The relevant departments of the CPC Central Committee, all ministries and commissions of the State Council, the institutions directly under the State Council, the General Office of the Standing Committee of the National People's Congress, the General Office of the Chinese People's Political Consultative Conference, the Supreme People's Procuratorate, the Supreme People's Court, relevant people's organizations, and the development and reform commissions, price bureaus, and finance offices (bureaus) of all provinces, autonomous regions, and municipalities directly under the Central Government: 党中央有关部门,国务院各部委、各直属机构,全国人大常委会办公厅,全国政协办公厅,高检院,高法院,有关人民团体,各省、自治区、直辖市发展改革委、物价局、财政厅(局):
For the purposes of strengthening the administration of charges collected by the state organs and public institutions, regulating the act of administering charging rates, enhancing the scientific nature and transparency in decision making of charging, and protecting the legitimate rights and interests of citizens, legal persons and other organizations, we have revised the Provisional Measures for the Administration of Administrative Charging Rates and formulated the Measures for the Administration of Administrative Charging Rates, which are hereby issued to you for your compliance and implementation. 为加强国家机关和事业单位收费管理,规范收费标准管理行为,提高收费决策的科学性和透明度,维护公民、法人和其他组织的合法权益,我们对2006年印发的《行政事业性收费标准管理暂行办法》进行了修订,形成了《行政事业性收费标准管理办法》。现印发给你们,请遵照执行。

