| Chapter I General Provisions | | 第一章 总则 |
| |
|
| Article 1 In order to regulate the reporting, investigation and disposition of production safety accidents, implement the system of investigating liabilities for production safety accidents, and prevent and reduce production safety accidents, these regulations have been made in accordance with the Law on Safe Production of the People's Republic of China and relevant laws. | | 第一条 为了规范生产安全事故的报告和调查处理，落实生产安全事故责任追究制度，防止和减少生产安全事故，根据《中华人民共和国安全生产法》和有关法律，制定本条例。 |

| Article 2 These regulations shall apply to the reporting, investigation and disposition of the production safety accidents that have caused casualty or direct economic losses arising out of the production or business operation; these regulations shall not apply to the reporting, investigation and disposition of the environmental pollution accidents, nuclear facility accidents and accidents arising out of scientific research and production for national defense. | | 第二条 生产经营活动中发生的造成人身伤亡或者直接经济损失的生产安全事故的报告和调查处理，适用本条例；环境污染事故、核设施事故、国防科研生产事故的报告和调查处理不适用本条例。 |

| Article 3 By the casualty or direct economic losses caused in a production safety accident (hereafter “accident”), the accidents shall be generally graded as follows: | | 第三条 根据生产安全事故（以下简称事故）造成的人员伤亡或者直接经济损失，事故一般分为以下等级： |
| |
|
| (a) Especially serious accident refers to an accident that has caused the deaths of at least 30 persons, serious injuries to at least 100 persons (including acute industrial poisoning), or direct economic losses of at least RMB 100 million yuan; | | （一）特别重大事故，是指造成30人以上死亡，或者100人以上重伤（包括急性工业中毒，下同），或者1亿元以上直接经济损失的事故； |

| (b) Serious accident refers to an accident that has caused the deaths of at least 10 but less than 30 persons, serious injuries to at least 50 but less than 100 persons, or direct economic losses of at least RMB 50 million yuan but less than RMB 100 million yuan; | | （二）重大事故，是指造成10人以上30人以下死亡，或者50人以上100人以下重伤，或者5000万元以上1亿元以下直接经济损失的事故； |

| (c) Large accident refers to an accident that has caused the deaths of at least 3 but less than 10 persons, serious injuries to at least 10 but less than 50 persons, or direct economic losses of at least RMB 10 million yuan but less than RMB 50 million yuan; and | | （三）较大事故，是指造成3人以上10人以下死亡，或者10人以上50人以下重伤，或者1000万元以上5000万元以下直接经济损失的事故； |

| (d) Ordinary accident refers to an accident that has caused the deaths of less than 3 persons, serious injuries to less than 10 persons, or direct economic losses of less than RMB 10 million yuan. | | （四）一般事故，是指造成3人以下死亡，或者10人以下重伤，或者1000万元以下直接经济损失的事故。 |
The Administration of Work Safety of the State Council may make supplementary rules on the grading of accidents in conjunction with the relevant authorities of the State Council. | |
国务院安全生产监督管理部门可以会同国务院有关部门，制定事故等级划分的补充性规定。 |
The “at least” mentioned in the preceding paragraph shall include the number itself, and the “less than” shall not. | |
本条第一款所称的“以上”包括本数，所称的“以下”不包括本数。 |

| Article 4 The accident reporting shall be timely, accurate and complete, and any entity or individual shall not delay, omit, falsify or conceal the reporting. | | 第四条 事故报告应当及时、准确、完整，任何单位和个人对事故不得迟报、漏报、谎报或者瞒报。 |
The investigation and disposition of an accident shall observe the principle of seeking truth from facts and respect for science. The process of, causes for and damage by the accident shall be ascertained timely and accurately, the nature of the accident shall be clarified, the liability for the accident shall be determined, the lessons from the accident shall be summarized, the measures for rectification shall be proposed, and the liabilities of those liable for the accident shall be investigated according to law. | |
事故调查处理应当坚持实事求是、尊重科学的原则，及时、准确地查清事故经过、事故原因和事故损失，查明事故性质，认定事故责任，总结事故教训，提出整改措施，并对事故责任者依法追究责任。 |

