The plaintiff Chen Weili instituted the action to the People's Court of Guanghan City, Sichuan Province against the defendant Lai Guofa for the dispute of employment contract.@#

In his complaint, the plaintiff asserted that when he was employed by the defendant Lai Guofa to watch over the truck for carrying sands, He was thrown down by a truck and his left leg was nipped to broken, which was identified to be the fifth degree of disability. The plaintiff requested a judgment to order the defendant to pay damages for work-related injury as follows: medical expenses in the amount of RMB3,944.20, hospitalization fee in the amount of RMB2,800, living grant-in -aid for hospitalization in the amount of RMB900, nursing fee in the amount of RMB2,000, a lump-sum disability pension in the amount of RMB70,560, a lump-sum disability grant-in-aid in the amount of RMB8,960, a lump-sum medical grant-in-aid in the amount of RMB7,840, wheelchair fee for disabled person in the amount of RMB12,800, and attorney fee, travel expenses in the amount of RMB200, which sunned up to RMB111,760.20, and bear all the costs for this case.@#

原告陈维礼因与被告赖国发发生雇佣合同纠纷,向四川省广汉市人民法院提起诉讼。@#
原告诉称:我在受雇为被告赖国发看管运沙车期间,被汽车摔下夹断左腿,经鉴定为五级伤残。请求判令被告给我赔偿因工致伤的医疗费3944.20元、住院费2800元、住院生活补助费900元、护理费2000元、一次性伤残抚恤金70560元、一次性伤残补助金8960元、一次性医疗补助费7840元、残疾人轮椅费12800元以及律师费、差旅费2000元,合计111760.20元,并承担本案诉讼费。@#
被告辩称:本案是劳动争议,依法应先进行劳动争议仲裁。此次损害的发生,是因原告严重违反操作程序所致,过错在原告方。况且被告已对原告进行了及时救助,双方还对善后处理达成协议,由被告给原告一次性补偿1000元后,不再承担其他责任。该协议履行后,原告又由于自己的原因加重了伤情,不应由被告承担责任。@#
广汉市人民法院经审理查明:@#
原告陈维礼从1996年8月起受雇为被告赖国发工作,主要工作是跟随赖国发经营的运沙车,为汽车换轮胎、在倒车时给主车连接拖车的转动三角架上插插销固定方向、提醒驾驶员注意安全等。双方口头约定,赖国发每月付给陈维礼工资300元,负责吃、住。同年10月7日晚,运沙车在成都某地卸沙需要倒车,此时上下插销孔错位,必须等车辆在运动中将插销孔正位后才能完成插插销的动作,陈维礼便跳上主、拖车之间的三角架,准备在车辆运行中插插销。主车倒车时,陈维礼在三角上未站稳,左脚滑进三角架内,被正在转正的三角架将左腿夹断。@#
原告陈维礼当日被送华西医科大学附属第一医院住院治疗。住院期间,陈维礼之父因生活所迫,与被告赖国发达成由赖负担此次住院期间的一切开支,并再支付1000元继续治疗费用,今后不再承担其他责任的善后处理协议。据此协议,陈维礼于1996年10月21日出院,出院的诊断结论为:左胫骨开放性骨折,左小腿及皮肤撕脱伤;患者及家属要求出院;出院后注意加强营养、及时换药,回当地医院继续治疗。赖国发支付了此次住院期间的全部医疗费。@#
原告陈维礼回家后,在中江县龙台中心卫生院继续住院治疗,后因家庭经济困难无力治疗而出院,共用去医疗费2643.20元。出院后,陈维礼多次请求广汉市连山镇法律服务所协助解决要求被告赖国发赔偿损失一事未果,遂在四川省德阳市法律援助中心提供的法律援助下提起诉讼。1999年7月23日,陈维礼的伤情经德阳市中级人民法院临床法医学鉴定,为五级伤残。@#
另查明:1995年1月13日,被告赖国发同广汉市连山运输社达成协议,约定由赖国发自己购车加入运输社,车辆由赖国发自己经营,运输社负责管理及协调各种关系并收取一定费用。涉案汽车(车牌号为川F30491)就是赖国发根据这项协议购置的,车辆行驶证和其他相关手续均登记为广汉市连山运输社。@#