Chapter I General Provisions 

第一章 总则

Article 1 In order to strengthen the administration of administrative charging rates, protect the legitimate rights and interests of citizens, legal persons and other organizations, regulate the act of administering charging rates, and enhance the scientific nature and transparency in decision making of charging, these Measures are formulated in accordance with the Price Law of the People's Republic of China, the Budget Law of the People's Republic of China, and relevant provisions of the State Council.   第一条 为加强行政事业性收费标准管理,保护公民、法人和其他组织的合法权益,规范对收费标准的管理行为,提高收费决策的科学性和透明度,根据《中华人民共和国价格法》、《中华人民共和国预算法》及国务院有关规定,制定本办法。
Article 2 For any charging item on the list of administrative charges within the territory of the People's Republic of China, these Measures shall be applicable to the application, acceptance, investigation, argumentation, examination, decision-making, issuance, publication, supervision and inspection of its charging rate, except as provided otherwise by any law or regulation.   第二条 中华人民共和国境内列入行政事业性收费目录清单的收费项目,收费标准的申请、受理、调查、论证、审核、决策、公布、公示、监督、检查等,适用本办法。法律法规另有规定的,从其规定。
Article 3 The “administrative charges” (hereinafter referred to as the “charges”) mentioned in these Measures refers to those fees that are collected by the state organs, public institutions, social organizations on the government's behalf and other organizations from specific objects in accordance with laws and regulations and upon the approval of procedures as provided for by the State Council when they are conducting social public management, and offering specific services to citizens, legal persons and other organizations.   第三条 本办法所称行政事业性收费(以下简称“收费”),是指国家机关、事业单位、代行政府职能的社会团体及其他组织根据法律法规等有关规定,依照国务院规定程序批准,在实施社会公共管理,以及在向公民、法人和其他组织提供特定公共服务过程中,向特定对象收取的费用。
Article 4 A two-level examination and approval system of the central and provincial levels shall be implemented for charging rates. The price and finance departments of the State Council and the people's governments of the provinces, autonomous regions and municipalities directly under the Central Government (hereinafter referred to as the “provincial government”) shall examine and approve the charging rates pursuant to the functions provided for by relevant provisions. For any charging item that is not on the list of administrative charges, no examination and approval shall be conducted on its charging rate.   第四条 收费标准实行中央和省两级审批制度。国务院和省、自治区、直辖市人民政府(以下简称“省级政府”)的价格、财政部门按照规定权限审批收费标准。未列入行政事业性收费目录清单的收费项目,一律不得审批收费标准。
Any charging rate implemented by relevant departments of the Central Government and public institutions (including the central department dispatched to the localities, the same below), and implemented across the country or certain regions (across provinces, autonomous regions and/or municipalities directly under the Central Government) shall be submitted to the price and finance departments of the State Council for examination and approval; and the charging rate of an important charging item shall be submitted to the price and finance departments of the State Council, which shall, upon examination, report it to the State Council for approval. 中央有关部门和单位(包括中央驻地方单位,下同),以及全国或者区域(跨省、自治区、直辖市)范围内实施收费的收费标准,由国务院价格、财政部门审批。其中,重要收费项目的收费标准应当由国务院价格、财政部门审核后报请国务院批准。
Other charging rates except those mentioned in the above paragraph shall be submitted to the provincial-level price and finance departments for examination and approval; and the charging rate of an important charging item shall be submitted to the provincial-level price and finance departments, which shall, upon examination, report it to the provincial people's government for approval. 除上款规定的其他收费标准,由省级政府价格、财政部门审批。其中,重要收费项目的收费标准应当由省级政府价格、财政部门审核后报请省级政府批准。
Article 5 The charging rates implemented across the country or certain regions (across provinces, autonomous regions and/or municipalities directly under the Central Government) that have a huge regional cost difference, under the authorization of the price and finance departments of the State Council, shall be submitted to the provincial-level price and finance departments for examination and approval.   第五条 地域成本差异较大的全国或者区域(跨省、自治区、直辖市)范围内实施的收费标准,国务院价格、财政部门可以授权省级政府价格、财政部门审批。
For examination and registration fees that need professional services and have multiple categories, the provincial-level price and finance departments may set the upper limit for the charging rate, within which the competent authorities shall determine the specific charging rate. 专业性强且类别较多的考试、注册等收费,省级以上政府价格、财政部门可以制定收费标准的上限,由行业主管部门在上限范围内确定具体收费标准。
Article 6 The following principles shall be followed when examining and approving a charging rate:   第六条 审批收费标准应当遵循以下原则:
1. The principle of fairness, impartiality, openness and efficiency; (一)公平、公正、公开和效率的原则;
2. The principle of meeting the requirements of social public management, reasonably compensating for the costs of management or services, and complying with the bearing capacity of the society; (二)满足社会公共管理需要,合理补偿管理或者服务成本,并与社会承受能力相适应的原则;
3. The principle of promoting environmental protection, and conservation and effective utilization of resources, as well as sustainable development of economic and social undertakings; (三)促进环境保护、资源节约和有效利用,以及经济和社会事业持续发展的原则;
4. The principle of complying with the international practice and international reciprocity. (四)符合国际惯例和国际对等的原则。
Article 7 A citizen, legal person or any other organization shall be entitled to supervising the implementation and administration of charges, and may refuse to pay and report the charges that violate any of the law and regulations or these Measures.   第七条 公民、法人或者其他组织有权对收费的实施和管理进行监督,可以拒绝缴纳和举报违反法律法规以及本办法规定的收费。
Chapter II Application and Acceptance 

第二章 申请和受理

Article 8 Unless it is otherwise prescribed by laws, regulations and the provisions of provincial people's governments or above, when a charging entity applies for making or adjusting a charging rate, it shall, according to the power limits of examination and approval, submit a written application to the price and finance departments of the State Council or provincial-level price and finance departments (hereinafter referred to as the “price and finance departments”).   第八条 除法律法规和省级以上人民政府另有规定外,收费单位申请制定或者调整收费标准,应当按照管理权限向国务院价格、财政部门或者省级政府价格、财政部门(以下简称“价格、财政部门”)提出书面申请。
If the charging rate is to be examined and approved by the price and finance departments of the State Council, the relevant departments of the Central Government, the provincial people's governments and their price and finance departments shall submit a written application to the price and finance departments of the State Council. 国务院价格、财政部门负责审批的收费标准,由中央有关部门,省级政府或者其价格、财政部门向国务院价格、财政部门提出书面申请。
If the charging rate is to be examined and approved by the provincial-level price and finance departments, the relevant departments of provincial people's governments, municipal people's governments at the prefecture level, or their price and finance departments shall submit a written application to the provincial-level price and finance departments. 省级政府价格、财政部门负责审批的收费标准,由省级政府有关部门、地市级人民政府或者其价格、财政部门向省级政府价格、财政部门提出书面申请。
