In order to further strengthen intellectual property rights (“IPR”) trial supervision and operational guidance functions of the Supreme People's Court and the Higher People's Courts, and reasonably balance the workload of the people's courts at all levels, in accordance with the practical situation of people's courts' implementation of the amended Civil Procedure Law in their IPR-related civil trial work, we hereby issue the following notice with respect to adjusting standards for the jurisdiction of local people's courts at different levels over IPR civil cases of the first instance: | |
为进一步加强最高人民法院和高级人民法院的知识产权审判监督和业务指导职能，合理均衡各级人民法院的工作负担，根据人民法院在知识产权民事审判工作中贯彻执行修改后的民事诉讼法的实际情况，现就调整地方各级人民法院管辖第一审知识产权民事案件标准问题，通知如下： |

| I. A Higher People's Court has jurisdiction over IPR civil cases of the first instance when the subject matter of the action has a value of more than 200 million yuan, and IPR civil cases of the first instance when the subject matter of the action has a value of more than 100 million yuan provided that the domicile of a party concerned is outside the court's territorial jurisdiction, or a foreign country or region, Hong Kong, Macao or Taiwan is involved. | | 一、高级人民法院管辖诉讼标的额在2亿元以上的第一审知识产权民事案件，以及诉讼标的额在1亿元以上且当事人一方住所地不在其辖区或者涉外、涉港澳台的第一审知识产权民事案件。 |

II. The IPR civil cases of the first instance below the standards as specified in Article I of this Notice are within the jurisdiction of the Intermediate People's Courts except for those within jurisdiction of basic-level people's courts which have jurisdiction over a general IPR civil case designated by the Supreme People's Court.
