Guiding Opinions on Further Doing a Good Job in the Trial of Agriculture-related Civil Cases under the Current Situation | |
关于当前形势下进一步做好涉农民事案件审判工作的指导意见 |
In the wake of the spread of the international financial crisis, the number of agriculture-related civil cases has greatly increased, which brings along with it new circumstances and problems. Giving full play to the functional roles of the people's courts in the trial work, doing a good job in the trial of agriculture-related civil cases and actively coping with challenges presented by the international financial crisis are important tasks of the civil trial work of the people's courts in a near future and particularly this year. The people's courts at all levels shall stick to the concept of socialist rule of law, erect the awareness of serving the whole situation and exercising justice for the people, and recognize the significance of doing a good job in the trial of agriculture-related cases under the current situation especially under the impact of the international financial crisis. To effectively regulate the trial of agriculture-related civil cases under the current situation, the following opinions are given pursuant to the relevant laws and state policies: | |
当前，受国际金融危机不断蔓延和扩散的影响，涉农民事案件数量大幅上升，案件中出现了许多新情况和新问题。充分发挥审判职能作用，做好涉农民事案件审判工作，积极应对国际金融危机带来的挑战，是今后一段时期特别是今年人民法院民事审判工作的重要内容。各级人民法院要认真坚持社会主义法治理念，牢固树立为大局服务、为人民司法的意识，深刻认识开展好当前形势下，特别是国际金融危机影响下涉农民事审判工作的重要意义。为切实抓好当前形势下涉农民事案件审判工作，根据相关法律和国家政策规定，特提出以下意见： |

We shall strictly implement the Real Right Law, the Rural Land Contracting Law, the Interpretation of the Supreme People's Court on Issues Concerning the Application of Law in the Trial of Cases of Rural Land Contracting Disputes and other relevant laws and judicial interpretations, and make more efforts in the trial of cases of disputes about infringing upon the right to land contracting management, especially farmers' rights to land contracting management, that arise when land is taken back or adjusted in violation of law so as to effectively protect farmers' rights and interests in land contracting management. | | 一、严格执行物权法、农村土地承包法以及最高人民法院《关于审理涉及农村土地承包纠纷案件适用法律问题的解释》等法律、司法解释的相关规定，加大对违法收回、调整承包地等侵害土地承包经营权，尤其是侵害农民工土地承包经营权各项权益纠纷案件的审判力度，切实维护农民土地承包经营各项权益。 |

2. We shall make overall arrangements on the coordination of the relationship between protecting the right to land contracting management and enhancing the circulation of the right. The principal target of the work on enhancing the circulation of the right to land contracting management lies in increasing farmers' income and improving the development level and competitiveness of agriculture. Therefore, we need to, on the principle of doing good to both the orderly and legal circulation of the right to land contracting management and the protection of farmers' rights and interests in land contracting management, conduct well the trial of cases of disputes over infringement upon farmers' rights to land contracting management in the name of the circulation of the right to land contracting management in violation of the relevant laws or state policies.
．．．．．． | | 二、统筹协调维护土地承包经营权与促进土地承包经营权流转之间的关系。促进土地承包经营权流转，重要目标在于增加农民收入、提高农业发展水平和竞争力。要按照既有利于土地承包经营权有序流转和规范流转，也有利于农民土地承包各项合法权益充分保障的原则，切实审理好有关违反法律、国家政策规定，借土地承包经营权流转之名损害农民土地承包经营权的纠纷案件。
