| Defendant Li Ruixia was the legal representative of the prosecuted entity Shanghai Mengkai Chemicals Co., Ltd. (hereinafter referred to as “Mengkai Company”) and Defendants Ma Wenge and Ma Minxue were employees of the Company. For seeking illegal profits, from September 2010 on, Mengkai Company purchased at a low price 258.33 tons of ground-level baking soda produced by Boyuan New Chemicals Co., Ltd. in Tongbai County, Henan Province and 40 tons of baking soda and production equipment from Xuyue Group Co., Ltd. in Inner Mongolia, and meanwhile customized 5,000 pieces of woven bags marked with food additive sodium bicarbonate baking soda. Mengkai Company mixed the aforesaid two types of baking soda in the proportion of 8:1, dried, smashed and packaged such baking soda and sold it to Hangzhou and Quzhou, Zhejiang Province and other places. It has sold a total of 243 tons of shoddy baking soda and the sales amount reached 447,300 yuan. On May 24, 2011, law enforcement officers seized 3.35 tons of finished products, 27.7 tons of raw materials, and production equipment on the production site. It was verified that the finished products of food additive sodium bicarbonate detained in the crime scene were unqualified products. | | 被告人李瑞霞系被告单位上海蒙凯化工有限公司（以下简称“蒙凯公司”）法定代表人，被告人马文革、马民学系公司工作人员。为牟取非法利益，2010年9月起，蒙凯公司低价购入河南省桐柏县博源新型化工有限公司生产的落地级小苏打258.33吨、内蒙古旭月集团有限公司小苏打40吨及生产设备，同时定制标有食品添加剂碳酸氢钠小苏打编织袋5000只。将上述两种小苏打以8∶1的比例混合，并进行烘干、粉碎、包装后，分别销往浙江杭州、衢州等地，共计销售伪劣小苏打243吨，销售金额达人民币44.73万元。2011年5月24日，执法人员在生产现场查扣了成品3.35吨、原料27.7吨及生产设备。经鉴定，从案发现场扣押的食品添加剂碳酸氢钠成品为不合格产品。 |
