The revised Anti-Unfair Competition Law has officially come into force on January 1, 2018. For the purposes of comprehensively implementing the spirit of the 19th CPC National Congress, further promoting the implementation of the Anti-Unfair Competition Law and creating a market environment for fair competition, the State Administration for Market Regulation has decided to conduct the key action of law enforcement in anti-unfair competition nationwide from May to October in 2018. The law enforcement action shall focus on the rectification of market confusion, commercial bribery, false publicity, Internet-related unfair competition and other prominent problems which attract high social concern and generate strong response mainly in such industries and fields as online trading, rural market, medicine and education, effectively maintain the fair competition market order and safeguard the lawful rights and interests of business operators and consumers. 新修订的《反不正当竞争法》已于2018年1月1日起正式实施。为全面贯彻党的十九大精神,进一步促进《反不正当竞争法》实施,营造公平竞争的市场环境,市场监管总局决定,自2018年5月至10月,在全国范围内开展反不正当竞争执法重点行动。此次执法行动,重点围绕网络交易、农村市场、医药、教育等行业和领域,集中整治社会关注度高、反映强烈的市场混淆、商业贿赂、虚假宣传以及涉网不正当竞争等突出问题,切实维护公平竞争市场秩序,维护经营者、消费者合法权益。
I. Focusing on the investigation and handling of unfair competition acts infringing upon intellectual property rights such as market confusion and infringement upon trade secrets, and strengthening property right protection   一、重点查处市场混淆、侵犯商业秘密等侵犯知识产权不正当竞争行为,加强产权保护
Legal basis: Articles 6, 9, 18 and 21 of the Anti-Unfair Competition Law and other provisions. 法律依据:《反不正当竞争法》第六条、第九条、第十八条、第二十一条等规定。
Key fields: strengthening the protection of leading enterprises in the industry, well-known trademarks, influential trade names, and trade secrets of technology-intensive enterprises, among others. Focusing on market confusion, false publicity and other acts in such areas as rural markets and fairs in urban-rural fringe areas, and centering on such commodities as daily necessities, department store supplies and alcoholic drinks. 重点领域:加强对行业龙头企业、驰名商标、有影响的字号、科技密集型企业商业秘密等的保护。聚焦农村市场、城乡结合部“大集”等地区的市场混淆、虚假宣传等行为,重点商品为日用品、百货用品、酒类商品等。
Key acts: using without permission a label identical with or similar to the name, packaging, or decoration, among others, of another person's commodity with certain influence; using without permission another person's enterprise name (including abbreviation, trade name, among others) with certain influence; and using another person's registered trademark in the enterprise name, which misleads the public and constitutes unfair competition.

 重点行为:擅自与使用他人有一定影响的商品名称、包装、装潢等相同或者近似标识的行为;擅自使用他人有一定影响的企业名称(包括简称、字号等)的行为;将他人注册商标作为企业名称中的字号使用,误导公众、构成不正当竞争的行为。
