【案情摘要】2009年2月，被告人赵学元、赵学保以营利为目的，未经《热血传奇》游戏中国运营商上海盛大网络发展有限公司许可，租用网络服务器，私自架设网络游戏服务器运营“热血传奇”，用银行卡绑定支付平台，供网络游戏玩家通过网银转帐、游戏点卡充值等方式付费。至案发，赵学元运营私服游戏的非法经营数额为629113.70元，赵学保非法经营数额为79663.70元。江苏省连云港市中级人民法院及江苏省高级人民法院均认为：被告人赵学元、赵学保以营利为目的，未经著作权人许可，复制发行其计算机软件作品，情节严重，其二人行为均已构成侵犯著作权罪。对于非法经营额的认定，根据汇款方提供的相应证据，证实通过漯河一五一七三网络科技有限公司、北京通融通信息技术有限公司、天空支付平台、青岛雷网网络科技有限公司、盘锦久网通信网络有限公司等环节，汇入赵学元及赵学保账户中的相关款项均系其从事涉案私服游戏的收入，并不包含被告人从事其他业务的收入，因此，上述款项均应计入本案非法经营数额。被告人赵学元具有立功表现，依法可对其从轻处罚；被告人赵学保认罪态度较好，具有悔罪表现，可以对其适用缓刑。据此判决被告人赵学元、赵学保犯侵犯著作权罪，分别判处有期徒刑三年，并处罚金人民币四十万元、有期徒刑一年六个月，缓刑二年，并处罚金人民币七万元等。@#
