Defendant: He Dexu, male, 48 years old, former worker of the No.1 Furniture Factory of Chongqing of Sichuan Province, arrested on July 9, 1986.@#
In 1982, for solicitation of bribes and embezzlement of 647 yuan during the sale of theater seats for the No.1 Furniture Factory of Chongqing, the defendant, He Dexu, was given the sanctions of major demerit, deduction of bonus and return of illicit money by the factory. He Dexu was very dissatisfied with it, thinking that Ye Zubi, the General Branch Secretary of the Communist Party of the Factory, disciplined him on purpose, and an evil idea of retaliation occurred to him. From January 1983 to March 1984, He Dexu continually wrote 22 letters to the leading authorities and the political and legal departments of Chongqing city and Sichuan province, fabricating the criminal facts that Ye Zubi had embezzled and stolen state and collective property by himself and in collusion with others and took bribes at a total value exceeding 10,000 yuan, and requesting investigation of Ye Zubi's criminal liabilities according to the relevant provisions of the Criminal Law.@#

被告人：何德绪，男，４８岁，原系四川省重庆家具一厂工人。１９８６年７月９日被逮捕。@#
被告人何德绪于１９８２年在为重庆家具一厂推销影剧院椅工作中，因索贿、贪污６４７元，工厂给予记大过、扣发奖金和退赔赃款的处分。何德绪对此极为不满，认为是厂党总支书记叶祖碧整他，遂产生报复恶念。１９８３年１月至１９８４年３月，何德绪先后向四川省、重庆市领导机关和政法部门写信２２封，捏造叶祖碧单独或伙同他人贪污、盗窃国家和集体财产、收受贿赂达万元以上的犯罪事实，要求按照刑法有关规定，追究其刑事责任。@#
被告人何德绪因诬告陷害一案，由四川省重庆市人民检察院向重庆市中级人民法院提起公诉。重庆市中级人民法院受理该案后，依法组成合议庭，经公开审理查明：@#
１９７９年９月至１９８２年初，重庆家具一厂修建厂房，何德绪是基建办公室成员之一，明知基建工程由厂长付××负责，叶祖碧不分管基建，明知承建单位提取部分施工费是用于工地招待开支，却捏造叶祖碧收受工程队回扣贿赂７７００元。@#
重庆家具一厂在修建厂房中，与承建单位签订的施工合同规定：“工程中不能用计件工资结算者，可协议按计时工或其他形式付工资”。何德绪不仅明知此规定，而且五次在计时工单中分别以计价员、记录员的身份签字报销，并明知叶祖碧与此事无关，却故意捏造叶祖碧伪造大量计时工资，贪污１０００元。@#
