| Chapter I General Rules | | 第一章 总则 |

| 1 The new Central People's Government formed at the 1st session of the 11th National People's Congress has formulated these Rules in accordance with the Constitution of the People's Republic of China and the Organic Law of the State Council of the People's Republic of China. | | 一、第十一届全国人民代表大会第一次会议产生的新一届中央人民政府，根据《中华人民共和国宪法》和《中华人民共和国国务院组织法》，制定本规则。 |

| 2 The working guidelines of the State Council are that the State Council shall, by taking Deng Xiaoping's Theory and the important thought of Three Represents as its guide, deeply implement the concept of scientific development, comply with the Party's line, principles and policies, exercise all of the functions of the government and make efforts to build a service-oriented government, accountable government, government ruled by law, and clean government. | | 二、国务院工作的指导思想是，高举中国特色社会主义伟大旗帜，以邓小平理论和“三个代表”重要思想为指导，深入贯彻落实科学发展观，执行党的路线方针政策，全面履行政府职能，努力建设服务政府、责任政府、法治政府和廉洁政府。 |

| 3 All work of the State Council shall follow the principles of adopting the manner of scientific and democratic decision-making, adhering to administration in pursuance of law, enhancing transparency of the government, improving the supervisory systems and intensifying the construction of a clean government. | | 三、国务院工作的准则是，实行科学民主决策，坚持依法行政，推进政务公开，健全监督制度，加强廉政建设。 |

| Chapter II Duties of Members | | 第二章 组成人员职责 |

| 4 The members of the State Council shall perform their duties and responsibilities granted by the Constitution and law, serve the people wholeheartedly, be duteous, practical, diligent and clean. | | 四、国务院组成人员要履行宪法和法律赋予的职责，执政为民，忠于职守，求真务实，勤勉廉洁。 |

| 5 The State Council adopts the premier responsibility system. The premier shall have leadership over the work of the State Council. The vice premiers and state councilors shall assist the premier in his work. | | 五、国务院实行总理负责制，总理领导国务院的工作。副总理、国务委员协助总理工作。 |
| |

| 6 The premier shall convene and preside over the plenary sessions of the State Council and the executive meetings of the State Council. The important matters in the work of the State Council shall be discussed and decided at a plenary session or executive meeting of the State Council. | | 六、总理召集和主持国务院全体会议和国务院常务会议。国务院工作中的重大事项，必须经国务院全体会议或国务院常务会议讨论决定。 |

| 7 The vice premiers and the state councilors shall be responsible for handling their respective work. Upon authorization of the premier, they may be responsible for the work in other aspects or special tasks, and may carry out activities of foreign affairs on behalf of the State Council as well. | | 七、副总理、国务委员按分工负责处理分管工作。受总理委托，负责其他方面的工作或专项任务，并可代表国务院进行外事活动。 |

| 8 Under the leadership of the premier, the secretary-general shall be responsible for handling the routine work of the State Council. | | 八、秘书长在总理领导下，负责处理国务院的日常工作。 |

| 9 During the period of the premier's visiting abroad, the vice premier who is responsible for the executive work shall perform the duties on behalf of the premier. | | 九、总理出国访问期间，由负责常务工作的副总理代行总理职务。 |

| 10 All ministries and commissions, the People's Bank of China and the National Audit Office shall adopt the minister, director, governor or auditor-general responsibility system and shall be under the leadership of their respective minister, director, governor or auditor-general. | | 十、各部、各委员会、人民银行、审计署实行部长、主任、行长、审计长负责制，由其领导本部门的工作。 |
All ministries and commissions, the People's Bank of China and the National Audit Office shall, under the laws, administrative regulations, decisions and orders of the State Council, formulate rules and regulations and issue orders within their respective functions. Under the leadership of the premier, the National Audit Office shall independently exercise the audit supervision power. It shall not be intervened by any other administrative organ, social group or individual. | |
各部、各委员会、人民银行、审计署根据法律和国务院的行政法规、决定、命令，在本部门的职权范围内，制定规章，发布命令。审计署在总理领导下，依照法律规定独立行使审计监督职能，不受其他行政机关、社会团体和个人的干涉。 |
All instrumentalities of the State Council shall exercise their respective functions, perform their respective duties, bear in mind the overall interests, be faithful and united, ensure consistency between policies and orders and earnestly implement the work arrangements made by the State Council. | |
国务院各部门要各司其职，各尽其责，顾全大局，精诚团结，维护政令统一，切实贯彻落实国务院各项工作部署。 |