| Article 5 The people's governments at or above the county level shall strictly discharge their functions, and timely and accurately complete the investigation and disposition of accidents in accordance with these regulations. | | 第五条 县级以上人民政府应当依照本条例的规定，严格履行职责，及时、准确地完成事故调查处理工作。 |
The relevant local people's government at the place of occurrence of an accident shall support and assist the superior people's government or relevant authorities in the investigation and disposition of accidents, and provide necessary conveniences. | |
事故发生地有关地方人民政府应当支持、配合上级人民政府或者有关部门的事故调查处理工作，并提供必要的便利条件。 |
The authorities and entities participating in the investigation and disposition of an accident shall assist each other to improve the working efficiency of investigation and disposition. | |
参加事故调查处理的部门和单位应当互相配合，提高事故调查处理工作的效率。 |

| Article 6 The trade union shall participate in the investigation and disposition of accidents according to law, and shall have the right to offer opinions on disposition to the relevant authorities. | | 第六条 工会依法参加事故调查处理，有权向有关部门提出处理意见。 |
| |
|
| Article 7 Any entity or individual shall not obstruct or interfere with the reporting and legal investigation and disposition of an accident. | | 第七条 任何单位和个人不得阻挠和干涉对事故的报告和依法调查处理。 |
| |
|
| Article 8 Any entity or individual shall have the right to inform the work safety authority, supervisory authorities or other relevant authorities of any violation in the reporting, investigation and disposition of an accident, and the authorities receiving such information shall timely deal with it according to law. | | 第八条 对事故报告和调查处理中的违法行为，任何单位和个人有权向安全生产监督管理部门、监察机关或者其他有关部门举报，接到举报的部门应当依法及时处理。 |

| Chapter II Accident Reporting | | 第二章 事故报告 |

| Article 9 After the occurrence of an accident, the relevant on-site personnel in the accident shall immediately report it to the person in charge of their entity; the person in charge of their entity shall report it to the work safety authority and relevant authorities responsible for work safety of the people's government at or above the county level at the place of occurrence of the accident within 1 hour after receiving the report. | | 第九条 事故发生后，事故现场有关人员应当立即向本单位负责人报告；单位负责人接到报告后，应当于1小时内向事故发生地县级以上人民政府安全生产监督管理部门和负有安全生产监督管理职责的有关部门报告。 |
In case of emergency, the relevant on-site personnel in the accident may directly report it to the work safety authority and relevant authorities responsible for work safety of the people's government at or above the county level at the place of occurrence of the accident. | |
情况紧急时，事故现场有关人员可以直接向事故发生地县级以上人民政府安全生产监督管理部门和负有安全生产监督管理职责的有关部门报告。 |

| Article 10 After receiving an accident report, the work safety authority and relevant authorities responsible for work safety of the people's government shall report the accident to their superior authorities, and notify the public security organ, administrative authority on labor security, trade union and people's procuratorate, as required below: | | 第十条 安全生产监督管理部门和负有安全生产监督管理职责的有关部门接到事故报告后，应当依照下列规定上报事故情况，并通知公安机关、劳动保障行政部门、工会和人民检察院： |

| (a) An especially serious accident or serious accident shall be reported level by level to the work safety authority and relevant authorities responsible for work safety of the State Council; | | （一）特别重大事故、重大事故逐级上报至国务院安全生产监督管理部门和负有安全生产监督管理职责的有关部门； |
| |
|
| (b) A large accident shall be reported level by level to the work safety authority and relevant authorities responsible for work safety of the people's government of a province, autonomous region or municipality directly under the Central Government; and | | （二）较大事故逐级上报至省、自治区、直辖市人民政府安全生产监督管理部门和负有安全生产监督管理职责的有关部门； |

