1. Basic Facts (一)基本案情
On January 7, 2001, Liu Zirong, deputy director of No. 3 Mine in Tiechanggou Town, Miquan City, Xinjiang (hereinafter referred to as the “Mine”), learned that the roof of the coal-bed drilling cavern in the mine had been emptied, which would pose a safety hazard to coal production. In order to ensure safe coal production, around 10:00 p.m. on January 8, Liu Zirong and blaster Yu Yuangui were converting an instantaneous electric detonator to a delay electric detonator in the employees' dormitory. The detonator exploded, blasted off Liu's left thumb, index finger and middle finger and injured his left ring finger. After the accident happened, the Mine immediately sent Liu Zirong to the hospital to for medical treatment and paid all his medical expenses. On March 21, the Mine and Liu Zirong reached a compensation agreement, and the Mine should give Liu Zirong a lump-sum stipend of 15,000 yuan for future living expenses and nutrition fees. On April 9, Liu Zirong applied for determination of a work-related injury to Miquan Municipal Bureau of Human Resources and Social Security (hereinafter referred to as “Miquan Human Resources Bureau”). On July 3, 2002, Miquan Human Resources Bureau issued the Decision on Non-Determination of a Work-Related Injury in Liu Zirong's Case (hereinafter referred to as the “Decision”). 2001年1月7日,新疆米泉市铁厂沟镇三矿副矿长刘自荣得知矿井煤层采仓仓顶被拉空,将给煤矿生产安全带来隐患。为保证煤矿安全生产,1月8日晚10时许,刘自荣与炮工余远贵一起在职工宿舍内,将瞬发电雷管改制成延期电雷管时,雷管爆炸,将刘自荣的左手拇指、食指、中指炸去,无名指受伤。事发后,铁厂沟镇煤矿立即将刘自荣送往医院救治,并承担了刘自荣的全部医疗费用。3月21日,铁厂沟镇煤矿与刘自荣达成赔偿协议,由铁厂沟镇煤矿给刘自荣今后生活费、营养费一次性补助15000元。4月9日,刘自荣向米泉市劳动局申请工伤认定。2002年7月3日,米泉市劳动局作出《关于不予认定刘自荣为工伤的决定》(以下简称《决定》)。

 米泉市人民法院一审以米泉市劳动局适用法律、法规错误为由,判决撤销米泉市劳动局的《决定》。
 昌吉回族自治州中级人民法院二审认为,米泉市劳动局对刘自荣的工伤申请所作的认定决定,认定事实清楚,适用法律正确,决定程序合法,判决撤销米泉市人民法院一审行政判决,维持米泉市劳动局的《决定》。
