| Advancing the building of the diversified resolution mechanism for financial disputes is an important measure for unblocking the remedy channels for the rights of financial consumers, satisfying the people's increasing judicial and financial demands, preventing and resolving financial risks, and maximizing the functional roles of the people's courts and financial administrative departments in modernizing the national governance system and capacity. For the purpose of implementing the Opinions of General Office of the CPC Central Committee and the General Office of the State Council on Improving the Diversified Resolution Mechanism for Conflicts and Disputes, the Guiding Opinions of the General Office of the State Council on Strengthening the Protection of Financial Consumers' Rights and Interests, and the Opinions of the Supreme People's Court on Further Deepening the Reform of the Diversified Dispute Resolution Mechanism by the People's Courts, the following opinions on comprehensively deepening the building of the diversified resolution mechanism for financial disputes are hereby raised: | | 推进金融纠纷多元化解机制建设，是畅通金融消费者权利救济渠道、满足人民群众日益增长的司法和金融需求、防范化解金融风险、充分发挥人民法院和金融管理部门在国家治理体系和治理能力现代化中的职能作用的重要举措。为贯彻落实《中共中央办公厅国务院办公厅关于完善矛盾纠纷多元化解机制的意见》《国务院办公厅关于加强金融消费者权益保护工作的指导意见》《最高人民法院关于人民法院进一步深化多元化纠纷解决机制改革的意见》，现就全面深化金融纠纷多元化解机制建设工作提出以下意见： |

| 2. Principle of legality and impartiality. The diversified resolution of financial disputes may not violate the basic principles of law and may not impair the national interests, collective interests, and lawful rights and interests of third parties. | | 2.依法公正原则。金融纠纷多元化解工作不得违反法律的基本原则，不得损害国家利益、集体利益和第三人合法权益。 |

The people's courts at all levels shall maximize their judicial functions and steadily advance the diversified resolution of financial disputes in the overall work of vigorously advancing the building of diversified dispute resolution mechanism and modern litigation service system and realizing one-stop dispute resolution and litigation services. The PBC and its branch offices shall, jointly with the CBIRC and its dispatched offices, prepare the overall planning and local planning for the development of financial dispute mediation organizations and advance the building of non-litigation third-party resolution mechanism of financial disputes. The people's courts at all levels, the PBC and its branch offices, the CBIRC and its dispatched offices (hereinafter referred to as the “financial administrative departments”) shall voluntarily integrate into the building of the dispute source governance mechanism under the leadership of the Party committees and governments, strengthen communication and coordination with the relevant departments, and solve difficulties in the building of the diversified resolution mechanism for financial disputes. | | 3.各级人民法院要充分发挥司法职能，在大力推进多元纠纷解决机制和现代化诉讼服务体系建设、实现一站式纠纷解决和一站式诉讼服务的工作大局中，扎实推进金融纠纷多元化解工作。中国人民银行及其分支机构会同中国银行保险监督管理委员会及其派出机构等，制定金融纠纷调解组织发展总体规划及地方规划，推动金融纠纷非诉第三方解决机制建设。各级人民法院和中国人民银行及其分支机构、中国银行保险监督管理委员会及其派出机构（以下简称金融管理部门）要主动融入党委和政府领导的诉源治理机制建设，加强与有关部门沟通协调，解决金融纠纷多元化解机制建设中的困难。 |
| (2) Strengthening the Building of Mediation Organizations for Financial Disputes | | （二）加强金融纠纷调解组织建设 |
| 4. Establishing and improving mediation organizations for financial disputes. As business guidance entities, the financial administrative departments shall advance the establishment of a system of mediation organizations for financial disputes with wide coverage, strong adaptability, and efficiency and convenience for the people. The financial administrative departments and financial institutions shall be encouraged to provide necessary office and personnel support for mediation organizations for financial disputes. The mediation organizations for financial disputes shall attach importance to optimizing the governance structure and establishing rules and systems, and improve the service efficiency. | | 4.建立完善金融纠纷调解组织。金融管理部门作为业务指导单位，推动建立健全覆盖面广、适应性强、高效便民的金融纠纷调解组织体系。鼓励金融管理部门、金融机构为金融纠纷调解组织提供必要的办公场地、人员支持。金融纠纷调解组织要注重优化治理结构和建章立制，提升服务效能。 |
5. Intensifying the team development of mediators and fund guarantee. The mediation organizations for financial disputes shall establish and improve the mechanism for selection, authentication, assessment, reward and punishment, and withdrawal of mediators, select mediators based on the standards of neutrality, impartiality, and specialty, establish teams with full-time and part-time mediators, and build the mediation expert database. The training on the political accomplishment, professional ethics, mediation skills, and legal and financial knowledge of mediators shall be strengthened. The mediators shall strictly abide by the requirements for mediation confidentiality and may not illegally disclose case information obtained in the process of performing duties to third parties. The mechanism of fund guarantee shall be established and the case-handling subsidies to mediators shall offset expenses in loss of working time, overtime meal allowance, and traffic allowance in the mediation.
