原告天津市国际信托投资公司气象台路证券交易营业部（以下简称天津国投证券部）因与被告上海申银证券公司发生证券回购纠纷，向天津市高级人民法院提起诉讼。@#
原告诉称，在与被告成交了两笔国债回购交易后，原告依约将购券款计人民币６００万元给付被告，而被告在回购到期后，除对冲１，０５５，３８０元外，余５，２８９，０２０元回购款拖欠至今。故诉请法院判令被告给付回购资金５，２８９，０２０元；支付延付利息７４５４９５元；赔偿经济损失６万元，并承担诉讼费用。@#
被告辩称，原告所诉属实。但由于双方在该笔交易中均有违规行为，故对原告按原协议约定计付延付利息的主张不能同意。@#
天津市高级人民法院经审理查明：原、被告均为天津证券交易中心的特种经纪商，均有在该中心从事国债回购业务的资格。１９９５年８月２日，双方在天津证券交易中心成交了两笔国债回购交易，原告为买入返售方，被告为卖出回购方。在该两笔交易中，原告以１００∶１００的价格分别买入被告价值２００万元和４００万元的国库券，期限分别为三个月和四个月。至１９９５年１１月３日和１９９５年１２月５日，被告应分别以１０６．９６∶１００和１０５．１３∶１００的价格购回。总计回购款为人民币６，３４４，４００元。成交后，原告后１９９５年８月３日通过交易中心将共计６００万元划入被告帐户。但被告在协议到期后未履行给付回购款义务。除１９９６年５月２６日跨场所对冲１，０５５，３８０元外，按原协议计算尚欠原５，２８９，０２０元。@#
