| Article 1 To further strengthen and regulate legal supervision over commutation and parole, and ensure legality and justice in the execution of modified sentences, these Provisions are hereby formulated in accordance with the Criminal Law of the People's Republic of China, the Criminal Procedure Law of the People's Republic of China, the Prison Law of the People's Republic of China and other relevant provisions, and in light of the reality of procuratorial work. | | 第一条 为了进一步加强和规范减刑、假释法律监督工作，确保刑罚变更执行合法、公正，根据《中华人民共和国刑法》、《中华人民共和国刑事诉讼法》和《中华人民共和国监狱法》等有关规定，结合检察工作实际，制定本规定。 |
| Article 2 A people's procuratorate shall exercise legal supervision over the legality of proposal, trial, ruling or any other activity in a commutation or parole case in accordance with the law. | | 第二条 人民检察院依法对减刑、假释案件的提请、审理、裁定等活动是否合法实行法律监督。 |
| Article 3 A people's procuratorate shall handle commutation and parole cases separately in accordance with the following circumstances: | | 第三条 人民检察院办理减刑、假释案件，应当按照下列情形分别处理： |
| (1) The people's procuratorate assuming procuratorial duties over the execution authority shall supervise the proposal-related activities in a commutation or parole case. | | （一）对减刑、假释案件提请活动的监督，由对执行机关承担检察职责的人民检察院负责； |
| (2) The people's procuratorate at the same level of the people's court shall supervise the trial and ruling-related activities in a commutation or parole case. Where procuratorial duties over the execution authority do not fall on the people's procuratorate at the same level, a people's procuratorate may be designated to assume procuratorial duties over the execution authority as needed and send personnel to attend court sessions. Where the people's procuratorate at a lower level discovers that a commutation or parole ruling is inappropriate, it shall file a report with the people's procuratorate at the same level as the people's court issuing the commutation or parole ruling in a timely manner. | | （二）对减刑、假释案件审理、裁定活动的监督，由人民法院的同级人民检察院负责；同级人民检察院对执行机关不承担检察职责的，可以根据需要指定对执行机关承担检察职责的人民检察院派员出席法庭；下级人民检察院发现减刑、假释裁定不当的，应当及时向作出减刑、假释裁定的人民法院的同级人民检察院报告。 |
| Article 4 In handling commutation and parole cases, the people's procuratorate shall, in accordance with the relevant provisions, manage cases in a uniform manner and apply an accountability system for case handling. | | 第四条 人民检察院办理减刑、假释案件，依照规定实行统一案件管理和办案责任制。 |
| Article 5 When the people's procuratorate receives the following materials on a commutation or parole case transferred by an execution authority, it shall review such materials in a timely manner. | | 第五条 人民检察院收到执行机关移送的下列减刑、假释案件材料后，应当及时进行审查： |
| (1) The opinion of the execution authority on commutation or parole to be proposed. | | （一）执行机关拟提请减刑、假释意见； |
| (2) The written judgment of the court of final appeal, execution notice, and previous commutation rulings. | | （二）终审法院裁判文书、执行通知书、历次减刑裁定书； |
| (3) Certification materials showing the offender's true remorse, meritorious service or major meritorious service. | | （三）罪犯确有悔改表现、立功表现或者重大立功表现的证明材料； |
| (4) The offender's assessment form for review and examination and approval form for rewards and punishments. | | （四）罪犯评审鉴定表、奖惩审批表； |
| (5) Other case materials which should be reviewed. | | （五）其他应当审查的案件材料。 |
| In a case where parole is going to be proposed, the investigation and evaluation report of the community corrections institution or grassroots organization regarding the impact on the community where the offender lives in upon parole shall also be reviewed. | | 对拟提请假释案件，还应当审查社区矫正机构或者基层组织关于罪犯假释后对所居住社区影响的调查评估报告。 |
Article 6 Under any of the following circumstances, the people's procuratorate shall investigate and verify the relevant information.
