Anyang Xiangyu Medical Equipment Co., Ltd. (hereinafter referred to as “Xiangyu Company”) raised a claim for declaring the invalidity of a utility patent (No. 94119284.9, titled “multi-function moxibustion therapeutic instrument”) owned by Cui Xuewei and upon examination, the Patent Re-examination Board made an administrative decision on affirming the validity of the patent in this case. Xiangyu Company refused to accept the alleged decision and filed an administrative lawsuit with the Intellectual Property Court of Beijing Municipality.
