| Your Request for Instructions on the Case Involving a Patent Infringement Dispute between Lianyungang Yingyou Textile Machinery Co., Ltd. andJiangyinZhouzhuang Textile Equipment Factory has been received. Upon deliberation, the following reply is made: | | 你院《关于连云港鹰游纺机有限责任公司与江阴周庄纺织设备厂专利侵权纠纷一案的请示》收悉。经研究，答复如下： |
I. Where a party waivesthe independent claim and voluntarily choosesdependent claims for the determination of the scope of patent right protection, the people's court shall allow it. Paragraph 1 of Article 56 of the Patent Law provides that the scope of patent right protection for an invention or a utility model shall be governed by the contents of claims. Paragraph 1 of Article 21 of the Detailed Rules for the Implementation of the Patent Law provides that written claims shall contain independent claimsbut may also include dependent claims. Because the term “claims” as referred to in paragraph 1 of Article 56 of the Patent Law is not defined asthe “independent claims” as set out in paragraph 1 of Article 21 of the Detailed Rules for the Implementation of the Patent Law, it shall also include the “dependent claims” as set out in the Detailed Rules for the Implementation. The“dependent claims”consist of additional technical features, and the claims to which the dependent claims refer include but further define the independent claim. Therefore, the scope of patent right protection as defined by the dependent claims is smaller than the scope of patent right protection as defined by the independent claim or the claims to which the dependent claims refer. Therefore, where a party waivesthe independent claim and voluntarily chooses the dependent claims as the basis for determination of the scope of patent right protection, the people's court shall allow itbecause such choice does not violate the law or damage public interests.
．．．．．． | | 一、当事人放弃独立权利要求，自愿选择从属权利要求确定专利权保护范围的，人民法院应当允许。专利法第五十六条第一款规定，发明或者实用新型专利权的保护范围以其权利要求的内容为准。专利法实施细则第二十一条第一款规定，权利要求书应当有独立权利要求，也可以有从属权利要求。由于专利法第五十六条第一款所说的"权利要求"没有仅限定为专利法实施细则第二十一条第一款规定的"独立权利要求"，因此也应当包括实施细则规定的"从属权利要求"。"从属权利要求"是附加的技术特征，对其所引用的权利要求包括独立权利要求作进一步的限定，因此从属权利要求所限定的专利权的保护范围要小于独立权利要求或者其所引用的权利要求所限定的专利权的保护范围。因此，在当事人放弃独立权利要求，自愿选择从属权利要求作为其专利权保护范围的依据的情况下，由于这种选择既不违反法律，也没有损害社会公众利益，人民法院应当允许。
