| | (一)基本案情 |
| | 日本富士化水工业株式会社(下称“富士化水”)、华阳电业有限公司(下称“华阳公司”)侵犯武汉晶源环境工程有限公司(下称“晶源公司”)发明专利权纠纷一案,福建省高级人民法院于2008年5月12日作出一审判决,晶源公司、富士化水、华阳公司均不服该判决,向最高人民法院提起上诉,最高人民法院于2009年12月21日作出(2008)民三终字第8号民事判决,判决认定富士化水和华阳公司共同侵犯晶源公司ZL95119389.9号发明专利火电脱硫技术,连带赔偿人民币5016.24万元,并按使用年限支付专利使用费,如支付迟延应按规定加倍支付迟延履行期间的债务利息。判决生效后,富士化水、华阳公司未履行生效法律文书确定的义务,晶源公司向人民法院申请执行。案件执行三年多,申请执行人晶源公司未收到执行款。晶源公司向检察机关申请执行监督。 |
