| Article 1 These Provisions are developed in accordance with the relevant provisions of the state for purposes of regulating the practicing activities of taxi drivers and enhancing the level of taxi services to passengers. | | 第一条 为了规范出租汽车驾驶员从业行为，提升出租汽车客运服务水平，根据国家有关规定，制定本规定。 |

| Article 6 The Ministry of Transport shall be responsible for guiding the administration of qualifications of taxi drivers nationwide. | | 第六条 交通运输部负责指导全国出租汽车驾驶员从业资格管理工作。 |
| The transport administrative departments of the people's governments of all provinces and autonomous regions shall, under the leadership of the people's governments at the same level, be responsible for guiding the administration of qualifications of taxi drivers within their respective administrative regions. | | 各省、自治区人民政府交通运输主管部门在本级人民政府领导下，负责指导本行政区域内出租汽车驾驶员从业资格管理工作。 |
| The transport administrative departments at the level of a municipality directly under the Central Government or a districted city or the county level or other taxi administrative departments designated by the people's governments (hereinafter referred to as “taxi administrative departments”) shall, under the leadership of the people's governments at the same levels, be responsible for specifically conducting the administration of qualifications of taxi drivers. | | 直辖市、设区的市级或者县级交通运输主管部门或者人民政府指定的其他出租汽车行政主管部门（以下称出租汽车行政主管部门）在本级人民政府领导下，负责具体实施出租汽车驾驶员从业资格管理。 |

| The examination on national public subjects is a test of knowledge with general standards and requirements, such as laws and regulations of the state on taxis, professional ethics, service standards, and safe operation. | | 全国公共科目考试是对国家出租汽车法律法规、职业道德、服务规范、安全运营等具有普遍规范要求的知识测试。 |
| The cruising taxi driver qualification examination on regional subjects is a test of knowledge with the characteristics of regional services, such as local policies and regulations on taxis, human geography within the business areas, and traffic routes. | | 巡游出租汽车驾驶员从业资格区域科目考试是对地方出租汽车政策法规、经营区域人文地理和交通路线等具有区域服务特征的知识测试。 |
| The online-booking taxi driver qualification examination on regional subjects is a test of knowledge with regional standards and requirements, such as local policies and regulations on taxis. The taxi administrative departments at the level of the local people's governments at or above the level of a districted city may independently determine other examination contents according to the characteristics of regional services. | | 网络预约出租汽车驾驶员从业资格区域科目考试是对地方出租汽车政策法规等具有区域规范要求的知识测试。设区的市级以上地方人民政府出租汽车行政主管部门可以根据区域服务特征自行确定其他考试内容。 |
| Article 8 A national uniform examination outline shall apply to the examination on national public subjects. The Ministry of Transport shall be responsible for preparing the national uniform examination outline and the examination question database. | | 第八条 全国公共科目考试实行全国统一考试大纲。全国公共科目考试大纲、考试题库由交通运输部负责编制。 |
| The taxi administrative departments of the local people's governments at or above the level of a districted city shall be responsible for preparing their respective regional examination outlines and examination question databases. | | 区域科目考试大纲和考试题库由设区的市级以上地方人民政府出租汽车行政主管部门负责编制。 |
| The taxi driver qualification examination shall be organized and conducted by the taxi administrative departments of the local people's governments at or above the level of a districted city in accordance with the examination rules and procedures prepared by the Ministry of Transport. The information technology and means are encouraged to be promoted and used to organize and conduct the taxi driver qualification examination. | | 出租汽车驾驶员从业资格考试由设区的市级以上地方人民政府出租汽车行政主管部门按照交通运输部编制的考试工作规范和程序组织实施。鼓励推广使用信息化方式和手段组织实施出租汽车驾驶员从业资格考试。 |
| Article 9 Whoever intends to provide taxi services to passengers shall fill out the Application Form for the Qualification Certificate of a Taxi Driver (see Annex 1 for the format thereof) and apply to the local taxi administrative department at the level of a districted city for taking the taxi driver qualification examination. | | 第九条 拟从事出租汽车客运服务的，应当填写《出租汽车驾驶员从业资格证申请表》（式样见附件1），向所在地设区的市级出租汽车行政主管部门申请参加出租汽车驾驶员从业资格考试。 |
| Article 10 Whoever applies for taking the taxi driver qualification examination shall meet the following conditions: | | 第十条 申请参加出租汽车驾驶员从业资格考试的，应当符合下列条件： |
| (1) He or she has obtained the driver's license for the corresponding vehicle type authorized to be driven and has driving experience of more than three years. | | （一）取得相应准驾车型机动车驾驶证并具有3年以上驾驶经历； |