|
| (c) An ordinary accident shall be reported to the work safety authority and relevant authorities responsible for work safety of the people's government of a municipality with districts. | | （三）一般事故上报至设区的市级人民政府安全生产监督管理部门和负有安全生产监督管理职责的有关部门。 |
While reporting an accident pursuant to the preceding paragraph, the work safety authority and relevant authorities responsible for work safety shall report it to the people's government at the same level. The work safety authority and relevant authorities responsible for work safety of the people's government of the State Council and the provincial people's government after receiving a report of an especially serious or serious accident shall immediately report it to the State Council. | |
安全生产监督管理部门和负有安全生产监督管理职责的有关部门依照前款规定上报事故情况，应当同时报告本级人民政府。国务院安全生产监督管理部门和负有安全生产监督管理职责的有关部门以及省级人民政府接到发生特别重大事故、重大事故的报告后，应当立即报告国务院。 |
When necessary, the work safety authority and relevant authorities responsible for work safety may report the accident by bypassing the immediate level or levels. | |
必要时，安全生产监督管理部门和负有安全生产监督管理职责的有关部门可以越级上报事故情况。 |

| Article 11 Where the work safety authority and relevant authorities responsible for work safety report an accident level by level, the time for reporting at each level shall not exceed 2 hours. | | 第十一条 安全生产监督管理部门和负有安全生产监督管理职责的有关部门逐级上报事故情况，每级上报的时间不得超过2小时。 |

| Article 12 An accident report shall include: | | 第十二条 报告事故应当包括下列内容： |

|
| (a) Introduction to the entity of occurrence of the accident; | | （一）事故发生单位概况； |
| |
|
| (b) Time and place of occurrence of the accident and information on the site of the accident; | | （二）事故发生的时间、地点以及事故现场情况； |
| |
|
| (c) Brief process of the accident; | | （三）事故的简要经过； |
| |
|
| (d) Number of casualties or likely casualties (including the missing persons) and initial estimate of direct economic losses as a result of the accident; | | （四）事故已经造成或者可能造成的伤亡人数（包括下落不明的人数）和初步估计的直接经济损失； |
| |
|
| (e) Measures already taken; and | | （五）已经采取的措施； |
| |
|
| (f) Other information that should be reported. | | （六）其他应当报告的情况。 |
| |

| Article 13 Any new situation arising after the reporting of an accident shall be reported timely in addition. | | 第十三条 事故报告后出现新情况的，应当及时补报。 |
Any change of the number of casualties as a result of an accident within 30 days as of the date of occurrence of the accident shall be reported timely in addition. Any change of the number of casualties as a result of a road traffic or fire accident within 7 days as of the date of occurrence of the accident shall be reported timely in addition. | |
自事故发生之日起30日内，事故造成的伤亡人数发生变化的，应当及时补报。道路交通事故、火灾事故自发生之日起7日内，事故造成的伤亡人数发生变化的，应当及时补报。 |

| Article 14 After receiving an accident report, the person in charge of the entity of occurrence of the accident shall immediately start up the relevant plan on the emergency response to accident, or take effective measures to organize rescue, avoid expansion of the accident and reduce the casualties as well as property damage. | | 第十四条 事故发生单位负责人接到事故报告后，应当立即启动事故相应应急预案，或者采取有效措施，组织抢救，防止事故扩大，减少人员伤亡和财产损失。 |

Article 15 After the relevant local people's government, work safety authority and relevant authorities responsible for work safety receive an accident report, the persons in charge of them shall reach the accident site immediately to organize accident rescue.
．．．．．． | | 第十五条 事故发生地有关地方人民政府、安全生产监督管理部门和负有安全生产监督管理职责的有关部门接到事故报告后，其负责人应当立即赶赴事故现场，组织事故救援。
