| All local offices of the China Banking and Insurance Regulatory Commission (“CBIRC”); all insurance companies; and the Insurance Association of China (“IAC”): | | 各银保监局，各保险公司，中国保险行业协会： |
| For purposes of strengthening the regulation of entrusted health security management services, promoting the sustained and sound development of such services, satisfying the multi-level, diversified and personalized health security needs of the people, and pushing forward the insurance industry in playing a more active role in the development of a multi-level medical security system, you are hereby notified of the relevant matters as follows: | | 为加强对健康保障委托管理业务的监管，促进业务持续健康发展，满足人民群众多层次多样化个性化的健康保障需求，推动保险业为完善多层次医疗保障体系发挥更积极作用，现将有关事项通知如下： |
| I. For the purpose of this Notice, “entrusted health security management services” means that insurance companies accept the entrustment of government departments, enterprises, public institutions, social organizations and other group clients to provide them with handling and management services such as health security scheme design, consulting and advisory, health management, medical service surveys, examination and payment of medical expenses, examination of diseases and payment of expenses, examination of loss of income due to disability and payment of expenses, examination of nursing and payment of expenses. | | 一、本通知所称健康保障委托管理业务，是指保险公司接受政府部门、企事业单位、社会团体等团体客户的委托，为其提供健康保障的方案设计和咨询建议、健康管理、医疗服务调查、医疗费用审核和支付、疾病审核和费用支付、失能收入损失审核和费用支付、护理审核和费用支付等经办管理服务。 |
| II. An insurance company intending to provide entrusted health security management services shall meet all conditions for health insurance operations set out in the Measures for the Administration of Health Insurance, and set up a branch or service provider at the place where it provides such services. | | 二、保险公司开展健康保障委托管理业务，应当符合《健康保险管理办法》有关经营健康保险的各项条件，并在开办地区设有分支机构或服务合作机构。 |
| III. An insurance company providing entrusted health security management services shall enter into an entrusted management contract with the client, stating the content of entrusted management, methods for the calculation and adjustment of management fees, the rights and obligations of both parties, the legal relationship between both parties, and other content. | | 三、保险公司开展健康保障委托管理业务，应当与委托人签订委托管理合同，列明委托管理内容、管理费计算和浮动办法、双方的权利和义务、双方的法律关系等内容。 |
| IV. An insurance company providing entrusted health security management services shall require the client to guarantee that the conduct of entrustment and the source of entrusted funds are lawful and conform to the provisions of the state on anti-money laundering, among others. | | 四、保险公司开展健康保障委托管理业务，应当要求委托人确保委托行为和委托资金来源合法，并符合国家反洗钱等相关规定。 |
| V. An insurance company providing entrusted health security management services shall require the client to provide the list of group members receiving such security services and their relevant identity information, and properly safeguard the security of such information. | | 五、保险公司开展健康保障委托管理业务，应当要求委托人提供接受保障的团体成员名单和相关身份信息，并妥善保护信息安全。 |
| VI. Where a branch office of an insurance company provides entrusted health security management services, the contracts signed by it shall be subject to the examination and approval of the provincial-level institution of the insurance company and be filed with the head office. | | 六、保险公司分支机构开展健康保障委托管理业务，签订的合同应当经保险公司省级机构审定，并在总公司备案。 |
| VII. Where an insurance company provides entrusted health security management services, its head office shall, on a periodical basis, check its conclusion and implementation of entrusted management contracts. | | 七、保险公司开展健康保障委托管理业务，应当由总公司对委托管理合同的签订和执行情况进行定期检查。 |
VIII. Where an insurance company provides entrusted health security management services and the client transfers entrusted funds to the insurance company for management, the insurance company shall set up a separate account to manage such funds, use such funds for designated purposes only, and the payment limit shall be the sum of entrusted funds and the interest income calculated at the benchmark interest rate of current deposits in RMB.
