Du Haisheng and Du Mansheng, the plaintiffs, brought a lawsuit with the People's Court of Pingding County, Shanxi Province (hereinafter referred to as Pingding District Court) against Du Xisheng for a dispute over house property right.@#
Du Haisheng and Du Mansheng alleged: The three bungalows and one horse stable in question were purchased by Du Yongsheng, a third person, for the whole family, and the fact could be proved with the house site use certificate. However, Du Xisheng intended to possess the house property all by himself. The two plaintiffs pleaded the court to lawfully confirm that the house property in question should be owned by the whole family.@#

原告杜海生、杜满生因与被告杜喜生发生房产确权纠纷,向山西省平定县人民法院提起诉讼。@#
原告杜海生、杜满生诉称;争议的平房三间、马棚一间,是第三人杜永生为全家人购买的,有宅基地使用证为凭。现被告杜喜生准备将此房据为己有。请求依法确认争议房屋的产权为全家人共有。@#
被告杜喜生辩称:争议房屋是第三人杜永生买下后准备以原价转让给我的,故在宅基地使用证上写明户主是我。既然原告想争此房产,我可以不要,但须物归原主杜永生。@#
第三人杜永生称:被告杜喜生所辩属实。因杜喜生身有残疾,故我买下此房后准备以原价转让给他一人所有,并不包括其他家庭成员。@#
平定县人民法院经公开审理查明:本案当事人系同胞兄妹。他们的父亲于1977年去世后,第三人杜永生即成家另过,只留母亲杨三妮和被告杜喜生、原告杜海生和杜满生以及第三人杜海鱼在一起生活。1984年,杜永生以700元价款买下村里的平房三间、马棚一间。1986年,杜永生出面为此房产申领了“宅基地使用证”,证内填明户主是杜喜生,家庭成员为五口人。该村的宅基地清查登记表上记载,宅基地使用证上所填的五口人,是户主杜喜生家庭成员杨三妮、杜海生、杜满生、杜海鱼。这五口人曾对此房产管理使用过一段时间。1987年杨三妮去世。1992年4月原告、被告之间因家务发生纠纷,杜永生在此时声称争议房产只转让给杜喜生一人所有,并将他保存的宅基地使用证上所填的“五口”人改为“一口”人。同年7月,杜喜生以1800元价款将争议房产出租给邻居卢维柱使用。杜海生、杜满生以房产是全家共有财产为由,提起确权诉讼。@#
平定县人民法院认为:第三人杜永生以700元价款购得争议房产,依照《中华人民共和国民法通则》第七十一条、第七十二条的规定,是该房产的合法所有权人,依法享有对该房产占有、使用、收益和处分的权利。杜永生在自己申办的宅基地使用证上已经声明户主是杜喜生,家庭成员是杜喜生、杨三妮、杜海生、杜满生、杜海鱼五口人,这是杜永生对自己所有的财产行使处分权的行为,意思表示真实,实属自愿转让。宅基地使用证是合法有效的证件,应当予以保护。以杜喜生为户主的全家五口人,在杜永生申办了宅基地使用证后,已经对此房产进行管理使用,至此,杜永生对争议财产的所有权,已合法转让给以杜喜生为户主的五口人共有。在家庭发生纠纷后,杜永生对自愿转让产权的行为翻悔,私自涂改宅基地使用证上的记载事项,声称只转让给杜喜生一人所有。根据最高人民法院《关于贯彻执行<中华人民共和国民法通则>若干问题的意见(试行)》第85条“财产所有权合法转移后,一方翻悔的,不予支持”的规定,对杜永生的翻悔行为,不予支持。据此,平定县人民法院于1994年7月18日判决:讼争之平房三间、马棚一间属杜喜生、杜满生、杜海生、杜海鱼及其母杨三妮五人共同所有。@#
