| | 2007年5月23日，原告乔福玉与被告荥阳市滨湖花园社会福利服务中心（简称滨湖福利中心）就原告为被告拉土方款进行结算，确认被告尚欠原告226144元，被告用一台装载机（原价24.5万元）抵偿给原告，原告当日给付被告车款8800元并将该装载机开走。约定余下1万元车款待被告向原告交付装载机发票时原告再行支付，同时注明：如果装载机购车手续出现经济纠纷，由被告负责。2008年3月下旬，张庆华持该车的租赁合同、合格证等相关手续，声称是该车车主，将装载机开走。 |
| | 另查明，2007年3月22日，福建晋工机械有限公司(简称晋工公司)驻郑州办事处负责人张庆华与樊天才签订工程机械租赁合同一份，约定樊天才向晋工公司租赁ZL50D装载机一台，装载机价款24.5万元，租期6个月，每月租金4万元，租赁期间装载机的所有权属于晋工公司，樊天才不得有将装载机销售、转租、抵押或其他任何侵犯晋工公司所有权的行为。同日，樊天才出具委托收回车辆拍卖授权书一份，主要内容为：“本人于2007年3月22日在贵公司分期购买ZL50D工程机械车辆一台，车辆总价值24.5万，其中首付5万元，余款19.5万元，期限六个月。余款将于10月22日前还清，若到期未还清欠款，则委托贵公司依法收回该车辆并拍卖该车辆。”樊天才交付5万元保证金后接收该装载机，后以该装载机抵购房款将车交给被告。樊天才自接收装载机后，共向晋工公司支付7万余元车款。 |
