The Provisions of the Supreme People's Court on Several Issues Concerning the Application of Law in the Trial of Cases about Tour Disputes, as adopted at the 1496th session of the Judicial Committee of the Supreme People's Court on September 13, 2010, are hereby issued, and shall come into force on November 1, 2010.
 
最高人民法院《关于审理旅游纠纷案件适用法律若干问题的规定》已于2010年9月13日由最高人民法院审判委员会第1496次会议通过,现予公布,自2010年11月1日起施行。

最高人民法院关于审理旅游纠纷案件适用法律若干问题的规定

(Interpretation No.13 [2010] of the Supreme People's Court)

In order to correctly try cases about tour disputes and protect the legitimate rights and interests of the parties concerned, these Provisions are formulated in accordance with the provisions of the General Principles of Civil Law of the People's Republic of China, the Contract Law of the People's Republic of China, the Law of the People's Republic of China on Protection of Consumer Rights and Interests, the Tort Law of the People's Republic of China, the Civil Procedure Law of the People's Republic of China and other relevant laws and in light of civil trial practices.

 
为正确审理旅游纠纷案件,依法保护当事人合法权益,根据《中华人民共和国民法通则》、《中华人民共和国合同法》、《中华人民共和国消费者权益保护法》、《中华人民共和国侵权责任法》和《中华人民共和国民事诉讼法》等有关法律规定,结合民事审判实践,制定本规定。

 
Article 1 A “tour dispute” as mentioned in these Provisions refers to a contractual dispute or a tort arising from a tour between a tourist and the tour operator or any tour assistant.   第一条 本规定所称的旅游纠纷,是指旅游者与旅游经营者、旅游辅助服务者之间因旅游发生的合同纠纷或者侵权纠纷。

A “tour operator” refers to anyone that operates the tour business in its own name and provides tour services for the public.
 
“旅游经营者”是指以自己的名义经营旅游业务,向公众提供旅游服务的人。

A “tour assistant” refers to anyone that has a contractual relationship with a tour operator to assist the tour operator in performing the obligations in the tour contract and actually provide such tour services as transportation, sightseeing, lodging, catering, entertainment, etc.
 
“旅游辅助服务者”是指与旅游经营者存在合同关系,协助旅游经营者履行旅游合同义务,实际提供交通、游览、住宿、餐饮、娱乐等旅游服务的人。

These Provisions shall apply analogically to a dispute arising from an independent tour between a tourist and the operator of a tourist attraction.
 
旅游者在自行旅游过程中与旅游景点经营者因旅游发生的纠纷,参照适用本规定。

 
Article 2 Where a tour contract is concluded with a tour operator in the form of a collective such as entity or family, and any dispute occurs during the performance of the tour contract, in addition to a lawsuit filed by the collective as a party to the contract, the people's court shall also accept a lawsuit filed personally by a tourist for any dispute over the tour contract.   第二条 以单位、家庭等集体形式与旅游经营者订立旅游合同,在履行过程中发生纠纷,除集体以合同一方当事人名义起诉外,旅游者个人提起旅游合同纠纷诉讼的,人民法院应予受理。

 
Article 3 Where a tour operator causes any personal injury or property loss to a tourist, and for the same reason, the tourist chooses to hold the tour operator liable for a breach of contract or liable for a tort, the people's court shall try the case according to the cause of action as chosen by the party concerned.   第三条 因旅游经营者方面的同一原因造成旅游者人身损害、财产损失,旅游者选择要求旅游经营者承担违约责任或者侵权责任的,人民法院应当根据当事人选择的案由进行审理。

 
Article 4 Where a tourist files a lawsuit only against a tour operator for the latter's breach of contract caused by a tour assistant, the people's court may add the tour assistant as a third party.   第四条 因旅游辅助服务者的原因导致旅游经营者违约,旅游者仅起诉旅游经营者的,人民法院可以将旅游辅助服务者追加为第三人。

 
Article 5 Where a tour operator has taken out liability insurance, and a tourist files a lawsuit only against the tour operator for an insurance accident, the people's court may list the insurance company as a third party at the request of the party concerned.   第五条 旅游经营者已投保责任险,旅游者因保险责任事故仅起诉旅游经营者的,人民法院可以应当事人的请求将保险公司列为第三人。

 
Article 6 Where, in a standard contract, notice, statement, bulletin, etc., a tour operator makes any unfair or unreasonable provisions on tourists, or reduces its liability or exempts itself from liability for any damage to the legitimate rights and interests of tourists, and a tourist claims that such provisions are void according to Article 24 of the Law on Protection of Consumer Rights and Interests, the people's court shall support such a claim.   第六条 旅游经营者以格式合同、通知、声明、告示等方式作出对旅游者不公平、不合理的规定,或者减轻、免除其损害旅游者合法权益的责任,旅游者请求依据消费者权益保护法二十四条的规定认定该内容无效的,人民法院应予支持。

 
Article 7 Where a tour operator or tour assistant fails to fulfill its obligation of safety protection, causing any personal injury or property loss to a tourist, and the tourist claims that the tour operator or tour assistant shall be liable for the injury or loss, the people's court shall support such a claim.

   第七条 旅游经营者、旅游辅助服务者未尽到安全保障义务,造成旅游者人身损害、财产损失,旅游者请求旅游经营者、旅游辅助服务者承担责任的,人民法院应予支持。
