The Regulation on the Administration of State Compensation Expenses, which was adopted at the 138th executive meeting of the State Council on December 29, 2010, is hereby promulgated, and shall come into force on the date of promulgation. | |

| Article 1 To strengthen the administration of state compensation expenses, protect the rights of citizens, legal persons and other organizations to obtain state compensation, and urge state organs to perform their duties according to law, this Regulation is formulated pursuant to the State Compensation Law of the People's Republic of China (hereinafter referred to as “SCL”). | | 第一条 为了加强国家赔偿费用管理，保障公民、法人和其他组织享有依法取得国家赔偿的权利，促进国家机关依法行使职权，根据《中华人民共和国国家赔偿法》（以下简称国家赔偿法），制定本条例。 |

| Article 2 For the purpose of this Regulation, the term “state compensation expenses” means the money that should be paid to compensation claimants under the SCL. | | 第二条 本条例所称国家赔偿费用，是指依照国家赔偿法的规定，应当向赔偿请求人赔偿的费用。 |

| Article 3 State compensation expenses shall be paid by the people's governments at all levels under the financial control system. | | 第三条 国家赔偿费用由各级人民政府按照财政管理体制分级负担。 |
The people's governments at all levels shall, in light of the local circumstances, allocate a certain amount of state compensation expenses and include them in the annual fiscal budgets at the corresponding levels. If the amount of payable state compensation expenses for the year exceeds the amount determined in the annual fiscal budget of this level, the government concerned shall arrange funds without delay. | |
各级人民政府应当根据实际情况，安排一定数额的国家赔偿费用，列入本级年度财政预算。当年需要支付的国家赔偿费用超过本级年度财政预算安排的，应当按照规定及时安排资金。 |

| Article 4 State compensation expenses shall be managed by the public finance departments of the people's governments at all levels uniformly. | | 第四条 国家赔偿费用由各级人民政府财政部门统一管理。 |
The management of state compensation expenses shall be subject to supervision in accordance with the law. | |
国家赔偿费用的管理应当依法接受监督。 |

| Article 5 To apply for the payment of state compensation expenses, a claimant shall submit a written application to the organ liable for compensation, together with a written judgment, decision of reconsideration, decision of compensation or mediation that has come into force and the claimant's identity certificate. | | 第五条 赔偿请求人申请支付国家赔偿费用的，应当向赔偿义务机关提出书面申请，并提交与申请有关的生效判决书、复议决定书、赔偿决定书或者调解书以及赔偿请求人的身份证明。 |
Where it is difficult for a claimant to write an application, the application can be written by other people upon the claimant's authorization, or be made orally. In the case of the latter, the organ liable for compensation shall keep records, hand them over to the claimant for verification or read them out to the claimant and have them signed by the claimant for confirmation. | |
赔偿请求人书写申请书确有困难的，可以委托他人代书；也可以口头申请，由赔偿义务机关如实记录，交赔偿请求人核对或者向赔偿请求人宣读，并由赔偿请求人签字确认。 |

| Article 6 If the application materials are authentic, valid and complete, the application shall be deemed accepted once the organ liable for compensation receives the application materials. After accepting the application, the organ liable for compensation shall notify the claimant in writing. | | 第六条 申请材料真实、有效、完整的，赔偿义务机关收到申请材料即为受理。赔偿义务机关受理申请的，应当书面通知赔偿请求人。 |
If the application materials are incomplete, the organ liable for compensation shall, at that time or within three workdays, notify the claimant at one time of all materials that need to be supplemented or corrected. If the claimant supplements or corrects the application materials according to the requirements of the organ liable for compensation, the application shall be deemed accepted once the organ liable for compensation receives the supplemented or corrected materials. If the claimant is not notified to supplement or correct the application materials, the application shall be deemed accepted once the organ liable for compensation receives the application materials.

申请材料不完整的，赔偿义务机关应当当场或者在3个工作日内一次告知赔偿请求人需要补正的全部材料。赔偿请求人按照赔偿义务机关的要求提交补正材料的，赔偿义务机关收到补正材料即为受理。未告知需要补正材料的，赔偿义务机关收到申请材料即为受理。
