| Chapter I General Provisions | | 第一章 总则 |
| Article 1 To fulfill international obligations, maintain peace and stability in Africa, and halt the illegal trade on conflict diamonds, this Regulation is developed in accordance with the relevant provisions set forth in China's laws and regulations, the United Nations General Assembly Resolution 55/56, and the requirements of the Kimberley Process Certification System (“KPCS”). | | 第一条 为履行国际义务，维护非洲地区的和平与稳定，制止冲突钻石非法交易，根据我国有关法律法规规定和联合国大会第55/56号决议以及金伯利进程国际证书制度的要求，制定本规定。 |
| Article 2 For the purpose of this Regulation, “rough diamonds” mean unprocessed, simply cut or partially polished diamonds that are included in sections 7102.10, 7102.21 and 7102.31 of the Harmonized System of Coding and Description of Goods. | | 第二条 本规定所称的毛坯钻石是指未经加工或者经简单切割或者部分抛光，归入《商品名称及编码协调制度》7102.10、7102.21和7102.31的钻石。 |
| Article 3 The General Administration of Quality Supervision, Inspection and Quarantine of the People's Republic of China (“AQSIQ”) is the regulatory authority for implementing the KPCS. The entry-exit inspection and quarantine bodies designated by the AQSIQ (hereinafter referred to as the “inspection and quarantine bodies”) are responsible for examining the countries (places) of origin or countries (places) of source of imported and exported rough diamonds, and verifying, inspecting and issuing certificates to rough diamonds. | | 第三条 中华人民共和国国家质量监督检验检疫总局（以下简称国家质检总局）是我国实施金伯利进程国际证书制度的管理部门。国家质检总局指定的出入境检验检疫机构（以下简称检验检疫机构）负责对进出口毛坯钻石的原产国（地）或者来源国（地）进行核查，并对毛坯钻石进行验证、检验、签证。 |
| Article 4 The Kimberley Process Certificate is a legally binding official certificate. | | 第四条 金伯利进程国际证书是具有法律约束力的官方证明文件。 |
| Article 5 This Regulation applies to the trade of rough diamond imports and exports between the KPCS member countries (hereinafter referred to as the “member countries”). The inspection and quarantine bodies only accept the declaration of rough diamond imports and exports between the member countries. | | 第五条 本规定适用于金伯利进程国际证书制度成员国（以下简称成员国）之间的毛坯钻石进出口贸易。检验检疫机构只受理成员国之间的毛坯钻石进出口的申报。 |
| Article 6 Acceptance of declaration, verification and inspection, and issuance of the Customs Clearance of Entry/Exit Commodities for the import and export of rough diamonds under the general trade programs shall be handled by the administrative office set up by the AQSIQ at the Shanghai Diamond Exchange. Diamond's value verification work of the KPCS shall be conducted by the Shanghai Diamond Research and Appraisal Center in the Shanghai Diamond Exchange under the approval of the AQSIQ. | | 第六条 一般贸易项下进出口毛坯钻石的受理申报、核查检验和签发《出/入境货物通关单》，由国家质检总局设在上海钻石交易所内的办事机构办理。金伯利进程国际证书制度中的有关价值核定工作由国家质检总局许可上海钻石研究鉴定中心在上海钻石交易所内承担。 |
| Acceptance of declaration, verification and inspection, and issuance of the Customs Clearance of Entry/Exit Commodities for the entry and exit of rough diamonds under the processing trade programs shall be handled by the inspection and quarantine bodies designated by the AQSIQ. | | 加工贸易项下进出境毛坯钻石的受理申报、核查检验和签发《出/入境货物通关单》，由国家质检总局指定的检验检疫机构办理。 |
| Acceptance of declaration, verification and inspection, and issuance of the Customs Clearance of Entry/Exit Commodities for rough diamonds that enter bonded zones, bonded warehouses and export processing zones or that leave China from bonded zones, bonded warehouses, export processing zones and warehouses under export surveillance shall be handled by the inspection and quarantine bodies designated by the AQSIQ. | | 从境外进入保税区、保税仓库和出口加工区以及从保税区、保税仓库、出口加工区和出口监管仓库出境的毛坯钻石的受理申报、核查检验和签发《出/入境货物通关单》，由国家质检总局指定的检验检疫机构办理。 |
| Chapter II Imports Verification and Inspection | | 第二章 进口核查检验 |
