In accordance with the Criminal Law , the crime of abuse of power refers to a state official's act of abusing power, which causes “heavy loss to the public property or the interests of the state and people.” In practice, where the abuse of power “causes egregious impacts on society,” it should be determined as abuse of power causing “heavy loss to the public property or the interests of the state and people.”

From August 2008 to December 2009, Luo Jianhua, Luo Jingtian, Zhu Bingcan, and Luo C were recruited as enforcement assistants of the Dasha Street law enforcement team of Huangpu Branch of the Comprehensive Enforcement Bureau for Urban Administration of Guangzhou City (“law enforcement team”) by the Dasha Sub-district Office of the People's Government of Huangpu District, Guangzhou City. The duty of the four defendants was to assist in the urban administration of the sub-district, including patrol and participation in routine urban administration of the sub-district and communities; dissuading, preventing, and demanding correction of acts that violate the regulations on urban administration; and cooperating with the comprehensive law enforcement department in carrying out unified enforcement campaigns. Their tasks included a combination of patrol and stakeout and the timely dissuasion of unlawful stalls in central urban areas. From August 2009 to May 2011, Luo Jianhua and Luo Jingtian were respectively the leader and deputy leader of the enforcement assistant team. Later, Luo Jingtian acted as the team leader, and Luo Jianhua as the deputy leader. The team leader was responsible for convening enforcement assistants, allocating road sections during work hours, and checking attendance; and the deputy leader was responsible for assisting the team leader in carrying out daily work and performing the team leader's duty when the team leader was absent. When the four defendants worked, they wore battle fatigues that were uniformly delivered, with red sleeve emblems on the arm, reading “Assistant for Urban Administration of Dasha Street,” and carried a wooden stick. From August 2010 to September 2011, Luo Jianhua, Luo Jingtian, Zhu Bingcan, Luo C, and Luo Huihong(handled in another case), by taking advantage of their positions, solicited cash in small amounts such as 12 yuan, 10 yuan, and 5 yuan and cigarettes from unlicensed vendors many times, or directly took cigarettes from “Shiduo store” located at the road section at the expense of some unlicensed vendors, in exchange for nonperformance of their duty, to permit those that offered them benefits to continue illegal operations at places where unlicensed stalls were prohibited. The acts of the defendants caused serious occupation of streets by unlicensed vendors. There were hundreds of vendors setting up stalls at will, which had severely affected the city appearance and environmental sanitation and brought great inconvenience to the operations, lives, and travels of shops and residents along the streets. They were indifferent to the unlawful operations of vendors that offered money or property to them, and dispersed or notify the urban administration department in order to punish on the site those that did not. The enforcement caused strong resentment from the people, and enforcement officers of the urban administration department encountered violent resistance to public administration in their performance of official duties, and several enforcement officers were injured and hospitalized. The acts of the four defendants severely endangered and affected the social order, economic order, urban administration, and security administration of the region, and caused egregious impacts on society.

 2008年8月至2009年12月期间,被告人罗建华、罗镜添、朱炳灿、罗锦游先后被广州市黄埔区人民政府大沙街道办事处招聘为广州市城市管理综合执法局黄埔分局大沙街执法队(以下简称“执法队”)协管员。上述四名被告人的工作职责是街道城市管理协管工作,包括动态巡查,参与街道、社区日常性的城管工作;劝阻和制止并督促改正违反城市管理法规的行为;配合综合执法部门,开展集中统一整治行动等。工作任务包括坚持巡查与守点相结合,及时劝导中心城区的乱摆卖行为等。罗建华、罗镜添从2009年8月至2011年5月担任协管员队长和副队长,此后由罗镜添担任队长,罗建华担任副队长。协管员队长职责是负责协管员人员召集,上班路段分配和日常考勤工作;副队长职责是协助队长开展日常工作,队长不在时履行队长职责。上述四名被告人上班时,身着统一发放的迷彩服,臂上戴着写有“大沙街城市管理督导员”的红袖章,手持一根木棍。2010年8月至2011年9月期间,罗建华、罗镜添、朱炳灿、罗锦游和罗慧洪(另案处理)利用职务便利,先后多次向多名无照商贩索要12元、10元、5元不等的少量现金、香烟或直接在该路段的“士多店”拿烟再让部分无照商贩结账,后放弃履行职责,允许给予好处的无照商贩在严禁乱摆卖的地段非法占道经营。由于上述被告人的行为,导致该地段的无照商贩非法占道经营十分严重,几百档流动商贩恣意乱摆卖,严重影响了市容市貌和环境卫生,给周边商铺和住户的经营、生活、出行造成极大不便。由于执法不公,对给予钱财的商贩放任其占道经营,对其他没给好处费的无照商贩则进行驱赶或通知城管部门到场处罚,引起了群众强烈不满,城市管理执法部门执法人员在依法执行公务过程中遭遇多次暴力抗法,数名执法人员受伤住院。上述四名被告人的行为严重危害和影响了该地区的社会秩序、经济秩序、城市管理和治安管理,造成了恶劣的社会影响。
