| For the purposes of protecting the lawful rights and interests of the copyright owners of photographic works, regulating the order of copyrights in photographic works, and promoting the extensive and orderly dissemination of photographic works, in accordance with the Copyright Law of the People's Republic of China, the Regulation on the Implementation of the Copyright Law of the People's Republic of China, the Regulation on the Protection of the Right of Dissemination on Information Networks and other relevant provisions, you are hereby notified of the relevant matters as follows: | | 为保护摄影作品著作权人合法权益，规范摄影作品版权秩序，推动摄影作品广泛有序传播，根据《中华人民共和国著作权法》、《中华人民共和国著作权法实施条例》、《信息网络传播权保护条例》等有关规定，现就有关问题通知如下。 |
| I. Photographic works are one type of the works protected by the Copyright Law, and shall be original and conform to the characteristics specified by subparagraph (10) of Article 4 of the Regulation for the Implementation of the Copyright Law. | | 一、摄影作品是著作权法保护的作品之一，应具有独创性，并符合著作权法实施条例第四条第（十）项的特征。 |
| Photographic works on the subject of news events, which do not fall within the scope of news on current affairs as prescribed by the Copyright Law, shall be protected by copyright laws and regulations. | | 以新闻事件为主题的摄影作品不属于著作权法规定的时事新闻，受著作权法律法规保护。 |
II. In using the photographic works of other persons, press entities, Internet content providers, Internet public accounts, image gallery operators, non-media organizations, and individuals shall strictly comply with copyright laws and regulations, and must be permitted by the copyright owners of the photographic works and pay them for the use, unless otherwise specified by laws and regulations or otherwise agreed upon by the parties.