| Article 7 Before rough diamonds enter China, the importer/exporter of rough diamonds or its agent and carrier (hereinafter referred to as the “declarer”) shall submit to the inspection and quarantine body the Declaration Form for Importing Rough Diamonds into the People's Republic of China (Annex 3), the original of Kimberley Process Certificate issued by the regulatory department of the exporting country's government of rough diamonds, and other relevant materials, and go through the declaration formalities for goods entering China. For those without the foregoing forms and certificates, no declaration shall be accepted. | | 第七条 毛坯钻石入境前，毛坯钻石的进出口企业或者其代理人以及承运人（以下简称申报人）应当向检验检疫机构提交《中华人民共和国进口毛坯钻石申报单》（附件3）、毛坯钻石出口国政府主管机构签发的金伯利进程国际证书正本等有关资料，办理入境申报手续。未提供上述单证的，不予受理申报。 |
| Article 8 After accepting the declaration, the inspection and quarantine body shall strictly examine the Kimberley Process Certificate submitted, and, if necessary, a verification between member countries may be conducted. Furthermore, the inspection and quarantine body shall, according to the requirements of the KPCS, review whether the declared contents comply with the Kimberley Process Certificate issued by the regulatory department of the exporting country's government. | | 第八条 检验检疫机构受理申报后，应当严格审查所提交的金伯利进程国际证书，必要时可以进行成员国间核对，并按照金伯利进程国际证书制度的要求，审核申报内容是否与出口国政府主管机构签发的金伯利进程国际证书相符。 |
| Article 9The inspection and quarantine body shall, with the presence of the declarer at a designated location, verify the mark of origin, seal and interior/exterior packing of goods; examine whether the country (place) of origin/ country (place) of source, the recipient, certificate number and other information comply with the contents set forth in the Kimberley Process Certificate; ratify the declared amount; and inspect the carat weight (quantity) of rough diamonds according to the requirements of the KPCS. | | 第九条 检验检疫机构应当在指定地点及申报人在场的情况下，核查货物原产地标记、封识及内外包装；检查原产国（地）/来源国（地）、受货人、证书编号等是否与随附的金伯利进程国际证书所列内容一致；对申报金额进行核定；对毛坯钻石的克拉重量（数量）等按照金伯利进程国际证书制度的要求实施检验。 |
| After the examination and inspection, those that meet the requirements shall be issued the Customs Clearance of Entry Commodities, based on which the customs shall release the goods. | | 经查验，对符合要求的，签发《入境货物通关单》，海关凭《入境货物通关单》验放。 |
| Article 10 After the completion of verification and inspection, the inspection and quarantine body shall issue the Conformation Letter for the Import of Rough Diamonds to the regulatory department of the government of the country (place) of origin/ country (place) of source, and send an email to confirm the diamonds have arrived at the destination. | | 第十条 核查、检验结束后，检验检疫机构应当签发进口毛坯钻石确认书，发送至货物原产国（地）/来源国（地）政府主管机构，同时以电子邮件方式确认该批钻石已到达目的地。 |
| Article 11 The inspection and quarantine body shall put on record the Declaration Form for Importing Rough Diamonds into the People's Republic of China, the original Kimberley Process Certificate issued by the regulatory department of the exporting country's government, and a photocopy of the Conformation Letter for the Import of Rough Diamonds. The record shall be preserved for three years. | | 第十一条 检验检疫机构应当将《中华人民共和国进口毛坯钻石申报单》、毛坯钻石出口国政府主管机构签发的金伯利进程国际证书正本和进口毛坯钻石确认书副本等有关资料一并归档。档案保存期为3年。 |
| Chapter III Exports Verification and Inspection | | 第三章 出口核查检验 |
Article 12 Before rough diamonds leave China, the declarer shall submit the inspection and quarantine body the Declaration Form for Exporting Rough Diamonds from the People's Republic of China (Annex 4), indicating that the declared rough diamonds for exports are non-conflict diamonds and the destination country is a KPCS member country and guaranteeing that the rough diamonds for exports are stored in anti-damage containers. In the meanwhile, the declarer shall provide contracts, receipts, value certification documents and other materials that can prove the rough diamonds' legality.
