利莱森玛公司、利莱森玛电机科技（福州）有限公司与利玛森玛（福建）电机有限公司侵害商标权、擅自使用他人企业名称纠纷上诉案（福建省高级人民法院[2012]闽民终字第819号民事判决书） @#
【案情摘要】利莱森玛公司是292016号 以及第G633661号“LEROY-SOMER”注册商标所有人。2000年，麦格乃泰克（福州）发电机有限公司变更企业名称为利莱森玛（福州）发电机有限公司，2005年再次变更为利莱森玛电机科技（福州）有限公司（简称利莱森玛福州公司）。利莱森玛公司授权利莱森玛福州公司使用上述两个注册商标，并出具书面函确认其有权共同提起商标侵权和不正当竞争诉讼。2004年福安市佳能电机有限公司成立，2005年12月5日变更企业名称为利莱森玛（福建）电机有限公司（简称福建利莱森玛公司）。福建利莱森玛公司申请注册了“ 利莱森玛（图1）”、“ 利莱森玛（图2）”商标，其生产、销售的发电机产品上使用了“ 利莱森玛（图2）”标识，发电机铭牌标注的企业名称为“LEROYSOMMER FUJIAN ELECTRIC MACHINERY CO.,LTD.”，无中文企业名称；产品宣传册及《使用维护说明书》中均使用“利莱森玛（图1） ”标识。利莱森玛公司、利莱森玛福州公司认为福建利莱森玛公司在产品及广告宣传中使用上述标识侵犯其注册商标专用权，使用含有“利莱森玛”字号的企业名称及“LEROYSOMMER”英文字号构成不正当竞争，向宁德市中级人民法院提起诉讼，请求判令停止侵权、赔偿经济损失2141944元。一审法院“利莱森玛”与利莱森玛公司注册商标不相近似，福建利莱森玛公司不构成侵犯商标权及不正当竞争，判决驳回诉讼请求。利莱森玛公司、利莱森玛福州公司提起上诉，福建省高级人民法院二审认为，利莱森玛公司及其注册商标中的LEROY SOMER在电机行业具有较高的知名度和美誉度，利莱森玛公司在相关商业活动中，LEROY SOMER对应的中文译名是“利莱森玛”，二者已经形成固定的对应关系。在此情况，福建利莱森玛公司在电机产品上及企业名称中使用“利莱森玛”、“LI LAI SEN MA”及“LEROYSOMMER”等行为，侵犯了利莱森玛公司的注册商标专用权，亦构成不正当竞争。因此判决撤销一审判决，福建利莱森玛公司停止相关侵权行为并变更企业名称，赔偿经济损失及合理支出100万元。@#
