The Measures for the Administration of Tibetan Buddhism Temples, which were adopted at the executive meeting of the State Administration for Religious Affairs on September 29, 2010, are hereby promulgated, and shall come into force on November 1, 2010.
 
《藏传佛教寺庙管理办法》已于2010年9月29日经国家宗教事务局局务会议通过,现予以发布,自2010年11月1日起施行。

Measures for the Administration of Tibetan Buddhism Temples
 
藏传佛教寺庙管理办法

 
Article 1 To guarantee citizens' freedom of religious belief and regulate the administration of Tibetan Buddhism temples, these Measures are formulated pursuant to the Regulation on Religious Affairs.   第一条 为保障公民的宗教信仰自由,规范藏传佛教寺庙管理,根据《宗教事务条例》,制定本办法。

 
Article 2 These Measures apply to sites for Tibetan Buddhism activities (hereinafter referred to as “temples”) established under the Regulation on Religious Affairs and the Measures for the Examination, Approval and Registration of Sites for Religious Activities.   第二条 本办法适用于 依照《宗教事务条例》和《宗教活动场所设立审批和登记办法》设立的藏传佛教活动场所(本办法称寺庙)。

 
Article 3 The legitimate rights and interests of temples and Tibetan Buddhist clergy (hereinafter referred to as “Buddhist clergy”) are under the protection of law.   第三条 寺庙、藏传佛教教职人员(以下简称教职人员)的合法权益受法律保护。

 
Article 4 Temples and Buddhist clergy shall abide by the Constitution, laws, regulations and rules, maintain national unity, ethnic solidarity and social stability, and enhance harmony between the Tibetan Buddhism and the socialist society.   第四条 寺庙、教职人员应当遵守宪法、法律、法规、规章,维护国家统一、民族团结和社会稳定,促进藏传佛教与社会主义社会相适应。

 
Article 5 Temples may not restore any religious feudal privilege or any oppressing or exploiting system that has been abated, or restore any subordinate relationship among temples.   第五条 寺庙不得恢复已被废除的宗教封建特权和压迫剥削制度,不得恢复寺庙之间的隶属关系。

 
Article 6 The Tibetan Buddhism and other religions as well as different rites or temples under the Tibetan Buddhism shall respect each other and live in amity.   第六条 藏传佛教与其他宗教之间、藏传佛教内部不同教派寺庙之间应当互相尊重、和睦相处。

 
Article 7 No organization or individual may use the Tibetan Buddhism to disrupt the social order, injure the health of citizens, impede the educational system of the state, or hold any other activity damaging the national interests, the public interests or the legitimate rights and interests of citizens.   第七条 任何组织和个人不得利用藏传佛教进行破坏社会秩序、损害公民身体健康、妨碍国家教育制度,以及其他损害国家利益、社会公共利益和公民合法权益的活动。

No overseas organization or individual may interfere with or predominate the temple affairs.
 
寺庙事务不受境外任何组织和个人的干涉和支配。

 
Article 8 A temple shall set up a democratic management organization upon negotiations. The members of such a management organization are usually Buddhist clergy of the temple, and the representatives of the local believer citizens and the local villagers' committee (neighborhood committee) may be among them.   第八条 寺庙应当通过协商成立民主管理组织。管理组织的成员一般由本寺庙的教职人员组成,也可以吸收所在地信教公民代表和当地村委会(居委会)代表参加。

Members of the management organization of a temple are subject to a fixed-term appointment system. The term of office is 3 to 5 years. Members can continue to hold office upon reelection.
 
寺庙管理组织成员实行任期制,每届任期3至5年,可连选连任。

 
Article 9 After the members of the management organization of a temple are determined, the organization shall report them to the religious affairs department of the local people's government at or above the county level for archival purposes. When examining the materials filed by the management organization, the religious affairs department shall solicit the opinion of the township people's government (or sub-district office) at the place where the temple is located.   第九条 寺庙管理组织成员人选确定后,由寺庙管理组织报所在地县级以上人民政府宗教事务部门备案。县级以上人民政府宗教事务部门在审核备案材料时,应当征求寺庙所在地乡镇人民政府(街道办事处)意见。

Any change in the position of a member of the temple management organization during the term of office shall be filed for archival purposes according to the procedure in the preceding paragraph without delay.
 
