For purposes of reforming and improving the rural land system and providing practical experience for advancing agricultural modernization and new urbanization with Chinese characteristics, as decided at the 13th session of the Standing Committee of the Twelfth National People's Congress, the State Council is authorized to provisionally adjust the implementation of the provisions on rural land expropriation, marketing of commercial collective construction land, and homestead administration systems of the Land Administration Law of the People's Republic of China and the Urban Real Estate Administration Law of the People's Republic of China in the administrative regions of 33 counties (cities and districts) under the pilot program including Daxing District of Beijing Municipality. Such adjustment shall be implemented on a trial basis until December 31, 2017. In relation to the provisional adjustment of the implementation of the relevant provisions of the laws, the bottom line that the nature of public ownership of land remains unchanged, the red line of arable land is not crossed, and the interests of farmers are not injured shall be upheld, and the principle of starting from reality based on local conditions shall be adhered to. The State Council and its land and resources department shall strengthen the overall guidance, holistic coordination, supervision and administration of work relating to the pilot program, proceed prudently, properly, according to procedures, step by step, summarize experience in work relating to the pilot program in a timely manner, and report on the provisional adjustment of the implementation of the relevant provisions of the laws to the Standing Committee of the National People's Congress. If the practice proves such adjustment feasible, the relevant laws shall be revised and improved; and if the practice proves such adjustment inappropriate, the implementation of relevant provisions of the laws shall be resumed.
．．．．．． | | 为了改革完善农村土地制度，为推进中国特色农业现代化和新型城镇化提供实践经验，第十二届全国人民代表大会常务委员会第十三次会议决定：授权国务院在北京市大兴区等三十三个试点县（市、区）行政区域，暂时调整实施《中华人民共和国土地管理法》、《中华人民共和国城市房地产管理法》关于农村土地征收、集体经营性建设用地入市、宅基地管理制度的有关规定。上述调整在2017年12月31日前试行。暂时调整实施有关法律规定，必须坚守土地公有制性质不改变、耕地红线不突破、农民利益不受损的底线，坚持从实际出发，因地制宜。国务院及其国土资源主管部门要加强对试点工作的整体指导和统筹协调、监督管理，按程序、分步骤审慎稳妥推进，及时总结试点工作经验，并就暂时调整实施有关法律规定的情况向全国人民代表大会常务委员会作出报告。对实践证明可行的，修改完善有关法律；对实践证明不宜调整的，恢复施行有关法律规定。
