| Interpretation of the Supreme People's Court of Several Issues on the Application of Law in the Trial of Criminal Cases on Cover-up or Concealment of Crime-Related Income and Proceeds Therefrom | | 最高人民法院关于审理掩饰、隐瞒犯罪所得、犯罪所得收益刑事案件适用法律若干问题的解释 |

| For the purpose of legally punishing such criminal acts as cover-up or concealment of crime-related income and proceeds therefrom, in accordance with the relevant provisions of the Criminal Law and in light of the criminal trial work of people's courts, several issues on the specific application of law in the trial of such type of cases are hereby interpreted as follows: | | 为依法惩治掩饰、隐瞒犯罪所得、犯罪所得收益犯罪活动，根据刑法有关规定，结合人民法院刑事审判工作实际，现就审理此类案件具体适用法律的若干问题解释如下： |
| Article 1 Whoever knowingly harbors, transfers, purchases or sells on behalf of any other person or covers up or conceals by other methods crime-related income and proceeds therefrom under any of the following circumstances shall be convicted and punished for the crime of covering up or concealing crime-related income and proceeds therefrom in accordance with paragraph 1 of Article 312 of the Criminal Law. | | 第一条 明知是犯罪所得及其产生的收益而予以窝藏、转移、收购、代为销售或者以其他方法掩饰、隐瞒，具有下列情形之一的，应当依照刑法三百一十二条第一款的规定，以掩饰、隐瞒犯罪所得、犯罪所得收益罪定罪处罚： |
| (1) The value of crime-related income and proceeds therefrom covered up or concealed is 3,000 yuan up to 10,000 yuan. | | （一）掩饰、隐瞒犯罪所得及其产生的收益价值三千元至一万元以上的； |
| (2) The offender has been given any administrative penalty for covering up or concealing crime-related income and proceeds therefrom within one year and covers up or conceals crime-related income and proceeds therefrom again after the penalty was imposed. | | （二）一年内曾因掩饰、隐瞒犯罪所得及其产生的收益行为受过行政处罚，又实施掩饰、隐瞒犯罪所得及其产生的收益行为的； |
| (3) The crime-related income covered up or concealed falls under electrical equipment, transport facilities, radio and TV facilities, public telecommunications facilities, military facilities or the funds and materials for disaster relief, emergency rescue, flood control, special care, poverty relief, migration and relief. | | （三）掩饰、隐瞒的犯罪所得系电力设备、交通设施、广播电视设施、公用电信设施、军事设施或者救灾、抢险、防汛、优抚、扶贫、移民、救济款物的； |
| (4) The act of covering up or concealing the income leads to the failure to investigate and punish the upstream crime in a timely manner, and leads to the failure to recover the loss of public and private property. | | （四）掩饰、隐瞒行为致使上游犯罪无法及时查处，并造成公私财物损失无法挽回的； |
| (5) The offender commits any other conduct of covering up or concealing the crime-related income and proceeds therefrom, and obstructs the judicial authority from investigating the upstream crime. | | （五）实施其他掩饰、隐瞒犯罪所得及其产生的收益行为，妨害司法机关对上游犯罪进行追究的。 |
| The higher people's courts of all provinces, autonomous regions, and municipalities directly under the Central Government may, in light of the economic and social development of their respective regions, and in consideration of the public security information, determine the specific amount within the range prescribed in item (1), paragraph 1 of this Article, and report it to the Supreme People's Court for recordation. | | 各省、自治区、直辖市高级人民法院可以根据本地区经济社会发展状况，并考虑社会治安状况，在本条第一款第（一）项规定的数额幅度内，确定本地执行的具体数额标准，报最高人民法院备案。 |
| Where any judicial interpretation prescribes that the act of covering up or concealing the income from the criminal offense involving computer information system data or the right to control the computer information system and the proceeds therefrom constitutes a crime, the trial of such type of cases shall be governed by such provisions. | | 司法解释对掩饰、隐瞒涉及计算机信息系统数据、计算机信息系统控制权的犯罪所得及其产生的收益行为构成犯罪已有规定的，审理此类案件依照该规定。 |
| In accordance with the Interpretation of the Standing Committee of the National People's Congress of Articles 341 and 312 of the Criminal Law of the People's Republic of China, whoever knowingly purchases illegally hunted wild animals of 50 or more shall be convicted and punished for the crime of covering up or concealing crime-related income. | | 依照全国人民代表大会常务委员会《关于〈中华人民共和国刑法〉第三百四十一条、第三百一十二条的解释》，明知是非法狩猎的野生动物而收购，数量达到五十只以上的，以掩饰、隐瞒犯罪所得罪定罪处罚。 |
Article 2 Where the act of covering up or concealing crime-related income and proceeds therefrom complies with the provisions of Article 1 of this Interpretation, and the offender confesses to his or her crime, shows repentance, returns the illegally obtained money, makes compensation, and falls under any of the following circumstances, it may be determined that the crimal circumstances are minor and the offender may be exempt from criminal punishment.
