| Defendant Yuan Qiaoe was in charge of Huaxia Craft Factory (a sole proprietorship enterprise) in Yunhe County, Zhejiang Province, but ran the business together with her husband, Xia Genfa (handled in another case). The factory failed to pay employees' wages as early as the beginning of 2011. In early September 2011, Yuan Qiaoe and Xia Genfa suddenly disappeared and they were not available on their mobile phones. On September 9, the Human Resources and Social Security Bureau of Yunhe County issued an order demanding that Huaxia Craft Factory pay the wages it owed to its employees before September 13. On the same day, the People's Court of Yunhe County placed a lien on the machinery and equipment of Huaxia Craft Factory. On September 21, because Yuan Qiaoe and Xia Genfa failed to perform the order before the scheduled date, the People's Court of Yunhe County initiated a case for official investigation. On October 8, Yuan Qiaoe went to the People's Court of Yunhe County to verify the amount of wages owed to the employees. Upon the court's judgment and mediation, it was determined that Huaxia Craft Factory owed employees' wages in the amount of 290,270.52 yuan. In late October, Yuan Qiaoe vanished again, but this time she changed her telephone number. On January 15, 2012, the case was transferred to the Public Security Bureau of Yunhe County, and a criminal case was initiated the following day. On January 19, Yuan Qiaoe surrendered herself to the Public Security Bureau of Yunhe County and truthfully confessed the primary facts of her crime. | | 被告人袁巧娥系浙江省云和县华夏工艺厂（系个人独资企业）的负责人，其与丈夫夏根发（另案处理）共同经营该厂。自2011年年初开始，该厂长期拖欠工人工资。2011年9月初，袁巧娥与夏根发突然逃匿，手机关机无法联系。9月9日，云和县人事劳动保障局发出指令书，指令华夏工艺厂于9月13日前支付拖欠的工人工资。同日，云和县人民法院对华夏工艺厂的机器设备进行了财产保全。9月21日，因袁巧娥与夏根发未如期履行，云和县人民法院正式立案调查。10月8日，袁巧娥到云和县人民法院核对拖欠的工人工资情况。经法院判决和调解，华夏工艺厂拖欠工人工资共计人民币290270.52元。10月下旬，袁巧娥再次逃匿，并改变联系方式。2012年1月15日，该案被移送至云和县公安局，并于次日被立刑事案件。1月19日，袁巧娥自动到云和县公安局投案，并如实供述了主要犯罪事实。 |