| (2) He or she has no criminal record of traffic accident or dangerous driving, no record of drug-taking, no record of driving under the influence of alcohol, and no record of 12 points for the latest three consecutive scoring cycles. | | （二）无交通肇事犯罪、危险驾驶犯罪记录，无吸毒记录，无饮酒后驾驶记录，最近连续3个记分周期内没有记满12分记录； |
| (3) He or she has no record of violent crime. | | （三）无暴力犯罪记录； |
| (4) He or she meets other conditions as prescribed by the people's government of the city. | | （四）城市人民政府规定的其他条件。 |
| Article 11 Whoever applies for taking the taxi driver qualification examination shall provide the certifications or commitment materials conforming to the provisions of Article 10 hereof: | | 第十一条 申请参加出租汽车驾驶员从业资格考试的，应当提供符合第十条规定的证明或者承诺材料： |
| (1) A motor vehicle driving license and a photocopy thereof. | | （一）机动车驾驶证及复印件； |
| (2) The materials that he or she has no criminal record of traffic accident or dangerous driving, no record of drug-taking, no record of driving under the influence of alcohol, and no record of 12 points for the latest three consecutive scoring cycles. | | （二）无交通肇事犯罪、危险驾驶犯罪记录，无吸毒记录，无饮酒后驾驶记录，最近连续3个记分周期内没有记满12分记录的材料； |
| (3) The materials that he or she has no record of violent crime. | | （三）无暴力犯罪记录的材料； |
| (4) His or her identity certificate and a photocopy thereof. | | （四）身份证明及复印件； |
| (5) Other materials prescribed by the people's government of the city. | | （五）城市人民政府规定的其他材料。 |
| Article 12 The taxi administrative departments at the level of a districted city shall arrange the applicants who meet the application conditions to take the examination in a timely manner in accordance with the rules for the taxi driver qualification examination. | | 第十二条 设区的市级出租汽车行政主管部门对符合申请条件的申请人，应当按照出租汽车驾驶员从业资格考试工作规范及时安排考试。 |
| An applicant who takes the taxi driver qualification examination for the first time shall complete the examination on national public subjects and the examination on regional subjects within the area where he or she applies for taking examination for the first time. | | 首次参加出租汽车驾驶员从业资格考试的申请人，全国公共科目和区域科目考试应当在首次申请考试的区域完成。 |
| Article 13 The taxi administrative departments at the level of a districted city shall, within ten days after the examination is concluded, release the examination results. The scores passing the examination shall be valid for three years. | | 第十三条 设区的市级出租汽车行政主管部门应当在考试结束10日内公布考试成绩。考试合格成绩有效期为3年。 |
| The examination results of national public subjects shall be valid nationwide, and the examination results of regional subjects shall be valid within the local administrative areas. | | 全国公共科目考试成绩在全国范围内有效，区域科目考试成绩在所在地行政区域内有效。 |
| Article 14 For the drivers who have passed the examination on national public subjects and the examination on regional subjects of the taxi driver qualification examination, the taxi administrative departments at the level of a districted city shall, within ten days from the date of publication of the examination results, issue the Cruising Taxi Driver's License to cruising taxi drivers, and issue the Online-booking Taxi Driver's License to online-booking taxi drivers. (The Cruising Taxi Driver's License and the Online-booking Taxi Driver's License are hereinafter collectively referred to as “qualification certificates”). | | 第十四条 出租汽车驾驶员从业资格考试全国公共科目和区域科目考试均合格的，设区的市级出租汽车行政主管部门应当自公布考试成绩之日起10日内向巡游出租汽车驾驶员核发《巡游出租汽车驾驶员证》、向网络预约出租汽车驾驶员核发《网络预约出租汽车驾驶员证》（《巡游出租汽车驾驶员证》和《网络预约出租汽车驾驶员证》以下统称从业资格证）。 |
| The format of the Qualification Certificate of the People's Republic of China for Persons Engaging in Road Transport shall apply, mutatis mutandis, to the format of qualification certificates. | | 从业资格证式样参照《中华人民共和国道路运输从业人员从业资格证》式样。 |
| The use of qualification certificates shall be encouraged and promoted. Where an electronic certificate is used, such a certificate shall include the relevant information confirmed by the format of the certificate. | | 鼓励推广使用从业资格电子证件。采用电子证件的，应当包含证件式样所确定的相关信息。 |
| Article 15 To provide taxi services to passengers beyond the scope as approved by the issuing authority of the qualification certificate, a taxi driver shall take the local examination on regional subjects. If the taxi driver passed the examination on regional subjects, the taxi administrative department at the level of a districted city shall issue a qualification certificate to him or her. | | 第十五条 出租汽车驾驶员到从业资格证发证机关核定的范围外从事出租汽车客运服务的，应当参加当地的区域科目考试。区域科目考试合格的，由当地设区的市级出租汽车行政主管部门核发从业资格证。 |
| Chapter III Registration | | 第三章 注 册 |
Article 16 A taxi driver who has obtained a qualification certificate may provide taxi services to passengers only after his or her qualification is registered with the taxi administrative department.
