Article 1 In order to regulate the international bidding and bid evaluation of mechanical and electrical products, and to increase transparency and improve efficiency, the system of public summons for the results of international bidding and bid evaluation of mechanical and electrical products is adopted and these measures are formulated according to the Bidding Law of the People's Republic of China and Measures for the Implementation of Bidding of Mechanical and Electrical Products (Order No.7 of the Ministry of Foreign Trade and Economic Cooperation 2000, hereinafter referred to as Order No.7).   第一条 为规范机电产品国际招标评标工作,增加透明度,提高工作效率,根据《中华人民共和国招标投标法》和《机电产品招标投标实施办法》(外经贸部二000年七号令,以下简称“七号令”),实行机电产品国际招标评标结果公示制度,并制定本办法。

 
Article 2 After each bid evaluation ends, the international bid inviting agencies of mechanical and electrical products (hereinafter referred to as bid inviting agencies) or the buyer (in self bid inviting) must fill in and publish the Form of Public Summons for Bid Evaluation Results on the China International Bidding Net (http://www.chinabidding .com, hereinafter referred to as the website) to make public summons for the results of bid evaluation, and shall, within the duration of the public summons, send the bid evaluation report to the corresponding administrations of the import and export of mechanical and electrical products (hereinafter referred to as import-export administrations) for record.   第二条 每次评标结束后,机电产品国际招标代理机构(以下简称招标机构)或买方(自行招标)须在“中国国际招标网”(http://www.chinabidding.com/,以下简称网站)上填写并刊登《评标结果公示表》将评标结果进行公示,同时在公示期内将评标报告送至相应的机电产品进出口管理机构(以下简称进出口机构)备案。

 
Article 3 The contents to be filled in the Form of Public Summons for Bidding Evaluation Results include: “title of the recommended bid-winner (manufacturer)”, “evaluated price” and “reasons for bid losing”, etc, which shall be consistent with the bid evaluation report and in accordance with the bid evaluation rules provided by Order No.7.   第三条 《评标结果公示表》的各项填写内容,包括“建议中标商(制造商)名称”、“评标价格”和“不中标理由”等,必须与评标报告一致,并符合七号令规定的评标规则。

 
Article 4 The reasons for bid losing for each bid loser shall be written in 3 categories in such order as business evaluation, technology evaluation and price evaluation. The contents filled in must clearly indicate the requirements of the bid inviting documents, the responding status and the response contents of the bidders. If many reasons fall into any one category of the reasons for bid losing of a bidder, the bid inviting agencies may fill in only the chief reasons.
However, the public summons are one-time summons, any reason for bid losing that hasn't been summoned shall not be the basis for annulment of bidding or bid losing.
   第四条 对每一位不中标商的不中标理由按商务评议、技术评议和价格评议三类逐项填写。填写的内容必须明确说明招标文件的要求和投标商的响应情况和内容。如一个投标商的某一类不中标理由过多,招标机构可填写其中最主要的若干项理由。但公示为一次性公示,凡未公示的不中标理由不再作为废标或不中标的依据。

 
Article 5 Agencies that have registered at the website may look up the public summons according to the limits of authority. The relevant import-export administrations, government authorities and bidders of the same bidding item shall have the right to challenge or complain about the results of bid evaluation being summoned.

   第五条 在网站注册的机构按权限查看公示内容。同一招标项下的有关进出口机构、政府主管机构和投标商有权对正在公示的评标结果进行质疑或投诉。
