| Article 1 For the purpose of strengthening the supervision and management of national nature reserves and improving the construction and administration of national nature reserves, these Measures are formulated in accordance with the Environmental Protection Law of the People's Republic of China, the Regulation of the People's Republic of China on Nature Reserves and other relevant provisions. | | 第一条 为加强对国家级自然保护区的监督管理，提高国家级自然保护区的建设和管理水平，根据《中华人民共和国环境保护法》、《中华人民共和国自然保护区条例》以及其他有关规定，制定本办法。 |
| Article 2 These Measures shall apply to the supervision and inspection of various kinds of national nature reserves organized by the competent administrative department of environmental protection under the State Council. | | 第二条 本办法适用于国务院环境保护行政主管部门组织的对全国各类国家级自然保护区的监督检查。 |
| Article 3 The competent administrative department of environmental protection of the State Council is entitled to adopt the following measures in performing its duties of supervision and inspection according to the provisions of laws, regulations and these Measures. | | 第三条 国务院环境保护行政主管部门在依照法律法规和本办法的规定履行监督检查职责时，有权采取下列措施： |
| (1) entering the national nature reserves to conduct on-the-spot inspection; | | （一）进入国家级自然保护区进行实地检查； |
| (2) asking the management bodies of the national nature reserves to report the situation of construction and management; | | （二）要求国家级自然保护区管理机构汇报建设和管理情况； |
| (3) consulting or copying the relevant materials or vouchers; | | （三）查阅或者复制有关资料、凭证； |
| (4) investigating and finding out the relevant situation from the relevant entities and personnel; | | （四）向有关单位和人员调查了解相关情况； |
| (5) other measures it is entitled to take as stipulated by any laws andor regulations. | | （五）法律、法规规定有权采取的其他措施。 |
| When performing the duties of supervision and inspection, the supervising and inspecting personnel shall strictly abide by the procedures stipulated by the relevant laws and regulations, produce the certificates and keep technical and business secrets for the entities subject to the inspection. | | 监督检查人员在履行监督检查职责时，应当严格遵守国家有关法律法规规定的程序，出示证件，并为被检查单位保守技术和业务秘密。 |
| Article 4 The relevant entities and personnel shall provide support and coordination assistance for in the supervision and inspection conducted according to law, reflect the situation according to the facts, provide the relevant materials and may not refuse or impede the supervision and inspection. | | 第四条 有关单位或者人员对依法进行的监督检查应当给予支持与配合，如实反映情况，提供有关资料，不得拒绝或者妨碍监督检查工作。 |
| Article 5 All entities and individuals are entitled to impeach or accuse the entities and individuals that pollute or damage national nature reserves or the organs that fail to perform the duties of supervision and management of national nature reserves. | | 第五条 任何单位和个人都有权对污染或者破坏国家级自然保护区的单位、个人以及不履行或者不依法履行国家级自然保护区监督管理职责的机构进行检举或者控告。 |
| Article 6 The competent administrative department of environmental protection of the State Council shall publicize the relevant situation on the supervision and inspection of national nature reserves to the society and shall be subject to the supervision of the society. | | 第六条 国务院环境保护行政主管部门应当向社会公开国家级自然保护区监督检查的有关情况，接受社会监督。 |
| Article 7 The competent administrative department of environmental protection of the State Council shall organize make regular evaluation appraisals on the construction and management of national nature reserves. | | 第七条 国务院环境保护行政主管部门组织对国家级自然保护区的建设和管理状况进行定期评估。 |
| The competent administrative department of environmental protection of the State Council shall organize the establishment of the national nature reserve evaluation appraisal commission, which shall conduct evaluation an appraisal on the construction and management of national nature reserves on a regular basis and put forward suggestions on rectification according to the evaluation appraisal results. | | 国务院环境保护行政主管部门组织成立国家级自然保护区评估委员会，对国家级自然保护区的建设和管理状况进行定期评估，并根据评估结果提出整改建议。 |
| The regular evaluation appraisals on the construction and management of each national nature reserve shall be conducted made at least once every five years. | | 对每个国家级自然保护区的建设和管理状况的定期评估，每五年不少于一次。 |
| Article 8 The content of the regular evaluation appraisal on national nature reserves shall include: | | 第八条 国家级自然保护区定期评估的内容应当包括： |
| (1) the set-up of management bodies and the staffing situation thereof; | | （一）管理机构的设置和人员编制情况； |
| (2) the condition of the facilities for management and maintenance; | | （二）管护设施状况； |
| (3) the appropriateness of the areas and functional sub-areas, range, boundary line and allocation of land ownership and land use right; | | （三）面积和功能分区适宜性、范围、界线和土地权属； |
| (4) the formulation and implementation of management rules and planning; | | （四）管理规章、规划的制定及其实施情况； |
| (5) the background, protection and utilization of resources; | | （五）资源本底、保护及利用情况； |
| (6) condition of situation of scientific research, monitoring, archives and specimen; | | （六）科研、监测、档案和标本情况； |
| (7) the management of the construction projects within the nature reserve; | | （七）自然保护区内建设项目管理情况； |
| (8) tourism and other human activities; | | （八）旅游和其他人类活动情况； |
| (9) relationship with the surrounding neighborhoods; | | （九）与周边社区的关系状况； |
| (10) situation of publicity, education, training, exchange and cooperation; | | （十）宣传教育、培训、交流与合作情况； |
| (11) management expenditures; | | （十一）管理经费情况； |
| (12) other content that shall be subject to evaluation appraisal. | | （十二）其他应当评估的内容。 |
The standards for the regular evaluation appraisal of national nature reserves shall be otherwise formulated by the competent administrative department of environmental protection of the State Council.
