当会同有关部门对标准的实施情况进行评估，并根据评估情况按照规定的权限和程序调整标准。 |
| Article 5 When approving the alteration of certain administrative boundaries of a county, a city, or a district under a city, or the relocation of the people's government of a county, a city not divided into districts, or a district under a city, the people's government of a province, an autonomous region, or a municipality directly under the Central Government shall submit the following materials (in quintuplicate) to the civil affairs department of the State Council for recordation: | | 第五条 省、自治区、直辖市人民政府批准县、市、市辖区部分行政区域界线变更或者县、不设区的市、市辖区人民政府驻地迁移时，应当将以下备案材料一式五份径送国务院民政部门： |
| 1. A report prepared by the people's government of the province, autonomous region, or municipality directly under the Central Government for recordation. | | （一）由省、自治区、直辖市人民政府出具的备案报告； |
| 2. Approval documents concerning the alteration of an administrative division. | | （二）行政区划变更批复文件； |
| 3. Application materials for the alteration of an administrative division submitted by the local people's government in accordance with the provisions of Article 13 of the Regulation. | | （三）申请变更行政区划的地方人民政府根据条例第十三条规定提交的行政区划变更申请材料。 |
| Article 6 When approving the standards of establishing a township or a sub-district, the people's government of a province, autonomous region, or municipality directly under the Central Government shall submit the following materials (in quintuplicate) to the civil affairs department of the State Council: | | 第六条 省、自治区、直辖市人民政府批准镇、街道设立标准时，应当将以下材料一式五份径送国务院民政部门： |
| 1. A report prepared by the people's government of the province, autonomous region, or municipality directly under the Central Government for recordation. | | （一）由省、自治区、直辖市人民政府出具的备案报告； |
| 2. Documents issuing the standards, texts of the standards and statements issued by the province, autonomous region, or municipality directly under the Central Government. | | （二）省、自治区、直辖市印发标准的文件、标准文本和说明。 |
Article 7 If the alteration items of an administrative division or the materials regarding the standards of establishing a township or a sub-district submitted by the people's government of a province, autonomous region or municipality directly under the Central Government fail to comply with the provisions as set forth in Article 5 or Article 6 of these Measures, the civil affairs department of the State Council shall give guidance on supplementing and correcting the materials; and the materials that are fully prepared and comply with the provisions shall be deemed qualified for recordation.