| Chapter III Fully Exercising Government Functions | | 第三章 全面履行政府职能 |

| 11 The State Council shall fully exercise the functions such as economic coordination, market supervision and administration, social administration and public services. | | 十一、国务院要全面履行经济调节、市场监管、社会管理和公共服务职能。 |
| |
|
| 12 The State Council shall improve the macro-control system. It shall mainly employ economic and legal means and necessary administrative means to guide and control the economic operations and promote the rapid and sound development of the national economy. | | 十二、健全宏观调控体系，主要运用经济、法律手段和必要的行政手段引导和调控经济运行，促进国民经济又好又快发展。 |

| 13 The State Council shall strictly conduct market supervision, enhance the fairness of market access, improve the market supervision system, regulate the market law enforcement and form a unified, open, competitive and orderly modern market system. | | 十三、严格市场监管，推进公平准入，完善监管体系，规范市场执法，形成统一开放竞争有序的现代市场体系。 |

| 14 The State Council shall intensify the social administration, strengthen the government's functions in increasing employment and adjusting the income distribution, perfect the social security system, improve the grass-roots social administration system, properly settle social conflicts, maintain the fairness, justice and stability of the society, improve the mechanism for emergency administration. | | 十四、加强社会管理，强化政府促进就业和调节收入分配职能，完善社会保障体系，健全基层社会管理体制，妥善处理社会矛盾，维护社会公平正义和社会稳定，健全突发事件应急管理机制。 |

| 15 The State Council shall intensify the public services, improve public policies and the public service system, enhance the capability to provide basic public services, and promote equality of basic public services. | | 十五、强化公共服务，完善公共政策，健全公共服务体系，增强基本公共服务能力，促进基本公共服务均等化。 |

| Chapter IV Implementing a Scientific and Democratic Decision-making Mechanism | | 第四章 实行科学民主决策 |

| 16 The State Council and its instrumentalities shall improve the rules and procedures for making major policy decisions and perfect the decision-making mechanism, which integrates the participation of the general public and expertise consultation with the government's decision-making. | | 十六、国务院及各部门要健全重大事项决策的规则和程序，完善群众参与、专家咨询和政府决策相结合的决策机制。 |

| 17 The national economic and social development plans, national budgets, major policies and measures in respect of macro-control and reform and opening-up, important national and social management affairs, bills and administrative regulations shall be discussed and decided at the plenary sessions or executive meetings of the State Council. | | 十七、国民经济和社会发展计划及国家预算，宏观调控和改革开放的重大政策措施，国家和社会管理重要事务、法律议案和行政法规等，由国务院全体会议或国务院常务会议讨论和决定。 |

| 18 The proposals about significant policy decisions, which all instrumentalities of the State Council submit to the State Council for deliberation and decision, shall be based on deep investigation and research and shall be subject to the appraisal by experts or by research and consultation agencies about the necessity, feasibility and legitimacy of the said policy decisions. If a proposal involves any other department, full negotiation shall be made. If a proposal involves any local government, the opinions of the local government shall be consulted in advance. If a proposal involves significant public interests and the people's immediate interests, generally, the opinions of the public shall be solicited openly and a hearing may be held, where necessary. | | 十八、国务院各部门提请国务院研究决定的重大事项，都必须经过深入调查研究，并经专家或研究、咨询机构等进行必要性、可行性和合法性论证；涉及相关部门的，应当充分协商；涉及地方的，应当事先听取意见；涉及重大公共利益和人民群众切身利益的，要向社会公开征求意见，必要时应举行听证会。 |

| 19 Before the State Council makes an important decision, it shall, in light of the actual needs, directly hear the opinions and suggestions of the democratic parties, social groups, experts, scholars and grassroots people. | | 十九、国务院在做出重大决策前，根据需要通过多种形式，直接听取民主党派、社会团体、专家学者、基层群众等方面的意见和建议。 |
