| Chapter I General Provisions | | 第一章 总 则 |
| Article 1 For the purposes of implementing the principle of giving special and preferential protection to minors, strengthening the management of faculty and staff members of schools, and preventing sexual assaults on minors by taking advantage of one's profession, these Opinions are formulated in accordance with the Criminal Law of the People's Republic of China, the Criminal Procedure Law of the People's Republic of China, the Law of the People's Republic of China on the Protection of Minors, the Public Security Administration Punishments Law of the People's Republic of China, the Teachers Law of the People's Republic of China, and the Employment Contract Law of the People's Republic of China. | | 第一条 为贯彻未成年人特殊、优先保护原则，加强对学校教职员工的管理，预防利用职业便利实施的性侵未成年人违法犯罪，根据《中华人民共和国刑法》《中华人民共和国刑事诉讼法》《中华人民共和国未成年人保护法》《中华人民共和国治安管理处罚法》《中华人民共和国教师法》《中华人民共和国劳动合同法》等法律，制定本意见。 |
| Article 2 The Supreme People's Procuratorate, the Ministry of Education and the Ministry of Public Security shall jointly establish an information sharing mechanism. The Ministry of Education shall coordinate and guide educational administrative departments at all levels, as well as teacher qualification certification bodies, to implement an inquiry system for the admission of faculty and staff members. The Ministry of Public Security shall assist the Ministry of Education in inquiring about relevant information. The Supreme People's Procuratorate shall conduct legal supervision of related work. | | 第二条 最高人民检察院、教育部与公安部联合建立信息共享工作机制。教育部统筹、指导各级教育行政部门及教师资格认定机构实施教职员工准入查询制度。公安部协助教育部开展信息查询工作。最高人民检察院对相关工作情况开展法律监督。 |
| Article 3 For the purpose of these Opinions, “schools” means primary and secondary schools (including secondary vocational schools and special education schools) and kindergartens. | | 第三条 本意见所称的学校，是指中小学校（含中等职业学校和特殊教育学校）、幼儿园。 |

| Article 4 For the purpose of these Opinions, “information on sexual assault offenses” means information on illegal or criminal conduct that meets the following conditions; and the Ministry of Public Security shall establish a database of information on sexual assault offenders in accordance with the provisions of this Article, including: | | 第四条 本意见所称的性侵违法犯罪信息，是指符合下列条件的违法犯罪信息，公安部根据本条规定建立性侵违法犯罪人员信息库： |
(1) information on persons who have been pronounced guilty by the people's courts in accordance with the law for committing the crime of rape, forcible indecency, or child molestation as prescribed in Article 236 and Article 237 of the Criminal Law;
