The Interim Provisions on the Administration of Online Tourism Business Services, as deliberated and adopted at the executive meeting of the Ministry of Culture and Tourism on July 20, 2020, are hereby issued, and shall come into force on October 1, 2020. 《在线旅游经营服务管理暂行规定》已经2020年7月20日文化和旅游部部务会议审议通过,现予发布,自2020年10月1日起施行。

Interim Provisions on the Administration of Online Tourism Business Services 在线旅游经营服务管理暂行规定
Chapter I General Provisions 

第一章 总 则

Article 1 For the purposes of protecting tourists' legitimate rights and interests, regulating the order of the online tourism market, and promoting the sustainable development of the online tourism industry, these Provisions are developed in accordance with the Tourism Law of the People's Republic of China, the Law of the People's Republic of China on the Protection of Consumer Rights and Interests, the Cybersecurity Law of the People's Republic of China, the E-Commerce Law of the People's Republic of China, the Regulation on Travel Agencies and other relevant laws and administrative regulations.   第一条 为保障旅游者合法权益,规范在线旅游市场秩序,促进在线旅游行业可持续发展,依据《中华人民共和国旅游法》、《中华人民共和国消费者权益保护法》、《中华人民共和国网络安全法》、《中华人民共和国电子商务法》、《旅行社条例》等相关法律、行政法规,制定本规定。
Article 2 These Provisions shall apply to the provision of online tourism business services within the territory of the People's Republic of China.   第二条 在中华人民共和国境内提供在线旅游经营服务,适用本规定。
For the purpose of these Provisions, “online tourism business services” means the business activities of providing package tour services or transportation, accommodation, catering, sightseeing, entertainment and other individual tourism services to tourists through information networks such as the Internet. 本规定所称在线旅游经营服务,是指通过互联网等信息网络为旅游者提供包价旅游服务或者交通、住宿、餐饮、游览、娱乐等单项旅游服务的经营活动。
Article 3 For the purpose of these Provisions, “online tourism operators” means the natural persons, legal persons and unincorporated organizations engaging in online tourism business services, including online tourism platform operators, on-platform operators, and operators that provide tourism services through self-built websites and other network services.   第三条 本规定所称在线旅游经营者,是指从事在线旅游经营服务的自然人、法人和非法人组织,包括在线旅游平台经营者、平台内经营者以及通过自建网站、其他网络服务提供旅游服务的经营者。
For the purpose of these Provisions, “platform operators” means the legal persons or unincorporated organizations that provide both parties or multiple parties in online tourism service transactions with online business premises, transaction matching, and information release and other services. 本规定所称平台经营者,是指为在线旅游经营服务交易双方或者多方提供网络经营场所、交易撮合、信息发布等服务的法人或者非法人组织。
For the purpose of these Provisions, “on-platform operators” means online tourism operators that provide tourism services through platform operators. 本规定所称平台内经营者,是指通过平台经营者提供旅游服务的在线旅游经营者。
Article 4 The online tourism operators that provide online tourism business services shall abide by the requirements of socialist core values, adhere to the bottom lines of personal and property safety, information content security, and cybersecurity, among others, conduct business operations in good faith, compete fairly, assume responsibility for product and service quality, and be subject to the supervision by the government and the public.   第四条 在线旅游经营者提供在线旅游经营服务,应当遵守社会主义核心价值观的要求,坚守人身财产安全、信息内容安全、网络安全等底线,诚信经营、公平竞争,承担产品和服务质量责任,接受政府和社会的监督。
Article 5 The Ministry of Culture and Tourism shall, according to its functions, be responsible for guiding, coordinating in and regulating the online tourism business services nationwide according to the law. The local departments of culture and tourism at or above the county level shall, according to the division of functions, be responsible for the supervision and administration of online tourism business services within their respective jurisdictions.   第五条 文化和旅游部按照职责依法负责全国在线旅游经营服务的指导、协调、监管工作。县级以上地方文化和旅游主管部门按照职责分工负责本辖区内在线旅游经营服务的监督管理工作。
Article 6 The departments of culture and tourism at all levels shall actively coordinate with relevant departments in supporting the development of the online tourism industry in terms of public finance, taxation, finance, and insurance, among others, to ensure online tourism operators' fair participation in market competition, maximize the proactive roles of online tourism operators in tourist destination promotion, construction of the tourism public service system, tourism big data application, reservation of scenic spot tickets and flow control, among others, and promote the high-quality development of the tourism industry.   第六条 各级文化和旅游主管部门应当积极协调相关部门在财政、税收、金融、保险等方面支持在线旅游行业发展,保障在线旅游经营者公平参与市场竞争,充分发挥在线旅游经营者在旅游目的地推广、旅游公共服务体系建设、旅游大数据应用、景区门票预约和流量控制等方面的积极作用,推动旅游业高质量发展。
Chapter II Operation 

