| Article 1 For the purposes of regulating the determination of drug addiction, scientifically determining drug addicts, and providing detoxification measures and treatment for drug addicts according to the law, these Measures are developed in accordance with the Narcotics Control Law of the People's Republic of China and the Regulation on Drug Rehabilitation. | | 第一条 为规范吸毒成瘾认定工作，科学认定吸毒成瘾人员，依法对吸毒成瘾人员采取戒毒措施和提供戒毒治疗，根据《中华人民共和国禁毒法》、《戒毒条例》，制定本办法。 |
| Article 2 The term “drug addiction” as mentioned in these Measures means chronic recurrent encephalopathy caused by repeated use of drugs by drug users, showing behavior of compulsively seeking and using drugs regardless of adverse consequences and often accompanied by harm to personal health and social function in varying degrees. | | 第二条 本办法所称吸毒成瘾，是指吸毒人员因反复使用毒品而导致的慢性复发性脑病，表现为不顾不良后果、强迫性寻求及使用毒品的行为，常伴有不同程度的个人健康及社会功能损害。 |
| Article 3 The term “determination of drug addiction” as mentioned in these Measures means that a public security authority or a medical institution for drug rehabilitation as authorized by the public security authority determines whether a drug user is addicted or whether the addiction is serious by testing human biological samples or collecting evidence of drug use or according to the physiological, mental, and psychiatric symptoms and signs, among others, of the drug user. | | 第三条 本办法所称吸毒成瘾认定，是指公安机关或者其委托的戒毒医疗机构通过对吸毒人员进行人体生物样本检测、收集其吸毒证据或者根据生理、心理、精神的症状、体征等情况，判断其是否成瘾以及是否成瘾严重的工作。 |
| The term “medical institutions for drug rehabilitation” as mentioned in these Measures means specialized drug rehabilitation hospitals conforming to the provisions of the Interim Measures for the Administration of Drug Rehabilitation Medical Services and other medical institutions with departments of drug rehabilitation treatment. | | 本办法所称戒毒医疗机构，是指符合《戒毒医疗服务管理暂行办法》规定的专科戒毒医院和设有戒毒治疗科室的其他医疗机构。 |
| Article 4 Where a public security authority discovers a drug user in law enforcement, it shall determine whether the drug user is addicted; and if it is difficult to determine for technical reasons, the public security authority may authorize a qualified medical institution for drug rehabilitation to determine drug addiction. | | 第四条 公安机关在执法活动中发现吸毒人员，应当进行吸毒成瘾认定；因技术原因认定有困难的，可以委托有资质的戒毒医疗机构进行认定。 |
| Article 5 The medical institutions for drug rehabilitation assuming the work of drug addiction determination shall be designated by the administrative department of health and family planning at the provincial level jointly with the public security authority at the same level. | | 第五条 承担吸毒成瘾认定工作的戒毒医疗机构，由省级卫生计生行政部门会同同级公安机关指定。 |
| Article 6 The determination of drug addiction by a public security authority shall be conducted by two or more police officers, and determination opinions shall be produced within 24 hours after the human biological sample test conclusion is reached. Determination opinions shall be signed by the determining personnel and reviewed by the person in charge of the public security authority, to which the seal of the public security authority shall be affixed. | | 第六条 公安机关认定吸毒成瘾，应当由两名以上人民警察进行，并在作出人体生物样本检测结论的二十四小时内提出认定意见，由认定人员签名，经所在单位负责人审核，加盖所在单位印章。 |
| The relevant evidentiary materials shall be part of determination opinions. | | 有关证据材料，应当作为认定意见的组成部分。 |
| Article 7 Where a drug user falls under all of the following circumstances, he or she shall be determined by the public security authority to be addicted: | | 第七条 吸毒人员同时具备以下情形的，公安机关认定其吸毒成瘾： |
| (1) Any drug ingredient exists in his or her system as evidenced by a test of human biological samples such as blood, urine, and saliva. | | （一）经血液、尿液和唾液等人体生物样本检测证明其体内含有毒品成分； |
| (2) There is evidence that he or she has used drugs. | | （二）有证据证明其有使用毒品行为； |
(3) He or she has any withdrawal symptoms or there is evidence that he or she has a history of drug use, for example, he or she was once investigated and handled by the public security authority for drug use or once voluntarily received drug rehabilitation or any drug ingredient is detected in his or her hair samples.
