—The Legality Review of the Enforcement Time Limit for an Administrative Action ——行政行为执法期限的合法性审查
[Adjudication Gist] 【裁判要旨】
Where there is no any explicit provisions on the time limit for the handling of a case for an administrative agency to investigate and punish food illegal acts in laws, regulations, or rules, the regulatory document with legal effect developed by a competent administrative agency at the provincial level in accordance with legal procedures is legally binding upon administrative enforcement activities of administrative agencies at the lower levels. 在法律、法规、规章均未对行政机关查处食品违法行为的办案期限作出明示规定的情况下,省级行政专业主管机关依据法定程序制定的具有法律意义的规范性文件,有权规范、约束下级行政机关的行政执法活动。

 原告:胡某;
 被告:某市市场监督管理局;
 被告:浙江省市场监督管理局;
 第三人:苏州某甲商贸有限公司;
 第三人:苏州某乙商贸有限公司。
 2017年11月21日,被告某市市场监督管理局作出嘉市监处字[2017]19号《行政处罚决定书》,对原告胡某作出以下行政处罚:1.没收27个快递盒内的奶粉,共计爱尔乐1200g三联装7盒、健儿乐1200g三联装4盒、健儿乐900g装97罐、幼儿乐1200g三联装7盒、幼儿乐900g装4罐、学儿乐900g装6罐;2.处奶粉货值金额10倍的罚款397371.20元;3.因公示虚假《食品经营许可证》,处以罚款3万元。原告胡某不服该《行政处罚决定书》,向浙江省食品药品监督管理局(现被告浙江省市场监督管理局)申请行政复议。2018年5月22日,浙江省食品药品监督管理局作出浙集复33[2018]4号《行政复议决定书》,认定原告胡某的违法行为事实清楚,证据确凿,行政处罚决定适用依据正确,内容恰当,但办案时间已超过《浙江省市场监督管理部门行政处罚程序规定》(试行)(浙食药监规[2015]27号)规定的办案期限,确认某市市场监督管理局作出的《行政处罚决定书》违法。原告胡某认为上述《行政处罚决定书》行政处罚主体认定错误,行政处罚程序严重违法,请求:1.撤销被告某市市场监督管理局作出的某市监处字[2017]19号《行政处罚决定书》;2.撤销被告浙江省市场监督管理局(原浙江省食品药品监督管理局)作出的浙集复33[2018]4号《行政复议决定书》。
 【审判】
 法院经审理认为:被告某市市场监督管理局在某市区域内负有食品监管的法定职责。其在发现“婴童物语”网店《食品经营许可证》涉嫌造假后,对位于明新路99号的网店经营场所进行现场执法符合法律规定。且执法人员调查形成的证据材料已形成证据锁链,行政处罚决定认定违法主体正确。同时,鉴于本案奶粉非假冒产品,产品质量合格,没有发生影响他人身体健康的危害后果,执法人员在法律规定范围内酌情予以从轻处罚,没收奶粉并处以货值金额十倍的法定最低额罚款,量罚适当。原告胡某在网店公示虚假《食品经营许可证》的行为系伪造行政机关颁发许可证照的行为,酌情予以从重处罚,处以法定最高额3万元罚款,于法有据。但办案期限超过法定期限,因未对原告胡某的权利和行政处罚结果产生实际影响,故被诉行政处罚决定不必撤销,应当依法确认为程序轻微违法。被诉行政复议决定符合法定程序,认定事实清楚,适用法律正确,原告胡某要求撤销行政复议决定于法无据,故对其诉讼请求不予支持。综上,法院判决驳回原告胡某的诉讼请求。一审宣判后,原告胡某不服,向杭州市中级人民法院提起上诉。