第二章 运 营

Article 7 Online tourism operators shall establish the tourist safety protection system according to the law, develop contingency plans, conduct risk monitoring and safety assessments in consideration of safety risk alerts issued by relevant government departments and other information, screen and eliminate potential safety hazards in a timely manner, and effectively conduct tourism safety publicity and guidance, risk alert and prevention, emergency rescue and response and other work.   第七条 在线旅游经营者应当依法建立旅游者安全保护制度,制定应急预案,结合有关政府部门发布的安全风险提示等信息进行风险监测和安全评估,及时排查安全隐患,做好旅游安全宣传与引导、风险提示与防范、应急救助与处置等工作。
Article 8 Where an online tourism operator finds any information of which the release or transmission is prohibited by any law or administrative regulation, it shall immediately cease the transmission of such information, take deletion or any other handling measure to prevent the information from spreading, preserve relevant records, and report it to the competent department.   第八条 在线旅游经营者发现法律、行政法规禁止发布或者传输的信息,应当立即停止传输该信息,采取消除等处置措施防止信息扩散,保存有关记录并向主管部门报告。
Platform operators shall strengthen the examination of the content of information such as texts, pictures, and audio and video recordings uploaded to the platforms to ensure the security of platform information content. 平台经营者应当对上传至平台的文字、图片、音视频等信息内容加强审核,确保平台信息内容安全。
Article 9 Online tourism operators shall, in accordance with the Cybersecurity Law of the People's Republic of China and other relevant laws, implement the rules for graded protection of cybersecurity, implement cybersecurity management and technical measures, develop contingency plans for cybersecurity, and organize drills on a periodical basis, to ensure the normal provision of online tourism business services.   第九条 在线旅游经营者应当按照《中华人民共和国网络安全法》等相关法律规定,贯彻网络安全等级保护制度,落实网络安全管理和技术措施,制定网络安全应急预案,并定期组织开展演练,确保在线旅游经营服务正常开展。
Article 10 The online tourism operators that conduct travel agency business shall obtain business permits for travel agencies according to the law.   第十条 在线旅游经营者经营旅行社业务的,应当依法取得旅行社业务经营许可。
Article 11 Platform operators shall verify the authenticity of and register the identities, addresses, contact information, administrative licensing, quality standard grades and credit ratings of on-platform operators and other information, establish registration archives, and verify and update them on a regular basis.   第十一条 平台经营者应当对平台内经营者的身份、地址、联系方式、行政许可、质量标准等级、信用等级等信息进行真实性核验、登记,建立登记档案,并定期核验更新。
Platform operators shall supervise and urge the on-platform operators' verification of authenticity and registration of relevant information on their tour support service providers. 平台经营者应当督促平台内经营者对其旅游辅助服务者的相关信息进行真实性核验、登记。
Article 12 Online tourism operators shall provide authentic and accurate tourism service information, and shall not conduct false publicity; and those which have not obtained quality standard grades and credit ratings shall not use relevant titles and logos. Platform operators shall distinguish and mark proprietary business and business conducted by on-platform operators in conspicuous manners.   第十二条 在线旅游经营者应当提供真实、准确的旅游服务信息,不得进行虚假宣传;未取得质量标准、信用等级的,不得使用相关称谓和标识。平台经营者应当以显著方式区分标记自营业务和平台内经营者开展的业务。
Online tourism operators that provide tourists with reservation services for transportation, accommodation and sightseeing, among others, shall establish the open, transparent and searchable reservation channels to enable the performance of relevant reservation services based on contracts.
