The integrated circuit layout design right is an independent intellectual property right and a proprietary right for right holders to reproduce and commercially exploit the layout designs. 华润矽威科技（上海）有限公司（以下简称矽威公司）享有用于LED照明用的PT4115集成电路布图设计专有权。南京源之峰科技有限公司（以下简称源之峰公司）与案外人华润半导体国际有限公司（以下简称华润半导体公司）订立协议开发1360集成电路。源之峰公司对矽威公司销售的PT4115芯片进行了反向剖析，形成1360集成电路的布图设计，并提供给华润半导体公司，获得10万元设计费。华润半导体公司委托第三方生产1360管芯并优先销售给源之峰公司，源之峰公司将管芯封装后，编码成6808、6807等系列集成电路向市场销售并获利。矽威公司以源之峰公司侵犯其集成电路布图设计专有权为由，向江苏省南京市中级人民法院提起诉讼。@#