寺庙管理组织成员在任期内如有变更,按前款规定的程序及时进行变更备案。

 
Article 10 Members of the management organization of a temple shall meet the following requirements:   第十条 寺庙管理组织成员应具备以下条件:

 
1. Advocating the Constitution, abiding by the state laws, regulations and rules, supporting national unity, opposing ethnic secession, and maintaining religious and social harmony; (一)拥护宪法,遵守国家法律、法规、规章,拥护祖国统一、反对民族分裂,维护宗教和睦与社会和谐;

 
2. Having a good moral character and having a certain prestige among believer citizens; and (二)品德良好,在信教公民中有一定威望;

 
3. Having a comparatively strong ability for organization, coordination and management and serving believer citizens warm–heartedly. (三)有较强的组织协调和管理能力,能热心为信教公民服务。

 
Article 11 The management organization of a temple shall perform the following duties:   第十一条 寺庙管理组织履行以下职责:

 
1. Making the management rules for the temple and organizing the implementation thereof; (一)制定并组织实施本寺庙的管理制度;

 
2. Organizing the religious activities of the temple and maintaining the normal order of religious activities; (二)组织本寺庙教务活动,维护宗教活动正常秩序;

 
3. Managing the Buddhist clergy and other staff members of the temple, organizing the study of the relevant laws, regulations, rules and ethnic and religious policies of the state, strengthening publicity and education about ethnic solidarity, and providing education and training to Buddhist clergy; (三)管理本寺庙教职人员和其他工作人员,组织学习国家有关的法律、法规、规章以及国家的民族、宗教政策,加强民族团结宣传教育,组织开展对教职人员的教育培训;

 
4. Educating and leading believer citizens to abide by the relevant laws, regulations and rules of the state; (四)教育引导信教公民遵守国家有关的法律、法规、规章;

 
5. Managing the property and cultural relics of the temple; (五)管理本寺庙财产和文物;

 
6. Developing the temple's self-support business and the public welfare undertakings; (六)组织开展寺庙自养产业和社会公益慈善事业;

 
7. Maintaining the security order, fire safety and environmental sanitation of the temple; (七)维护本寺庙治安秩序、消防安全和环境卫生;

 
8. Coordinating the temple's relationships with other circles and maintaining the legitimate rights and interests of the temple and Buddhist clergy; and (八)协调本寺庙与社会其他方面的关系,维护本寺庙和教职人员的合法权益;

 
9. Handling other affairs for the temple. (九)处理本寺庙的其他事务。

The management organization of a temple may set up subordinate bodies to perform the above-mentioned duties.
 
寺庙管理组织可以下设相关机构负责履行上述职能。

 
Article 12 The management organization of a temple shall manage the temple affairs by democratic means. Significant matters shall be decided through collective discussion and democratic negotiations by the members of the temple management organization.   第十二条 寺庙事务由寺庙管理组织民主管理。重大事项由寺庙管理组织成员集体讨论、民主协商确定。

 
Article 13 A temple shall set up a performance evaluation system for members of its management organization and make adjustments to the incompetent ones.   第十三条 寺庙应当建立寺庙管理组织成员考核制度,对不称职的成员应当及时进行调整。

 
Article 14 A temple shall strengthen internal management and, pursuant to the relevant laws, regulations and rules as well as the Tibetan Buddhism dharma, establish management rules for religious activities, personnel, financial affairs, accounting affairs, public security, fire control, cultural relics, environmental protection, hygiene, disease control, etc.   第十四条 寺庙应当加强内部管理,依照有关法律、法规、规章及藏传佛教教义教规,建立健全教务活动、人员、财务、会计、治安、消防、文物、环境保护、卫生防疫等管理制度。

 
Article 15 A temple shall determine its personnel quota on the basis of its accommodation capacity, self-support capability and self-management ability as well as the support ability of the local believer citizens.   第十五条 寺庙根据容纳能力、自养能力、自我管理能力、当地信教公民的供养能力确定定员数额。

 
Article 16 The personnel quota of a temple shall be applied for by the management organization of the temple to the local Buddhist association with explanatory materials on the temple's possession of abilities mentioned in Article 15 of these Measures. The local Buddhist association shall, upon examination and approval, submit them to the religious affairs department of the local people's government at the county level which shall then submit them to the religious affairs department of the people's government at the provincial level for archival purposes level by level.

   第十六条 寺庙定员数额由该寺庙管理组织向所在地佛教协会提出申请,并提交该寺庙具备本办法第十五条规定的相应能力的说明材料。所在地佛教协会审核同意后,报所在地县级人民政府宗教事务部门,由县级人民政府宗教事务部门逐级报省级人民政府宗教事务部门备案。
