为了依法行使起诉权，保证起诉案件的办案质量，根据《中华人民共和国刑法》、《中华人民共和国刑事诉讼法》和《人民检察院刑事诉讼规则》等有关规定，结合检察机关起诉工作实际，制定本标准。 |
For the purposes of exercising the prosecution power and ensuring the quality of handling prosecution cases, these Standards are formulated in accordance with the Criminal Law of the People's Republic of China, Criminal Procedural Law of the People's Republic of China and Criminal Litigation Rules for People's Procuratorates, and by taking into consideration the actual circumstances of the procuratorates. | |

| | 一、办理案件质量标准 |
| I Standards on the quality of handling cases | |
|
| | （一）指控的犯罪事实清楚 |
| 1. The charged criminal facts are clear. | |
|
| | 1、指控的被告人的身份，实施犯罪的时间、地点、手段、动机、目的、后果以及其他影响定罪量刑的事实、情节清楚； |
| (1)The identity of the defendant charged against, the time, place, way, motive, purpose, consequences and other facts and circumstances that may affect the conviction of crime and determination of the punishment to be imposed on the defendant are clear; | |

| | 2、无遗漏犯罪事实； |
| (2)No criminal fact is omitted; and | |
|
| | 3、无遗漏被告人。 |
| (3)No defendant is omitted. | |
|
| | （二）证据确实、充分 |
| 2. The evidence is certain and sufficient. | |
|
| | 1、证明案件事实和情节的证据合法有效； |
| (1)The proofs that support the facts and circumstances of the case are lawful and valid; | |
|
| | 2、证明犯罪构成要件的事实和证据确实、充分； |
| (2)The facts and proofs that support the essential elements of the crime are certain and sufficient; | |
|
| | 3、据以定罪的证据之间不存在矛盾或者矛盾能够合理排除； |
| (3)There is no paradox among the proofs on which the conviction of crime is based, or the paradox among such proofs can be eliminated reasonably; and | |
|
| | 4、根据证据得出的结论具有排他性。 |
| (4)The conclusion drawn from the proofs is exclusive. | |

| | （三）适用法律正确 |
| 3. The application of law is correct | |
|
| | 1、认定的犯罪性质和罪名准确； |
| (1)The nature and name of the ascertained crime are correct; | |
|
| | 2、认定的一罪或者数罪正确； |
| (2)The ascertained crime or plural crimes is or are correct; | |
|
| | 3、认定从重、从轻、减轻或者免除处罚的法定情节准确； |
| (3)The ascertained statutory circumstances, for which the punishment shall be heavier, lenient, mitigated or exempted, are correct; | |
|
| | 4、认定共同犯罪的各被告人在犯罪活动中的作用和责任恰当； |
| (4)The determination of the roles and liabilities of each defendant in a joint crime is appropriate; and | |
|
| | 5、引用法律条文准确、完整。 |
| (5)The cited legal clauses are correct and complete. | |

| | （四）诉讼程序合法 |
| 4. The litigation proceedings are lawful. | |
|
| | 1、本院有案件管辖权； |
| (1)The people's procuratorate has the jurisdiction over the case; | |
|
| | 2、符合回避条件的人员应当依法回避； |
| (2)Any person who meets the requirements for withdrawal shall withdraw in accordance with the law; | |
|
| | 3、强制措施适用恰当； |
| (3)The application of the mandatory measures is proper; | |
|
| | 4、依法讯问了犯罪嫌疑人，听取了被害人和犯罪嫌疑人、被害人委托的人的意见；
